RESIDENTIAL SOUND INSULATION PROGRAM (RSIP) - PHASE IV
RECOMMENDATION:
It is recommended that the City Council award bid for the Residential Sound Insulation
Program (RSIP), Phase IV (AIP 3-06-0181-29, City Project 2003-10) to Great West
Contractors, Inc in the amount of $1,554,000 and upholding the bid protest filed by
Great West Contractors, Inc, subject to FAA approval.
SUMMARY:
Phase IV of the Airport's Residential Sound Insulation Program (RSIP) is the final
phase of this project. As with the previous phases, a pre-qualification process for a
general construction contractor was utilized. A protest was filed by the second low
bidder. The City Attorney and staff recommend upholding the protest.
BACKGROUND:
The purpose of the Residential Sound Insulation Program (RSIP)is to mitigate aircraft
noise impacts to residential homes that lie within the 65 CNEL (Community Noise
Equivalency Level) noise insulation boundary. The program is now entering its fourth
and final phase, which currently includes 68 homes. All of the homes are within the
City of Palm Springs.
This fourth and final phase of RSIP followed the methodology of the previous phases
and a two step bidding process for a general construction contractor is being
conducted. Those contractors who met the requirements outlined in the first step will
be eligible to participate in Step II - Invitation for Bid to provide construction services.
Only those Offerors submitting Step I proposals and found qualified by the City are
eligible to submit bids in Step II. Step II bids will be evaluated on a standard
competitive sealed bid basis. All Step II submittals will be reviewed and analyzed by
City staff and project consultants for compliance with the Invitation for Proposal/Bid
Specifications and acceptable engineering standards. Final award of the contract (if
any) will be made by the Palm Springs City Council based on the lowest responsive
and responsible bid.
The only Offerors submitting Step I proposals and found qualified by the City are Great
West Contractors, Inc., Jim Webber &Associates, Inc. and T&M Construction, Inc..
The Disadvantaged Business Enterprise (DBE) goal for this project is 5.9%.
At its regularly scheduled meeting of December 3, 2003, the City Council rejected all
bids that were received on November 25, 2003 and authorized re-bidding to the three
pre-qualified contractors.

A protest of the apparent low bid award to Jim Webber&Associates, Inc was filed by
Great West Contractors, Inc (see attachment A). Upon conferring with the City
Attorney, staff feels the bid protest should be upheld and this project awarded to Great
West Contractors, Inc..
There are currently 68 homes registered for this fourth and final phase. There are still
approximately20 homes remaining within the program boundaries and staff is working
diligently to include these homes. A map showing the boundaries of the program, as
established by the Airport Commission and City Council, is shown on Attachment A
The FAA is extremely anxious to have this project completed and in order not to lose
the available federal funds, an extremely short time line for construction has been
agreed to with the FAA.
Funds for the project are available via Airport Improvement Program (AIP) Grant 29
from the Federal Aviation Administration (FAA), account no 415-6600-56047.

Dear Mr,Good,
1 have reviewed the bid documents of Jim Webber and Associates for the R.S.U. Phase 1V
project. Their subcontractor list appears to be lacking some of the subcontractors necessary to
provide an efficient project. They listed only an FIVAC and insulation subcont actor. They
failed to list a window and sliding glass door installer, door installer, electrician, painter and
abatement subcontractor. Although Jim Webber & Associates can self-perform some of the
scopes of work, it appears certain the project will suffer from a lack of expert tradesmen
specializing in their appropriate trade.
The abatement scope of work cannot be self-performed and requires certification from the
C¢lifomia State License Board and certification by the Division of Occupational Safely and
Health, When performing abatement there are many rules and regulations which must he
followed and each worker is required to complete a training course in order to qualify for
certification from t'ho Environmental Protection Agency..

"Failure to Specify Subcontractor
4106_ If a prime contractor Pails to specify a subcontractor or if a prime contractor specifies more

qualified to perform that portion himself,and that be shall perform that portion himself"
The abatement scope of work is approximately 3%of the total bid which requires this portion of
work to be listed on Jim Webber&Associates subcontractor list(see attached bid from CC Serv),.
They are not licensed or qualified to perform this portion of work themselves.

