SALE OF SURPLUS OSHKOSH P-19 ARFF FIRE APPARATUS TO THE DEPARTMENT
OF THE ARMY, UNITED STATES ARMY FORCES CENTRAL COMMAND-KUWAIT
(ARCENT-KU) IN THE AMOUNT OF $85,000.00.
RECOMMENDATION:
It is recommended that the City Council approve the sale of one (1) surplus
Oshkosh® P-19 Aircraft Rescue Fire Fighting (ARFF) fire apparatus to Combat
Support Association (CSA), a duly recognized agent of the Department of the Army,
United States Army Forces Central Command-Kuwait(ARCENT-KU)in"as is,where
is condition" for the amount of $85,000.
SUMMARY:
This action would approve the sale of one (1) surplus ARFF apparatus to the United
States military in support of their on going operations in Kuwait,
BACKGROUND:
As a result of the recent acquisition of the new ARFF apparatus for the Airport, the
old ARFF apparatus are no longer required. As a cooperative effort between the
Department of Aviation, the Fire Department and the Department of Procurement &
Contracting, Invitation For Bid (IFB) 04-04 was issued on December 22, 2003 to sell
three (3)surplus Aircraft Rescue fire engines through a competitive bid process. The
IFB stated that the bids would be opened on January 30, 2004 and it was intended
that the bids would be awarded by the City Council at the next scheduled City Council
meeting.
Prior to the IFB distribution, a person purporting to be associated with a United States
military operation in Kuwait and wanting to obtain the ARFF P-19 fire apparatus had
contacted the Fire Department. They were advised of the City's IFB process, told to
properly document their urgency, and substantiate their status.
On the date that the IFB was issued (December 22, 2003),the Fire Chief received an
email with an attached letter from a Sergeant Major Bryan Green (unsigned, undated,
and not on recognizable U. S. Government letterhead). On December 28, 2003 a
second letter was received via email, which was signed by Lieutenant Colonel Gary
L. Heer, dated December 24, 2003 on Department of the Army letterhead (ARCENT-
KU). In the content of the letter from Lieutenant Colonel Heer,he stated he was acting
on behalf of the United States Army Central Command Kuwait and specifically,Camp
Arifjan. He stated that a contractor (Combat Support Association - CSA) has been
asked to procure the necessary fire fighting vehicles for the United States Army,
Therefore, in the interest of National Security, he requested the United States Army
Central Command Kuwait be given the opportunity to by-pass the bid process, and
directly procure the P-19 ARFF fire engine through their authorized representative,
Combat Support Association (CSA). V.

Camp Arifjan is a new$200 million state-of-the-art facility built courtesy of the Kuwait
government. The new Army base has literally risen out of the sand and will provide
permanent support facilities for American troop in Kuwait, replacing temporary
facilities that have been used since the Gulf War. The Army component of U.S.
Central Command(USCENTCOM), U.S.Army Forces Central Command(ARCENT),
maintains a forward presence in the region. In a news article dated December 15"
2003, it was stated that:
Logistics experts at this camp are preparing for one of the greatest feats of
transportation in military history. The camp will be home to the Iraq troop rotation.
Soldiers will come out of Iraq, clean their equipment and board planes and ships
for home. Other service members will be arriving from the United States, drawing
equipment and preparing to move into Iraq. Nothing like this effort has been done
before.
The camp is located outside Kuwait City and it is already the logistical hub for
Operation Iraqi Freedom. "A total of 800 trucks a day go north into Iraq,"said Maj.
Gen. Steve Speakes, the deputy commander of the Combined Land Component
Command and the man in charge of effort. There are 28,000 American troops in
Kuwait, with 10,000 in Arifjan. The soldiers are almost equally divided among
active duty,Army Reserve and National Guard.Their sole purpose is to ensure the
combat troops in Iraq get what they need, when they need it. But they will be
tested further by what Speakes calls "the surge." That is when the 130,000
American service members now in Iraq start moving back to their home stations
and 110,000 soldiers and Marines replace them. The surge will start in January
and will last through the end of April. Speakes and his soldiers will be the area's
largest innkeeper during that time, housing about 65,000 more Americans than
they do now. But it is not just people that will make up the surge. Those coming
out of Iraq will bring 30,000 pieces of equipment with them. That equipment has
to be scrupulously cleaned before coming back to the United States or Germany.
U.S. Department of Agriculture inspectors do not want germs, fungus, insects or
diseases riding home with the equipment.Atthe same time, arriving units will bring
new equipment with them, and the equipment must be married up with the proper
units, primed and readied for combat. The soldiers and Marines must test the
weapons to ensure they work.
Speakes said the command is readying beds, tents, wash racks, fueling areas,
chow halls and training areas-all the things needed to get service members ready
for combat or ready for home. Planning began months ago. "We plan for the
worst-case scenario," Speakes said. "We don't want to be surprised." All of this
is being done in a high-threat environment. Speakes said the Americans have
worked closely with their Kuwaiti hosts to ensure force protection. "They have
been immensely cooperative, and we have put in place many force protection
measures," he said.
Speakes said the surge will be more complicated, in many ways, than D-Day at
Normandy. "It's going both ways—coming and going," he said. "But these young
soldiers are up to the task. The mission is to get people into Iraq so there is no
degradation of security,while atthe same time ensuring no one stays in the region
one day longer than they have to."

