HomeMy WebLinkAbout01366 - RIVERSIDE COUNTY COOPERATION AGR CDBG BLOCK GRANT 4TH YR 1 SUPPLEMENTAL AGREEMENT ' FOR THE USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS 2 3 COUNTY OF RIVERSIDE of the State of California, herein 4 called "County, " and the City of Palm Springs 5 herein called "City, " mutually agree as follows : 6 to GENERAL, County and City have executed a Cooperation 7 Agreement dated November 24 , 1981 , whereby City elected 8 to participate with County, which has qualified as an "Urban 9 County" for purposes of receiving Community Development Block 10 Grant (CDBG) funds , and to assist and undertake essential. 11 community development and housing assistance activities , pursuant 12 to the Hosing and Community Development Act of 1974 , as ' amended, _ e 13 hereinafter referred to as "Act. " Said Cooperation Agreement 14 dated November 24, , '1981 , is incorporated herein by 15 :reference and made a part of this Agreement as if each and every 16 provision was set forth herein. 17 2 . PURPOSE, City promises and agrees to undertake and 18 assist with the community development activities , within its 19 jurisdiction, by utilizing the sum of $ 235,570 20 CDBG Entitlement Funds, as specifically identified in Exhibit(s) 21 11A q° , `° r " , and "D" , respectively, which are attached hereto 22 an`dd consist (s) of 3 pages , and by this reference is incorporated 23 herein, for the construction of a public facility or the 24 acquisition of real property as designated as the following 25 project(s) : 26 Sewer Hook-Up Assistance Program;, Desert Highland Unity Center; ' JD/gk 27 Commercial Rehabilitation Program; Land Market Survey ;/27/84 28 GERA J GEERIINGS COUNT COUNSEL SUITE 3W 3535 IOTH STREET RIVERSIDE,CALIFORNIA /1/ i i 1 City shall obtain County ' s approval , through its Department of 2 Housing and Community Development, of the project (s) plans and 3 specifications prior to' City ' s construction of same . City promises 4 and agrees to utilize and maintain the project (s) constructed 5 for a minimum period of twenty (20) years or the life of ',the 6 project, whichever event is less , 7 3e TERM OF AGREEMENT. The term of this Agreement for 8 the construction or acquisition of the project (s) shall be for 9 a period of one (1) year commencing upon the date of the execution 10 of this Agreement and proceed consistent with the completion 11 schedule set forth in Exhibit s) "_A,�' , " C " , and " D , " if 12 substantial compliance with the completion schedule, due to ` v 13 unforseen or uncontrollable circumstances , cannot be met- ,by City, 14 the schedule for the project (s) may be extended. If substantial 15 progress toward completion, as determined by County, of a. 16 project (sj is not made during the term of the Supplemental Agree- 17 ment, the entitlement funds associated with the project (s) may 18 be reprogrammed by County after appropriate notice is given City. 19 4 . DISPOSITION OF FUNDS . County ' s Board of Supervisors 20 shall determine the final disposition and distribution of all 21 funds received by County under the Act consistent with -the pro- 22 visions of Paragraphs 2 and 3 of this Agreement. County through 23 its Department of Housing and Community Development , shall : 24 (1) make payments of the grant funds to City as designated in 25 Exhibit ( s) "AB" , it C " , and " D " and (2). monitor the construction e 26 of the facility or the acquisition of the real property to 27 insure compliance with applicable federal regulations and the 28 terms of this Agreement. JJ: 5 . COOPERATION WITH HOUSING ASSISTANCE ACTIVITIES . City 5 shall cooperate with County in undertaking essential community 6 development and housing assistance activities , specifically urban 7 renewal and public assistance housing, and shall assist County 8 in carrying out its housing assistance plans and other requirements 9 of the Community Development Block Grant Program. City shall 10 adhere to Housing Policy as set forth in Exhibit " E . " 11 6 . LEAD AGENCY FOR COMPLIANCE WITH THE CALIFORNIA 12 ENVIRONMENTAL QUALITY ACT, (CEQA) . Pursuant to Section 15065 (d) - r 13 of Title 14 of the California Administrative Code, City is ?4 designated as the lead agency for the project (s) that is the 15 subject matter of this Agreement. 16 7. HOLD HARMLESS AND INDEMNIFICATION. City shall comply 17 with all applicable laws, rules and regulations , and shall 18 indemnify, save and hold harmless County and its agency members 19 and their respective agents , servants and employees of and from 20 any and all liabilities , claims , debts, damages , demands , suits , 21 actions, and causes of action of whatsoever kind, nature or sort 12 including, but not by way of limitation, wrongful death, expenses 23 of the defense of said parties , and the payment of attorney ° s 24 fees, arising out of or in any manner connected with the perfor-- 25 mance by City under this Agreement. 26 8. RECORDS AND INSPECTIONS . 