RESIDENTIAL SOUND INSULATION PROGRAM (RSIP) - PHASE IV
PALM SPRINGS INTERNATIONAL AIRPORT
NOTICE IS HEREBY GIVEN that the City of Palm Springs has determined that all general contractors
bidding for the above named project must be pre-qualified prior to submitting a bid on that project.
PROJECT BACKGROUND:
The RSIP program is funded by an Airport Improvement Program (AIP) grant from the Federal
Aviation Administration (FAA). The intent of the program is to provide additional sound insulation
for homes that are within the approved noise contour boundary as defined by the FAA and the City
of Palm Springs. The airport has sound insulated 200 + homes within the contour under previous
phases of RSIP. Historically, these improvements included the installation of accoustically rated
windows and doors, additional attic insulation, heating and cooling upgrades, ceiling treatments,
chimney top dampers, kitchen and bath vent baffles and gable vent baffles. The treatments vary
according to the individual house. Historically, the range of costs per house were approximately
$15,000 to $25,000.
Phase IV of RSIP will include approximately 70 homes. The anticipated construction contract time
is 180 calendar days from the date stated in the Notice to Proceed. The Notice to Proceed is
anticipated to be issued to the successful general construction contractor by the Palm Springs City
Council in early January 2004.
1. It is mandatory that all Contractors who intend to submit a bid on the City Project 2003-10,
"Residential Sound Insulation Program (RSIP) Phase IV" fully complete a pre-qualification
questionnaire, provide all materials requested, and be approved by the City of Palm Springs to be on
the final qualified Bidders list. No bid will be accepted from a Contractor that has failed to comply with
these requirements for the above named project. If two or more business entities submit a bid as part
of a Joint Venture, or expect to submit a bid as part of a Joint Venture, each entity within the Joint
Venture must be separately qualified to bid. The last date to submit a fully completed questionnaire
is October 9, 2003. Contractors are encouraged to submit this pre-qualification packages as soon
as possible, so they may be notified of omissions of information to be remedied or of their pre-
qualification status in advance of the bid advertisement for this project.
Answers to the questions in the questionnaire, information about current bonding capacity, notarized
statement from surety, and the most recent reviewed or audited financial statements, with
accompanying notes and supplemental information are required. The City of Palm Springs will use
these documents as the basis of rating Contractors. The City of Palm Springs reserves the right to
check other sources available. The City of Palm Springs' decision will be based on objective
evaluation criteria.
The City of Palm Springs reserves the right to adjust, increase, limit, suspend or rescind the pre-
qualification rating based on subsequently learned information. Contractors whose rating changes
sufficient to disqualify them will be notified, and given an opportunity of a hearing consistent with the
hearing procedures described below for appealing a pre-qualification ratting.
2. The pre-qualification package (an original and five copies) should be submitted under seal and
marked "CONFIDENTIAL" to Harold E. Good, CPPO, Director of Procurement & Contracting, 3200
E. Tahquitz Canyon Way, Palm Springs, CA. 92262.
3. The pre-qualification packages (questionnaire answers and financial statements) submitted by
Contractors are not public records and are not open to public inspection. All information provided will
be kept confidential to the extent permitted by law. However, the contents may be disclosed to third
parties for purpose of verification, or investigation of substantial allegations, or in the appeal hearing.
State law requires that the names of contractors applying for pre-qualification status shall be public
records subject to disclosure, and the first page of the questionnaire will be used for that purpose.
4. Each questionnaire must be signed under penalty of perjury in the manner designated at the end of
the form, by an individual who has the legal authority to bind the Contractor on whose behalf that
person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor
must immediately notify the City of Palm Springs and provide updated accurate information in writing,
under penalty of perjury.
5. The City of Palm Springs reserves the right to waive minor irregularities and omissions in the
information contained in the pre-qualification application submitted, to make all final determinations.
6. Contractors may submit pre-qualification packages during regular working hours on any day that the
offices of the City of Palm Springs are open. Contractors who submit a complete pre-qualification
package will be notified of their qualification status no later than five business days after submission
of the information.
7. The City of Palm Springs may refuse to grant pre-qualification where the requested information and
materials are not provided, or not provided by October 9, 2003. There is no appeal from a refusal for
an incomplete or late application, but re-application for a later project is permitted. The closing time
for bids will not be changed in order to accommodate supplementation of incomplete submissions,
or late submissions.
8. Where a timely and completed application results in a rating below that necessary to pre-qualify, an
appeal can be made. An appeal is begun by the Contractor delivering notice to the City of Palm
Springs of its appeal of the decision with respect to its pre-qualification rating, no later than ten
business days prior to the closing time for the receipt of bids for this public works project. Without a
timely appeal, the Contractor waives any and all rights to challenge the decision of the City of Palm
Springs,whether by administrative process,judicial process or anyother legal process or proceeding.
9. If the Contractor give the required notice of appeal and requests a hearing, the hearing shall be
conducted so that it is concluded no later than five business days after the City of Palm Springs
receipt of the notice of appeal, and no later than five business days prior to the last due for the receipt
of bids on the project. The hearing shall be an informal process conducted by a panel to whom the
City Council has delegated responsibility to hear such appeals. At or prior to the hearing, the
Contractor will be advised of the basis for the City of Palm Springs' pre-qualification determination.
The Contractor will be given the opportunity to present information and present reasons in opposition
to the rating. Within one day after the conclusion of the hearing, the City Council will render its
decision. It is the intention of the City of Palm Springs that the date for the submission and opening
of bids will not be delayed or postponed to allow for completion of an appeal process.
Note: A contractor may be found not pre-qualified for bidding on a specific pubic works
contract to be let by the City of Palm Springs, until the Contractor meets the City's
requirements. In addition, a contractor may be found no pre-qualified for either:
(1) Omission of requested information or
(2) Falsification of information

