REVISE RESOLUTION NO. 12967 WHICH WOULD APPROVE ANIMAL CONTROL
OFFICERS TO ENFORCE LAWS AND ISSUE CITATIONS FOR ALL CALIFORNIA
STATE CODES PERTAINING TO ANIMALS.
RECOMMENDATION:
It is recommended that City Council approve the modification of Resolution No.
12967 dated April 18, 1979 to read "All Municipal Code provisions relating to
animal control and all state code provisions relating to animal control"
SUMMARY:
This modification of the resolution would extend the abilities of the animal control
personnel to enforce state laws that are located in codes other than the Penal
and Municipal Codes that relate to animal control laws.
BACKGROUND:
Animal Control Officers are currently able to write citations for all Municipal Code
provisions and all California Penal Code provisions related to animals as a result
of Resolution 12967 dated April 18, 1979. This excludes many other state
codes, which could provide additional enforcement abilities.
If the resolution is modified animal control officers will be able to enforce the
provisions of the below listed California codes having to do with animal control
laws:
Vehicle Code
Fish and Game Code
Health and Safety Code
Food and Agriculture Codes
Business and Professions Code
Education Code
Civil Code
Government Code
California state laws requires that all animal control officers who enforce laws
and write citations for violations of animal control laws complete a state
mandated training program. All of the city's current animal control officers have
successfully completed this training.

FISCAL IMPACTS:
By extending the animal control officers ability to write citations for state code
violations having to do with animal control laws, there may be an increase in
revenue derived from such citations.

SPRINGS CALIFORNIA, AMENDING RESOLUTION
12967, DESIGNATING CERTAIN EMPLOYEES AND
OFFICERS AUTHORIZED TO ISSUE ARREST
CITATIONS FOR SPECIAL MISDEMEANOR
VIOLATIONS.
WHEREAS, Resolution No. 12967 was adopted on April 19, 1979, by the City Council of
the City of Palm Springs; and
WHEREAS, the City Council wishes to amend the section concerning officers and
employees designated to exercise the arrest and citation authority conferred by Section
1.08.050 of the Patin Springs Municipal Code as well as the misdemeanors they may cite.
NOW THEREFORE, be it resolved by the City Council of the City of Palm Springs Section
A of Resolution 12967 is hereby amended to read as follows:
Officer or Employee Misdemeanors
A. Police Department
1. Animal Control Supervisor All Municipal Code and other ordinance
Animal Control Officer provisions and all California Code
Assistant Animal Control Officer sections relating to animals as may be
amended from time to time.