27 a. City shall establish and maintain records in 28 accordance with 24 C. City shall maintain a separate account for 2 CDEG Entitlement funds received as set forth in Exhibit (s ) 3 n A Io , cr C 17 , and rr D eo 4 C. City shall , during the normal business hours , 5 make available to County and 'to the Department of Housing and 6 Urban Development for examination and copying all of its records 7 and other materials with respect to matters covered by this 8 Agreement. 9 9 . FEDERAL REQUIREMENTS . City shall comply with the l0 provisions of the Act and any amendments thereto and the federal 11 regulations and guidelines now or hereafter enacted pursuant to I 12 the Act. ' More particularly, City is to comply with those regula- 13 tions found in Part 570 of Title 2.4 of the Code of Federal 14 Regulations. City is to comply with OMB Circulars A-87 and 15 A-102 , or any subsequent replacement. City is to abide by 16 the provision of the Community Development Block. Grant Manual , 17 prepared by County and cited in the above-mentioned Cooperation 18 Agreement dated November 24 a 1981. 19 10. INDEPENDENT CONTRACTOR. TERMINATION. "'4) 2 a. City. City may not terminate this Agreement 3 except upon express written consent of County. 4 b. County. Notwithstanding the provisions of 5 Paragraph 11a, County may suspend or terminate this Agreement 6 upon written notice to City of action being taken and the reason 7 for such action : 8 (1) In the event City fails to perform 9 the covenants herein contained at such times and 10 in such manner as provided in this Agreement ; and 1.1 (2) In the event there is a conflict with 12 any federal, state or local law, , ordinance, regulation 13 or rule rendering any of the provisions of this 14 Agreement invalid or untenable; or 15 (3) In the event the funding from the 16 Department of Housing and Urban Development referred 17 to in Paragraphs 1 and 2 above is terminated or 18 otherwise becomes unavailable. 19 c. Upon suspension of this Agreement, City agrees to 20 .return any unencumbered funds which it has been provided by County. 21 In accepting said. funds , County does not waive any claim or cause 22 of action it may have against City for breach of this Agreement. :23 d. Upon suspension of this Agreement, City agrees not 24 to incur any additional cost with regard to the project (s) that 25 are cited in the Written notice as necessitating the' , uspensions . 26 14 . NONDISCRIMINATION. ENTIRE AGREEMENT. It is expressly agreed that this 6 Agreement embodies the entire agreement of the parties in relation 7 to the subject matter hereof, and that no other Agreement or 8 understanding, verbal or otherwise , relative to this subject 9 matter, exists between the parties at the time of execution. 10 16 . MODIFICATION OF AGREEMENT. The Housing Assistance Plan serves as a.measure of the conditions of the housing stock and the needs of low and moderate income persons for housing assistance. The HAP also serves to establish goals for assistance best suited to meet the identified needs and to further the revitalization of the ommnity. The HAP mist also provide general locations for assisted housing which promotes a greater choice of housing opportunities and avoids undue concentrations of assisted persons in areas containing a high proportion of lower income persons, and which furthers fair housing and assures the availability of public facilities. CITY OF PALM SPRINGS 1 COOPERATION AGREEMENT FOR COMMUNITY DEVELOPMENT BASIC GRANT FUNDS 2 IMPLEMENTING THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1980 3 4 COUNTY OF RIVERSIDE, of he State of California, herein called "County" , and the CITY OF Q , a City within 5 said County, herein called "City" , mutua ly dgree as follows : 6 1. GENERAL. 7 The Housing and Community Development Act of 1974 , as amended by the Housing and Community Development Act of 1980 , pro- 8 vides that basic grant funds may be used for essential community development and housing assistance activities . 9 County is qualified as an "Urban County" under the Act. 10 City, by execution of this Agreement, hereby gives notice of its election to participate in an Urban County program with County. 11 Therefore, County and City hereby agree to cooperate in undertaking or assisting in undertaking, essential community development and 12 housing assistance activities, specifically urban renewal and pub- licly assisted housing. 13 2. TERM. 14 The term of this Agreement shall be for not less than a 15 period of three (3)- years commencing on the date specified below and extending through the fiscal years 1982 , 1983, and 1984 . 16 3. PREPARATION OF APPLICATION. 17 County, by and through its Administrative Office, subject 18 to approval of County's Board of Supervisors, shall be responsible for preparing and submitting to HUD all necessary applications for 19 a basic grant under the Acts. This duty shall include the updating of a community development plan, programs, and a housing assistance 20 plan which satisfy the application requirements of the Acts and 21 their Regulations. 4 . COMPLIANCE WITH FINAL PROGRAMS AND PLANS. 