N-1 NOTICE IS HEREBY GIVEN that sealed bids for the Residential Sound Insulation Program
(RSIP), Phase IV will be received from General Contractors who have successfully completed
the pre-qualification process set forth by the City and advertised in the Desert Sun on
September 18, 2003 and September 25, 2003. Said SEALED BIDS will be accepted at the
office of the Director of Procurement & Contracting, 3200 E. Tahquitz Canyon Way, Palm
Springs, California. The work to be performed is described in N-2 below. The City has chosen
to develop a contract to perform the work via a pre-qualification process. No bid will be
accepted from a General Contractor who has not been pre-qualified by the City for this specific
project.
N-2 PRE-QUALIFICATION OF GENERAL CONTRACTORS: The pre-qualification process closes
on October 9, 2003, at 5:00 p.m. PST. For the benefit of sub-contractors and suppliers, a list of
pre-qualified General Contractors will be available from the undersigned on October 15, 2003.
N-3 DATE AND TIME OF OPENING BIDS: Sealed bids will be received at the office of the Director
of Procurement & Contracting of the City of Palm Springs, California until 2:00 PM, local time
on November 25, 2003. At that time, they will be opened and read aloud. Bids shall be
submitted in a sealed envelope marked on the outside "RSIP Phase IV" the name of the bidder,
the project title and the project name.
N-4 DESCRIPTION OF THE WORK: The purpose of the Residential Sound Insulation Program is
to mitigate aircraft noise. The work, which is divided into phases, consists of insulating single-
family residential homes within the proximity of the Palm Springs International Airport. The work
to be done consists of, but is not limited to, sound insulating approximately 70 single family
residential homes. The work shall include generally the replacement of windows, exterior doors,
providing attic insulation, gable vent baffles, chimney dampers and miscellaneous HVAC
acoustic modifications.

