THIS AGR NT is made by and between TRUDY R IS, INC. , and
the CITY OF PXL�PRINGS, a municipal corporation, with reference to
the following;
A. That TRUDY RICHARDS$ INC. is the Lessee under that certain
lease dated October 8, 1959, and recorded in Book 2958 ,
Page 143 of Official Records of the County of Riverside
California.
B. That on the 9th day of December, 1959, the City Council of
the CITY OF PALM SPRINGS at a regular meeting of said Coun-
cil, approved the lot design of that certain Record of
Survey recorded in Book 30 , Pages 89 & 90 of Record of
Surveys in the office of the County Recorder of Riverside
County, California, which Record of Survey covers the entire
property described in the Lease referred to hereinabove.
THEREFORE, the parties hereto agree as follows;
1. So long as this agreement shall remain in force and when
acting in their official capacity to uphold the laws , render municipal
services or for the purpose of inspection, authorized employees and
personnel of the City of Palm Springs and the County of Riverside shall
have a continuing right and right of way in or upon Parcel& 24 and 53
of said Record of Survey.
2. The final Map of Chino- Palms Estates , a subdivision, recorded
in Book 34, Page 66 of Maps, records of Riverside County, California,
shows public utility easements over the Southerly 5 feet of Lots 10 and 11
and the Northerly 5 feet of Lots 12 to 169 inclusive, and the Easterly
5 feet of Lot 16 thereof; and the final Map of Chino Palms Estates Unit

No. •2, a subdivision, recorded in Book 36, Page 30 of Maps, records of
Riverside County, California, shows public utility easements over the
Easterly 5 feet of Lot 17 and the Southerly 5 feet of Lots 18 and 19
thereof. So long as this agreement shall remain in force, the CITY OF
PALM SPRINGS does hereby agree that it will not exercise any of such
public utility easements nor grant or attempt to grant any rights to
others therein far any purpose or purposes whatsoever. Nothing herein
contained is intended to change, modify or interrupt or disturb any right,
title or interest the CITY OF PALM SPRINGS may have in that certain ease-
ment for the installation of sewer lines, pumps and appurtenances granted
to CITY OF PALM SPRINGS by Deed recorded January
ar 5,1959, is Book 2390,
Page 155 of Official Reoords of Riverside County, California.
3. This agreement shall remain in force for the full life of the
lease referred to in Paragraph A above and the life of any subleases
executed thereunder or pursuant thereto.
IN WITNESS WHEREOF, the parties hereto have set their hands this

RESOLUTION NO. 5701
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AUTHORIZING EXECUTION OF AGREEMENT WITH
TRUDY RICHARDS, INC. COVERING BLANKET EASEMENT OVER
AND ACROSS PROPERTY PROPOSED AS COOPERATIVE APART-
MENT DEVELOPMENT
WHEREAS, this City Council has heretofore approved Record of Survey
by Jack Weiss (by Res. No. 5682, 12-9-59) for a cooperative apartment
development in a portion of Chino Palms Estates Nos. 1 and 2, in
Section 2, T4S, R4E, SBB&M. ; and
WHEREAS, said approval was granted upon condition that applicant
consent to agreement giving City blanket easement over and across
this property in order to perform and render municipal services;
and
WHEREAS, said agreement has now been tendered by Trudy Richards, Inc.
and the City Manager is recommending that Mayor and City Clerk be
authorized to execute said agreement on behalf of the City,
NOW THEREFORE BE IT RESOLVED that, as recommended, execution of
agreement between the City of Palm Springs and Trudy Richards, Inc. ,
giving the City a blanket easement over and across said property
in order for all authorized City officials and personnel to render
municipal services, is hereby authorized and approved.

I hereby certify that the foregoing is a true copy of Res. No. 5701,
duly adopted by the City Council of the City of Palm Springs in a
meeting thereof held on the 23rd day of December, 1959.