22 Both County and City shall comply in all respects with 23 the community development plans, programs, and the housing assist- ance plan which are developed pursuant to the application require- 24 ments of the Acts and their Regulations and approved by HUD. 25 5. COMPLIANCE WITH THE ACTS , REGULATIONS, AND OTHER LAWS 26 Both County and City will comply with all applicable requirements of the Acts and theirs Regulations in utilizing basic 27 grant funds under the Acts. County and City will comply with the provisions of the National Environmental Policy Act of 1969 , Title 28 VI of the Civil Rights Act of 1964 , Title VIII of the Civil Rights JAMES H.ANGELL Act of 1968 , Executive Order 11988 , Section 109 of the Housing and COONTYCOUNSEL LAW LIBRARY SLOG. DISPOSITION OF FUNDS. 3 County' s Board of Supervisors shall determine the final disposition and distribution of all funds receive! by County under 4 the Act and the activities for which such funds shall be used, subject to the provisions of Sections 4, 5 & 7 of this Agreement. 5 7 . SUPPLEMENTAL AGREEMENTS. 6 County and City shall enter into one (1) year term 7 supplemental Agreements for specific project. The supplemental Agreements include an exhibit designating a schedule of progress in 8 increments for the proposed project to be carried out by City, listing estimated dates of completion for each increment. If 9 substantial compliance has been made by the City in complying with schedule, or there were unforseen or uncontrolled circumstances , 10 the project may be renewed for an additional year by the County. If substantial progress has not been made by 'the City in compliance 11 with the schedule, said project funds may be reprogramed by the County without further notice to City after the one year term from 12 date of the execution of this amendment. 13 Nonrenewal by County of City ' s Supplemental Agreement and reprograming of funds therefrom, will not excuse City' s performance 14 under this three (3) year basic grant agreement nor cause City to be -ineligible for future CDBG projects in any future fiscal year, 151 either remaining under this 'Basic Grant Agreement, Amendments or extensions thereof. 16 8 . COMMUNITY DEVELOPMENT BLOCK GRANT MANUAL. 17 City warrants that its staff members , responsible for 18 implementing CDBG program, has received, renewed, and shall follow, the Community Development Policy Manual prepared by County , which 19 is incorporated herein and made a part hereof. 20 9 . REAL PROPERTY REQUIREMENTS WHERE APPLICABLE. 21 Where Community Development Block Grant Funds are used by City to acquire real property, City shall comply with the minimum 22 federal requirements for a minimum period of twenty (20) years , as follows : 23 24 (a) Title to real property shall vest in the City subject to the condition that the City shall use the real property for the authorized prupose of the original grant 25 as long as needed. 26 (b) The City shall obtain approval by the County for the use of the real property in other CDBG projects when 27 the City determines that the property is no longer needed 28 for the original grant purposes . RIVERSIDE,CALIFORNIA -2- 1 (c) When the real property is no longer needed as provided in (a) and (b) above, the City shall dispose of 2 the real property as follows : 3 1) The City may retain title after it compensates the County' s CDBG funds or the Federal Government in 4 an amount computed by applying the CDBG percentage of participation in the cost of the original project to 5 fair market value of the property. 6 2) The City may be directed to sell the property under Federal guidelines provided by the County and 7 repay to the CDBG funds or the Federal Government, an amount computed by applying the Federal percentage 8 of the participation in the cost of the original pro- ject to the proceeds from sale (after deducting actual 9 and reasonable selling and fix-up expenses, if any, 10 from the sales proceeds) . 3) Conditions, Covenants and Restrictions (CCR) 11 conveyance for CDBG funds acquired real property designating the above restrictions. 12 10 . SECTION 213 REVIEW. 13 City shall , prior to implementing any project for assist 14 ed housing, within its territorial jurisdiction, regardless of funding for same, will obtain County' s review and comment to be mad 151in accordance with -the review responsibility of County found under Section 213 of the Housing and Community Development Act of 1974 16 (42 U.S.C. 5301) . 17 11. TERMINATION AND EXTENSION. 18 This Agreement may not be terminated or withdrawn by either County or City unless and if County fails to continue to 19 qualify as an Urban County or does not receive a grant in any year of the three (3) year period. This Agreement may be extended for 20 successive three (3) year periods by the mutual consent of the 21 parties. 12. COUNTY COUNSEL' S CERTIFICATION. 22 County Counsel certifies that the terms and provisions 23 of the Agreement are fully authorized under State and local law and that the Agreement provides full legal authority for the County to 24 undertake or assist in undertaking essential community development and housing assistance activities, specifically urban renewal and 25 publicly assisted housing.. 26 13 . LIABILITY.
