DATE: March 3, 2004 TO: City Council FROM: Acting Director of Aviation TRANSPORTATION SECURITY ADMINISTRATION BAGGAGE AREA - CHANGE ORDER#3 RECOMMENDATION: It is recommended that the City Council approve Change Order #3 to agreement #4741 with B.E. McMurray Construction, Inc for additional work items related to the Transportation Security Administration (TSA) Baggage Area (City Project 2003-07), in the amount of$36,765.30, for a revised total agreement amount of $574,596.15. SUMMARY: City Project #2003-07 is the development of a baggage screening area for the federally mandated Explosive Detection System (EDS) equipment, which has been supplied bythe TSA.This Change Order is related to receiving federal reimbursement for the project and modifications to the passenger screening checkpoint. BACKGROUND: In response to the events of September 11`h, and the subsequent security regulations mandated by the federal government, screening of passenger luggage was required to be in place prior to December 31, 2002. The TSA initially placed all of this equipment in the lobby of the Airport's ticketing wing, which created serious congestion, poor customer service and at time, untenable exiting restrictions. In August of last year, the TSA was able to commit to three (3) CTX machines, which were placed into service in early October. This project converted an existing covered, but not enclosed area behind the ticket wing into a fully conditioned space capable of supporting the CTX machines. All of the baggage screening equipment has been removed from the ticket wing lobby. On June 4, 2003, City Council approved an agreement with B.E. McMurray Construction, Inc for this work. When the project was advertised for bid, it was not anticipated that reimbursement would be available. However, staff was recently contacted by the Federal Aviation Administration (FAA)and notified that the projectwould be eligible for reimbursement via a future Airport Improvement Program (AIP) grant. In accordance with federal guidelines, a wage rate determination has been received from the Department of Labor. This determination has been used to determine the amount of the change order so as to be in compliance with Davis-Bacon and/or State of California prevailing wage standards. Due to the requirements for passenger screening as mandated by the Transportation Security Administration (TSA), some minor modifications to the passenger screening checkpoint are needed to ensure adequate security and passenger flow space. The upcoming Airport Improvement Program (AIP) grant the Airport receives will include funding for the reimbursement of this project. This reimbursement will cover 95% of the cost with the remaining 5% coming from Airport funds. No general fund monies will be used for this project.
