01469 - VANTON SYDNEY EL CIELO FAIRCHILD CONSTRUCTION REFUND
i 0 RELEASE OF CITY OF PALM SPRINGS FROM IMPROVEMENT CONSTRUCTION REFUND AGREEMENT NO. 1469 WHEREAS on December 20, 1978, by Resolution No. 12858, the City of Palm Springs (City) and Sydney Vanton (Vanton) entered into an Improvement Construction Refund Agreement, referred to as construc- tion Agreement No. 1469; and WHEREAS said Agreement provided that on property developed along that portion of El Cielo Road improved by Vanton as required by the City, the City would collect and remit to Vanton the $61, 000 ex- pended by Vanton for such improvements; and WHEREAS pursuant to a Stipulation for Entry of Judgment, Case # I 28675, dated May 29, 1984, Construction Agreement No. 1469 was declared to be a valid, lawful and enforceable lien against the property of Fairchild, or his successors and assigns; and WHEREAS the settlement amount in said Judgment was reduced from $61, 000, previously written in Agreement No. 1469, to $42 , 000 plus interest, at the rate of Szo from and after April 6, 1984 , until paid; and WHEREAS currently the Fairchild property lease, which covers a portion of Indian Allotment PS 10, is in the process of being sold in bankruptcy; and WHEREAS Vanton, the beneficiary under the aforementioned Construc- tion Refund Agreement No. 1469 has agreed to accept $42 , 000, with- out interest, as full settlement of his claim under said agreement; and WHEREAS Vanton desires to receive payment directly from the Escrow Company handling the Fairchild Estate Bankruptcy in settlement of this issue. NOW, THEREFORE, I Sydney Vanton, a party to and a beneficiary of the Construction Agreement No. 1469 entered into with the City of Palm Springs, do hereby release the City of Palm Springs from any and all its obligations whatsoever under said Agreement. Hereafter the City shall have no obligation to collect any funds pursuant to said Agreement or to make any payment to Vanton. E-:=t'Y'ow I ld pt"7ayrf22T1'- MEMORANDUM s' " DATE : May 29, 1984 TO : City Clerk FROM City Attorney SUBJECT : IMPROVEMENT CONSTRUCTION AGREEMENT N0: 1469-- FAIRCHILD GOLF CENTER Attached is a copy of a stipulated judgment finally settling the disputes over the refund agreement by which the City agreed with Sidney Vanton to collect and pay over to Vanton, from the owner of the Clarkston (now Fairchild) Golf Center, the cost of improve- ment of E1 Cielo fronting the golf center property. 1. The stipulated judgment should be attached to and be treated as part of the refund agreement #1469 . 2 . If building permits for improvement of the subject property (southeast corner of the Fairchild Golf Center) are applied for on or before August 6, 1984, (assuming all other requisites have been met) the refund agreement may be disposed of by payment of $37, 000, which should be in a check payable jointly to the City of Palm Springs and Sidney Vanton. 3. If building permits are applied for after August 6, 1984 , contact me. I will contact Vanton ' s attorney to determine the exact amount acceptable for a full release from the effects of the agreement. 4. If any application is made for conditional use permit or other entitlement of use, preliminary to obtaining building permits, approval of such should be conditioned upon acceptable disposition of the construction refund agreement.
