WHEREAS, Bernard Herman is the owner of the following des r�' ed
real property, to-wit:
Beginning at the southeast corner of Section 3, thence
north 00, 111 east 115.63 feet, thence north 890, 431
west 30 feet to the true point of beginning, thence
continuing north 890 431 west 553 A feet to the east
line of California State Highway 111, thence northwest
along the east line of the said State Highway on an
arc 106.37 feet, thence continuing along the east line
of said State Highway north 380 241 west 102.09 feet,
thence south 89' 581 east 680.48 feet, thence south
00 111 west 168.13 feet to the true point of beginning.
The said real property is also known as 2080 North
Palm Canyon Drive.
WHEREAS, the said Bernard Herman applied for a variance to
the City of Palm Springs so as to be able to establish a permanent sign
on a standard within the setback area provided for by the Setback Ordinance
of the City of Palm Springs, being Ordinance No. 265; and
WHEREAS, after a hearing upon the matter the Variance Board
of the City of Palm Springs did grant the said Bernard Herman the right
to place a sign on a standard within the setback area on Via Escuela;
said setback encroachment being granted on the express condition that
should ths'Gity of Palm Springs elect to acquire additional right of way
within the setback area on Via Escuela that the City shall have the
right, upon acquisition of the said area or commencement of condemnation
proceedings to remove the said sign and the said. City shall not be required
to reimburse the said Bernard Herman, his successors in interest or assigns,
for the cost of the erection or maintenance of the said sign; and
WHEREAS, the said Bernard Herman does acquiesein the conditions
attached to the variance granted and does desire to bind himself and his
successors in interest or assigns to these conditions;
NOW THEREFORE BE IT RESOLVED that the owner of the above described
property, Bernard Herman, does hereby agree, promise and covenant on behalf
of himself, his successors in interest and assigns, that should the City
of Palm Springs acquire any of the above described property abutting on
that certain street within the City of Palm Springs known as Via Escuela,
that no compensation shall be payable to the said Bernard Herman, his
successors in interest or assigns for the removal of the sign and standard
now existing within,the forty-five foot (451) setback area.