Springs. Specifically, the work is located in an area generally bounded by Racquet Club Road,
Sunrise Way, Vista Chino, Viminal Road and San Juan Road.
N-6 BID SECURITY: Each bid shall be accompanied by a certified or cashier's check or Bid Bond in
the amount of 10 percent of the total bid price, payable to the City of Palm Springs as a
guarantee that the Bidder, if its Bid is accepted, will promptly obtain the required bonds and
insurance and will prepare the required submittal documents and execute the Agreement. Bid
bonds will be required of all qualified Offerors submitting Bids.
N-7 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of ninety
(90) calendar days from the date of bid opening.
N-8 CONTRACTOR'S LICENSE CLASSIFICATION: In accordance with the provisions of California
Public Contract Code Section 3300, the City has determined that the Contractor shall possess a
valued Class B-1 Contractor's License at the time that the Contract is awarded. Failure to
possess the specific license shall render the bid as non-responsive and shall act as a bar to
award of the Contract to any bidder not possessing said license at the time of award.
The successful General Contractor must be licensed to do business in the City of Palm Springs
in accordance with the provisions of Chapter 9, Division 3, of the Business and Professions
Code, and will be required to obtain a City Construction Permit (No Fee) from the Public Works
Inspection Supervisor, City, Hall, Palm Springs.
N-9 WAGE REQUIREMENTS:
(a) State - In accordance with the provisions of California Labor Code Section 1770,
1773, 1773.1, 1773.6 and '1773.7, as amended, the Director of the Department of
Industrial Relations has determined the general prevailing rate of per diem wages in
accordance with the standard set forth in Section 1773 for the locality in which the work
is to be performed. A copy of said wage rates is on file at the Department of Building
and Safety, City Hall, Palm Springs, California. It shall be mandatory upon the
Contractor to pay not less than said specified rates to all workers employed by them in
the execution of the Work, and shall post a copy of said wage rates at the project site.
(b) Federal - The general prevailing rate of wages, as determined by the Secretary
of Labor, are included hereinafter as part of the Contract Documents; provided, that if
there is any difference between the State or Federal wage rate for any given craft of
mechanic needed to execute the work, it shall be mandatory upon the Contractor and
any sub-contractors to pay the higher of the two rates.
All labor on the project shall be paid no less than the minimum wage rates established by the
U.S. Secretary of Labor.
N-10 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100 percent of
payments due under the Contract Documents from time to time, without retention of any portion
of the payment by the City, by depositing securities of equivalent value with the City in
accordance with the provisions of Section 22300 of the Public Contract Code.
N-11 TRADE RESTRICTIONS - All solicitations, contracts and documents resulting from project
funded under the AIP must contain the foreign trade restriction required by 49 CFR Part 30,
Denial of Public Works Contracts to Suppliers of Goods and Services of Countries that Deny
Procurement Market Access to U.S. Contractors.
The Aviation Safety and Capacity Expansion Act of 1990 provides that preference be given to
steel and manufactured products produced in the United States when funds are expended
pursuant to a grant issued under the Airport Improvement Program.
N-12 EQUAL EMPLOYMENT OPPORTUNITY AND AFFIRMATIVE ACTION REQUIREMENTS.
Each bidder must complete, sign and furnish, prior to award of the contract, the "Bidder's
Statement on Previous Contracts Subject to EEO Clause", a "Certification of Non-segregated
Facilities", and the "Assurance of Disadvantaged Business Enterprise Participation" as
contained in the Bid Proposal. These items must be submitted with his/her bid.
A contractor having 50 or more employees and his/her sub-contractors having 50 or more
employees and who may be awarded a contract of$50,000 or more will be required to maintain
an affirmative action program, the standards for which are contained in the specifications.
Any contract resulting from this process is under and subject to Executive Order 11246, as
amended, on September 24, 1965, and to the Equal Employment Opportunity (EEO) and
Federal Labor Provisions.
The EEO requirements, labor provisions, and wage rates are included in the specification and
bid documents and will be available for inspection at the Department of Building and Safety,
City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs, CA and at the offices of Harrison Wick
Consulting, 2999 E. Via Vaquero Road, Palm Springs, CA 92262, (760) 880-8481.
To be eligible for award, each bidder must comply with the affirmative action requirements
which will be contained in the specifications.
Disadvantaged Business Enterprises (DBE's) as defined in 49 CFR Part 23 shall have the
maximum opportunity to participate in the performance of contracts under this agreement.
Consequently, the DBE requirements of 49 CFR Part 23 apply to any agreement resulting from
this process.
Women will be afforded equal opportunity in all areas of employment. However, the
employment of women shall not diminish the standards of requirements for the employment of
minorities.
N-13 AWARD OF CONTRACT
(a) The award of contract will be based on the lowest total bid, conditioned upon satisfying the
requirements established by the Sponsor (Airport) to evaluate efforts of the bidder to meet the
Disadvantaged Business Enterprise Participation contract goals included in the Bid Conditions.
The City reserves the right to award any or all parts of the Bid Schedule to the lowest
responsive, responsible bidder, and to reject all other bids, as it may best serve the interests of
the City. The City reserves the right to waive any informality in or to reject any or all portions of
the various low bids from qualified contractor bid items. The City further reserves the right, after
opening bids to reject any or all bids or to waive any minor informality (non-responsiveness) in a
bid. The award of the Contract is subject to the approval of the Federal Aviation Administration.
The Sponsor further reserves the right to negotiate changes with low bidder in the scope of
project, extent of the work, or to increase or decrease the size of the project, if so desired, all to
the best interests of the Owner, prior to award of contract. Additional information is included in
Bid Conditions.
(b) As a condition of award, the successful bidder will be required to submit payment and
performance bonds and insurance prior to execution of the Agreement by the City. Failure to
meet this requirement shall constitute abandonment of the Bids by the Bidder and forfeiture of
the Bid Bond. The contract may then be awarded to the next lowest bidder.
N-14 MANDATORY PRE-BID VISIT TO WORK SITE: Pre-qualified general contractors eligible to bid
this project are required to attend a MANDATORY pre-bid walk through of the proposed work
site and existing facilities, which will be conducted by the City at 2:00 pm on November 13,
2003. Failure to participate in the pre-bid walk though will render a bidder as non-responsive.

