SOUTH PALM CANYON DRIVE AT SUNNY DUNES ROAD MEDIAN CONSTRUCTION
RECOMMENDATION:
It is recommended that the Community Redevelopment Agency award contract to Sol
Construction, Inc., in the amount of $36,583.00 for the South Palm Canyon Drive at
Sunny Dunes Road Median Construction, City Project 03-18.
SUMMARY:
Award of this contract will construct a new median within South Palm Canyon Drive from
Sunny Dunes Road south to the existing bridge across the Tahquitz Creek, adjacent to
the new Kentucky Fried Chicken/A&W restaurant, a redevelopment project that is
currently under construction.
BACKGROUND:
The Agency programmed a capital project for a new traffic island median within South
Palm Canyon Drive at Sunny Dunes Road as part of its 2003/2004 capital project
budget. The project was programmed to support the redevelopment of the adjacent
project site, which was considered a blighted site due to the restaurant vacated by
Sizzler and a vacant dry cleaning facility. Yum Brand Foods, operator of the previous
Kentucky Fried Chicken restaurant on that site, proceeded with plans to demolish and
redevelop the entire site, including removal of the existing dry cleaning facility and
vacant restaurant building.
Their proposed project, approved by the Planning Commission at its May 28, 2003,
meeting (Major Architectural Approval Case No. 5.0955), required construction of a
traffic island median to provide better and safer traffic circulation into and out of the
project site. The requirement was necessary in the event the Agency did not proceed
with its project. The island is necessary to prevent left-turn vehicles from exiting the
project site onto South Palm Canyon Drive, as well as prevent left-turn vehicles from
entering the project site from South Palm Canyon Drive. Access into the project site will
be made from Sunny Dunes Road, or is limited to right-turn into and out of the project
site on South Palm Canyon Drive. This was the case for the developments that
previously occupied the site, although a raised median on Palm Canyon Drive did not
exist. Turning was previously restricted by signs. Traffic congestion along this segment
of South Palm Canyon Drive will be improved as a result of this median island.

In order to expedite the project, the Agency requested that the developer prepare plans
on behalf of the Agency. The plans were prepared by Milestone Engineering, for the
developer (Yum Brand Foods), with specifications prepared by Engineering Division staff
for public bidding purposes. On February 3 at 2:30 P.M., the Department of
Procurement and Contracting received bids from the following contractors:

The engineer's estimate was $40,225. The low bidder is Sol Construction, Inc., from
Riverside, CA. The company is a California corporation whose officers are: Manuel
Andrade and Pablo Mendoza. Sufficient funds are available in Merged Project Area #1
account number 811-8191-65162 (Sunny Dunes/SPC Island).

NOTICE INVITING BIDS
For constructing:
SOUTH PALM CANYON DRIVE AT SUNNY DUNES ROAD MEDIAN CONSTRUCTION
City Project No. 03-18
N-1 NOTICE IS HEREBY GIVEN that sealed bids for the SOUTH PALM
CANYON DRIVE AT SUNNY DUNES ROAD MEDIAN CONSTRUCTION will be
received at the office of the Director of Procurement and
Contracting of the City of Palm Springs, California, until 2: 30
P.M. on February 3, 2004, at which time they will be opened and
read aloud.
N-2 DESCRIPTION OF THE WORK: The Work comprises the removal of
existing asphalt concrete pavement; and construction of new
Portland cement concrete curb, curb and gutter, curb openings, and
decorative colored concrete; replacement of existing traffic
signal loop detectors; traffic signage, striping and markings; and
all appurtenant work necessary to construct a new traffic median
located on South Palm Canyon Drive south of Sunny Dunes Road, as
shown on the plans and required in the Special Provisions .
N-3 AWARD OF CONTRACT:
(a) The City reserves the right after opening bids to reject
any or all bids, to waive any informality (non-responsiveness) in
a bid, or to make award to the lowest responsive, responsible
bidder and reject all other bids, as it may best serve the
interest of the City.
(b) As a condition of award, the successful bidder will be
required to submit payment and performance bonds and insurance.
N-4 BID SECURITY: each bid shall be accompanied by a certified or
cashier' s check or Bid Bond in the amount of 10 percent of the
total bid price, payable to the City of Palm Springs.
N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid
Price for a period of 60 calendar days from the date of bid
opening.
N-6 CONTRACTOR' S LICENSE CLASSIFICATION: The Contractor shall
possess a valid Class A Contractor license at the time of
submitting bids .
N-7 PREVAILING WAGE RATES NOT APPLICABLE: Funding for the Work
is with all local funds and, as provided under City Charter, will
NOT require compliance with the prevailing wage requirements of
the State of California.

N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive
100 percent of payments due under the Contract Documents from time
to time, without retention of any portion of the payment by the
City, by depositing securities of equivalent value with the City
in accordance with the provisions of Section 22300 of the Public
Contract Code .
N-9 OBTAINING OR INSPECTING CONTRACT DOCUMENTS:
(a) Contract Documents may be inspected without charge at the
office of the City Engineer, 3200 East Tahquitz Canyon Way, Palm
Springs, CA 92262 .
(b) Complete sets of said Contract Documents may be purchased
at $30. 00 per set and are obtainable from the office of the City
Engineer, 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262.
No refund will be made of any charges for sets of Contract
Documents.
(c) An additional fee of $20 . 00 will be charged for sets of
documents sent by mail.
N-10 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid
shall be sealed and addressed to the City of Palm Springs, and
shall be delivered or mailed to the Director of Procurement and
Contracting at 3200 East Tahquitz Canyon Way, Palm Springs, CA
92262. The envelope shall be plainly marked in the upper left hand
corner with the name and address of the Bidder and shall bear the
words "Bid For. . " followed by the title of the Project and the
date and hour of opening Bids. The certified or cashier' s check or
Bid Bond shall be enclosed in the same envelope with the Bid.
