NOIA TO CHANGE THE STREET NAME OF MESQUITE AVENUE TO DINAH SHORE DRIVE, EAST OF GENE AUTRY TRAIL TO THE CITY LIMITS. RECOMMENDATION The Planning Commission recommends that the City Council approve a street name change from Mesquite Avenue to Dinah Shore Drive, between Gene Autry Trail and the Dinah Shore Bridge. SUMMARY Ernest G. Noia has requested that Mesquite Avenue, east of Gene Autry Trail, be renamed Dinah Shore Drive. The applicant notes that Gene Autry Trail is the appropriate location to change names, given that it is designated as State Highway 111, The applicant also notes that no properties on Mesquite Avenue have been developed east of Gene Autry Trail, so the name change should not present a hardship to existing businesses in the area. On December 10, 2003, by a vote of 7-0, the Planning Commission voted to recommend that the City Council approve the proposed name change. The Notice of Public Hearing was published in the Desert Sun and distributed to property owners of property with street frontage on Mesquite Avenue, from Vella Road east to the city limit line. The applicant seeks this name change in order to link their project, the Indian Oasis Resort, to Palm Spring's historic past as a playground of the stars as well as to the glamor and prestige of Dinah Shore. BACKGROUND Pursuant to Section 14.08.010 of the Palm Springs Municipal Code, to initiate a street name change, any person may initiate a street name change for any reason consistent with law, by complying with the provisions of this chapter. In accordance with Section 14.08 of the Palm Springs Municipal Code, a proposed change of street name may be initiated by filing with the Planning Commission an application in the form prescribed by the Director of Planning and Zoning.The form must be signed by the owners of at least sixty(60) percent of the lineal frontage abutting the street to be affected. Mr. Noia controls property in excess of 63% (8,400' of 13,200') percent of the Mesquite Avenue street frontage, east of Gene Autry Trail. The City Council may, pursuant to California Government Code Section 34091.1, take such action as it deems appropriate upon the recommendation of the Planning Commission,and failure to take action within sixty days after submission of the Commission's recommendation shall be deemed denial of the application. Street name changes are a policy issue, on which the Planning Commission makes a recommendation to the City Council. The application for a street name change from Mesquite Avenue to Dinah Shore Avenue was reviewed by the Development Committee. The Development Committee is comprised of staff members from the Engineering and Public Works, Building and Safety and Planning and Zoning Departments. No objections were raised by the Development Committee. The applicant has proposed a street name change Gene Autry Trail (Hwy 111)to the Dinah Shore Bridge. A second option, to approve the name change from the City limits to Vella Road, which would provide for a continuous street name along the Dinah Shore portion of the Mid Valley Parkway,was reviewed and rejected by the Planning Commission.There are 21 parcels with frontage on Mesquite Road between Vella Road and eastern City limits. Four of these parcels, all of which are west of Gene Autry Trail, are developed. This street name change would share the boundary with the recent General Plan Amendment, which downgraded the General Plan designation of Mesquite Avenue from a Secondary Thoroughfare to a Special Collector, between Vella Road and El Cielo Changing the street name at Vella Road could result in increased traffic between Vella Road and Gene Autry Trail, and could draw additional vehicles into the Demuth Park area. The Planning Commission recommended adding a provision to the resolution requiring that the applicant pay for all costs associated with changing the street signs. The applicant has submitted correspondence further explaining the request as well as a letterfrom an adjoining property owner in support of this request. Alex Meyerhoff, Principal Planner reported that the applicant is requesting that Mesquite Avenue be renamed to Dinah Shore conjunction with improvements further east and the bridge as the roadway is part of the Midvalley Parkway link to the airport entrance. He confirmed that property owners on the subject corridor have been noticed of today's meeting as well as all property owners from Vella Road to the City Limit line. He reported that there are no residences from Gene Autry Trail to Vella Road. Director reported that the City has been working for more than a year to reduce traffic adjacent to the Demuth park and adjacent residential area and that, if the street name is changed, it is more likely that the main use of roadway at the park will be local traffic as long as the roadway name change does not include Mesquite Avenue from Gene Autry Trail westward. Chairman Shoenberger opened the Public Hearing. He stated that he feels it makes sense to use a historical name appropriate for the Coachella Valley. He also stated that, as he will be paying for street signs, he would like them to be a special color and design and will bring a specific request to the City at a later date. He stated that the Indian Oasis will be breaking ground in January and that there has been significant interest from major brand hotels. There being no further appearances, the Public Hearing was closed. In my initial submittal, I had 90.78% of the landowners in agreement. Since then, I received the enclosed letter from Palm Springs Self-Storage, Richard Hanson, general partner, which supports the name change. We now include all the frontage excluding only one parcel with 400 foot frontage out of the total of 14,100 lineal feet. I believe this owner would be in agreement, but is located back East and has not responded as yet. Please schedule the name change along with the other matters for Indian Oasis. I am writing this letter on behalf of Mid-Valley Center LP, Mid-Valley Business Park LP-,-and the Lessors for all of the frontage on both sides of Mesquite Avenue from the City border on the east to San Luis Rey on the.west. It is our understanding that if the street name change is granted, that we will be responsible for the cost of changing all street signs. We hereby agree to do same, not only for the portion we control, but for all the street signs to east side or Gene Autry Trail For your information, the approximate total frontage along Mesquite is 14,100 lineal feet for both sides, of which we control 11,500 lineal feet or 81.6%. Also, an additional 9.18% is Indian land making a real total of 90.78%. In the meantime, we have contacted the one other Indian owner as well as the two owners of the fee parcels on the south to obtain their agreement as well. We assume that they will agree since we will absorb all the underlying cost of this new signage. We would also request, if possible, that this matter be heard at the same time as the other applications submitted for the Indian Oasis Resort so that the complete picture can be presented to the appropriate agencies. OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE STREET NAME CHANGE REQUEST, FROM MESQUITE ROAD TO DINAH SHORE DRIVE, BETWEEN GENE AUTRY TRAIL AND THE DINAH SHORE BRIDGE. WHEREAS, the Municipal Code sets forth procedures for considering street name changes; and WHEREAS,the Planning Commission of the City of Palm Springs has received an application from Ernest G, Noia, the representative of property owners along the said street to change Mesquite Road to Dinah Shore Drive; and WHEREAS, the Planning Commission of the City of Palm Springs considered said request at its meeting of December 10, 2003; and WHEREAS, on December 10, 2003,the Planning Commission held a public hearing for said street name change application; and WHEREAS, on December 10, 2003, a public hearing on said street name change application was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission finds that the street name change will not be detrimental to the City of Palm Springs, and the applicant must pay for all costs associated with changing the street signs; and WHEREAS, on December 10, 2003, the Planning Commission voted to recommend that the City Council approve said street name change application; and WHEREAS, on February 4, 2004, the City Council held a public hearing for said street name change application; and WHEREAS,on February 4,2004,a public hearing on said street name change application was held by the City Council in accordance with applicable law; and WHEREAS, the City Council finds that the street name change will not be detrimental to the City of Palm Springs, and the applicant must pay for all costs associated with changing the street signs; and 16 NOW THEREFORE BE IT RESOLVED that the City Council hereby approve the street name change request, and that the street name, Mesquite Avenue, be changed to Dinah Shore Drive, between Gene Autry Trail and the Dinah Shore bridge.
