So Tbto AVOOAW NOW be aftool*d day #ttbor of lho p"oo upoa givift 30 00 "W44 W*14* Of iAtoation to tftool to 0e of at thoir RESOLUTION N0, 5404 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AUTHORIZING EXECUTION OF AGREEMENT WITH RIVERSIDE COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT WHEREAS, the Acting City Manager has recommended to this City Council that he be authorized to execute an agreement with the Riverside County Flood Control and Water Conservation District to engage said District 's services for flood hazard studies , pursuant to ordinance introduced in this meeting, said ordinance providing for the collection of fees to cover the cost of flood hazard studies in subdivisions (ordinance for passage in meeting of April 8, 1959 - to become effective May 8, 1959) , said agreement to become effective after effective date of said ordinance; and WHEREAS, this City, pursuant to said agreement, agrees to pay fees pre- scribed by County Ordinance No. 336, as amended, for said subdivision' flood hazard studies; and WHEREAS , the procedure recommended appears to be in order and in the best interests of the conduct of the City's business, NOW THEREFORE BE IT RESOLVED that, the Acting City Manager is hereby authorized and directed to execute agreement with Riverside County Flood Control and Water Conservation District for making flood hazard studies in subdivisions under fees prescribed by County Ordinance No. 336, as amended, all as hereinabove in WHEREAS clauses recited. -o- I hereby certify that the foregoing is a true copy of Resolution No. 5404, duly adopted by the City Council of the City of Palm Springs in a meeting thereof held on the 25th day of March, 1959. SHIRLEY HENRY City Clerk, Deputy Page 2 September 1, 1989 Re: Cancellation of Land Development Agreement As far as other District/City ongoing business is concerned, I expect no change in our, excellent working relationship. Where master drainage plan facilities are involved, the District will continue to accept them for operation and maintenance upon com- pletion to District standards. If such facilities are initiated through the land development process within the City, then we of course will require review of the improvement plans by the Dis- trict staff and provide inspection. If Area Drainage Plan (ADP) fees are to be paid by the land developers, I suggest that the City continue to collect these fees and transfer them to the Dis- trict for funding ADP facilities. If other, major non-master plan facil,i.ties are ,proposed by 1,ard developers in your City, and you desire the District to eventually operate and maintain these facilities, we should be requested to comment on those proposed facilities during the tentative map process stage. This long time cooperative effort has been mutually beneficial for both entities and certainly the public; however, land development reviews and responsibility for these reviews must now shift to the City. It should be noted that an increase in this fee to $100. 00 plus $1.00 per site is under consideration. In order to streamline and standardize the District' s processing of developments in all cities in a uniform manner and to permit closer coordination between our agencies on all subdivisions the attached "Standard Subdivision Processing Procedure" is attached for your information. Adoption of this fee and adherance to the procedures outlined will permit us to continue providing this technical assistance to you and provide long range and permanent protection to residents in the new developments.