N-16 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid shall be sealed and
addressed to the City of Palm Springs, and shall be delivered to the Director of Procurement &
Contracting at 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262 by 2:00 p.m., local
time, on November 25, 2003. The envelope shall be plainly marked in the upper left hand
corner with the name and address of the Bidder and shall bear the words "Bid for RSIP -
PHASE IV", the date and hour of opening Bids. The certified or cashier's check or Bid Bond
shall be enclosed in the same envelope with the Bid.
N-17 COMPLETION OF WORK: Time is of the essence. The work must be completed within the
time(s) stated in the Notice to Proceed and liquidated damages will be assessed for failure to
complete on time as set forth in the agreement.

WHEREAS the Airport' 1994 Master Plan identified the need fora sound insulation program
for homes within certain areas surrounding the Palm Springs International Airport; and,
WHEREAS the Airport Commission and the City Council have adopted the boundaries for
the sound insulation program, in accordance with FAA criteria; and,
WHEREAS the City Council adopted plans and specifications for Phase IV of the
Residential Sound Insulation Program (RSIP) on October 29, 2003; and,
WHEREAS following careful review of the bid protestfiled by Great West Contractors, Inc.,
the protest is hereby upheld.
WHEREAS following careful review of the proposals, the lowest responsive, responsible
proposer has been determined to be Great West Contractors, Inc, Inc.
NOW THEREFORE BE IT RESOLVED as follows:
SECTION 1: That the Residential Sound Insulation Program (RSIP), Phase IV(AIP 3-06-
0181-29, City Project 2003-10) is awarded to Great West Contractors, Inc,
in the amount of$1,554,000, with a DBE commitment of 23%; and,
SECTION 2: That the bid protest filed by Great West Contractors, Inc is hereby upheld.