The ARFF units were originally purchased with 90% matching grant funds from the
Federal Aviation Administration (FAA), which would normally mandate that these
funds be applied toward the purchase of replacement units. However,the Department
of Aviation has received authorization from the FAA to utilize the revenue from the
sale of all units for the Airport's portion of acquiring a shared City mobile command
post. The revenue from the sale of the P-19 ARFF fire apparatus will be combined
with a gift from the Agua Caliente Band of Cahuilla Indians, Homeland Security
Grants allocations for the City and County, and the Motor Vehicle Replacement to
acquire a mobile command post.
The Director of Procurement&Contacting believes the proposal offered by the United
States military will result in a higher return to the City compared with what would be
realized by the competitive bid process for the single apparatus. Accepting this
proposal supports the Uniteii States military effort.
A Resolution is attached for City Council consideration.

Dear Chief Bary Freet:
This letter is to inform you that Combat Support Association is acting on behalf of the
United States Army Central Command Kuwait and specifically Camp Ariflan. Combat
Support Association is contracted to stand up a fully operational fire department at Camp
Arifjan. As part of this contract Combat Support Association has been asked to procure
the necessary fire fighting vehicles for the United States Army. This department protects
over 10,000 soldiers assigned to the installation and augments the limited military fire
fighting assets available in theater.
Therefore, in the interest of National Security, I respectfully request the United States
Army Central Command Kuwait be given the opportunity to by-pass the bid process,
directly procuring a vehicle through our authorized representative Combat Support
Association. This vehicle will provide immediate needed aircraft fire protection for the
soldiers of Camp Arif an.Your assistance in this matter is greatly appreciated.

Dear Fire Chief Freet&The Palm Springs City Council,
In response to your letter dated 31 December 2003 we are acknowledging receipt of your correspondence.
Our sincere apologies for the date omission on our original Offer Letter.
We are extremely appreciative of your initiative regarding this situation and would like to extend
our appreciation to you, your staff and anyone involved since the 22 December 2003 correspondence which
you have pointed out in this latest correspondence. We are entering a phase where security issues are
paramount in our efforts to maintain stability while protecting our Servicemen and Women. Therefore, our
initial offer of $80,000.00 that is not acceptable by the Palm Springs Fire Department which, due to your
request to resubmit our best and final offer, we have discussed this subject with the following
determinations.
We understand that your P-19 unit is being offered "as is where is"which in itself will pose a risk
to the US Government, US Military Personnel and its support groups. This risk is not taken lightly but it is
understood that this is a choice. In addition, as stated in the original offer, the original new cost for the P-19
($160,000.00 to $180,000.00)does not warrant a clear justification of over extending the purchase price.
Our justification is based on many factors and the cost to purchase a "as is where is"vehicle would be going
against the grain of the Policies and Procedures of the FAR which we are mandated to follow. We are pleased
to resubmit an offer of $86,000.00 for your P=19 Oshkosh Crash Rescue Vehicle Vin #OT9L5B7TH1029680.
This offer is considered extremely fair and reasonable based on the parameters we have to work with and
without question.
CSA would like to thank the Palm Springs Fire Department and The Honorable City Council of Palm Springs
for taking steps over and above it's normal bidding process to consider this proposal. We express a great
degree of anticipation for the above statements and hope favorably to hear from you soon.

CALIFORNIA, ACCEPTING THE PROPOSAL FROM COMBAT
SUPPORT ASSOCIATION (CSA), A DULY RECOGNIZED AGENT OF
THE UNITED STATES ARMY, FOR THE SALE OF ONE (1) SURPLUS
P-19 AIRCRAFT RESCUE AND FIRE FIGHTING (ARFF)APPARATUS
IN THE AMOUNT OF $85,000, BASED ON URGENT NEEDS OF THE
UNITED STATES MILITARY AND DEDICATING THE FUNDS TO THE
CITY'S SHARED MOBILE COMMAND POST.
WHEREAS, the events of September 11`h have placed extraordinary requirements on the
Unites States military and the City of Palm Springs; and,
WHEREAS, the City having recently replaced the three (3) ARFF apparatus assigned to
the Palm Springs International Airport,through an Airport Improvement Program(AIP)grant
from the Federal Aviation Administration (FAA); and,
WHEREAS, under normal circumstances, the FAA would require that funds from surplus
apparatus purchased via AIP funds must go toward the replacement of new apparatus,the
FAA has agreed that funds from the surplus sale can go toward the Department of Aviation
share of a City shared Mobile Command Post; and,
WHEREAS, after careful review of the proposal from Combat Support Association (CSA)
on behalf of the United States Army, it has been deemed to be responsive and responsible.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as
follows:
1. The events of September 11`h have placed extraordinary demands on the United
States military, as well as the City of Palm Springs.
2. The Director of Procurement & Contacting believes the proposal offered by the
United States military will result in a higher return to the City compared with what
would be realized by the competitive bid process for the single apparatus.Accepting
this proposal supports the Unites States military effort.
3. That the sale of one (1) surplus Oshkosh P-19 Aircraft Rescue and Fire Fighting
(ARFF) apparatus is awarded to Combat Support Association (CSA), who is an
authorized agent acting on behalf of the Unites States Army in the amount of
$85,000.
4. The Department of Aviation has received authorization from the Federal Aviation
Administration (FAA) to utilize the revenue from the sale of this ARFF apparatus
towards the Airport's portion of acquiring a shared City mobile command post.

5. The funds from the sale of this single apparatus are hereby dedicated to the
Department of Aviation's portion of the pending City mobile command post.
