Sethack.encroachment-� �A G P E E F� E T T agreement(No. 49) ., i y EEREAS, Max 1"it0borg and ,Pose 10YAWborg, owners of the hereinafter described property in the City of Palm Springs, California, have made application to the Variance Board of the City of Palm Springs for a Variance from the setback: provisions of the Palm Springs Ordinance Code relating to setbacks on Palm Canyon Drive in said City and; VVIIEREAS, said Application, known, as Case No. 6.40, was duly heard by the said Variance Board at a meeting held on June 13, 1955, and a Variance of 10 feet :from the provisions relating to 03 applicants property was approved NOW THEREFORE, Max Wittenberg and Rose Wittenberg, owners of the hereinafter described real property, do hereby accept the Variance granted and upon the conditions stated therein and do agree that ,should the said State Highway, known as Palm Canyon Drive, be uldened and condemnation of abutting property be necessitated that all damages accruing to the property and improvements shall he considered wholly sot off by the benefits accruing to the remaining property. FURTHER AGREED that this agreement shall be construed as a covenant running with the land and shall be binding on the said Fax 7ittenberb and Rose Tittenberg and their heirs, quccossors in interest or assigns. The property referred to :n his agreement is located in the City of Palm Springs, County of Riverside, State of California. and is described as follows: Lot U, Block 24, Palm Springs subdivision as shown by map on file in Book 9; Page 432 of Slaps, Records of San Diego County, California.
