HomeMy WebLinkAbout12/17/2003 - STAFF REPORTS (6) �h DATE: December 17, 2003 TO: City Council FROM: Chief of Police The CITY COUNCIL APPROVE AN AGREEMENT WITH THE CALIFORNIA DEPARTMNT OF JUSTICE FOR THE TESTING OF SUSPECTED ILLEGAL DRUGS. RECOMMENDATION It is recommended that the City Council approve an agreement with the California Department of Justice for the testing of suspected illegal drugs. SUMMARY The California Department of Justice lab currently conducts testing of suspected illegal drugs for the police department. The results of these tests are submitted to the district attorney's office and the courts for prosecution. BACKGROUND The police department does not have the equipment or personnel to conduct court required tests on suspected illegal drugs that are seized by department personnel. The California Department of Justice lab has the necessary equipment and personnel to conduct these tests. Their lab personnel also testify in court. The Department of Justice provides these services for the majority of the law enforcement agencies in the state. The Department of Justice charges the police department a fee for these services. A copy of the new fee scheduDe is attached to this staff report. FISCAL IMPACT There will be a small increase in the cost of illegal drug testing. These increases with be paid from the existing department's budget. In fiscal year 2002-2003 the city paid the Department of Justice $3,045.00 for illegal drug testing. Travel and testimony regarding the results of the analysis shall be provided at no cost. All court appearances shall require confirmation. The services will include a postage paid,Business Reply Mail specimen collection kit (urine or blood) addressed to the Toxicology Laboratory, which will be made available to the Agency upon request. Please call the laboratory at (916) 227-3620 or fax (916)227-4751 to request the kits.
