HomeMy WebLinkAbout3/17/2004 - STAFF REPORTS (28) DATE: March 17, 2004 TO: City Council FROM: Director of Planning and Zoning TEMPORARY SUSPENSION OF NOISE ORDINANCE (CHAPTER 11.74.00), NOISE NUISANCE (CHAPTER 11.08.040), DANCES (CHAPTER 5.12), AND SIGN ORDINANCE (CHAPTER 93.20.00) AND APPROVING A CARNIVAL ON APRIL 9, 10, AND 11, 2004 TO FACILIATE THE PLANNED EVENTS FOR "WHITE PARTY FIFTEEN'. RECOMMENDATION That the City Council consider adopting a resolution suspending certain regulatory ordinances to facilitate "White Party Fifteen" planned events at certain locations from April 9-11, 2004. SUMMARY The White Party has been held in Palm Springs for the past 14 years. The event utilizes a wide range of venues including Palm Springs Convention Center, Wyndham Hotel, the vacant lot at the northeast corner of Arenas Road and Calle Encilia, and the Hilton Hotel. The event is scheduled from April 9-11, 2004. Over the past several years, the success of the event has resulted in increased attendance, expanded activities, and use of additional sites. As the event has grown, the City has received noise-related complaints for three locations including Wyndham Hotel, vacant lot at the northeast corner of Arenas Road and Calle Encilia, and the Convention Center. Noise complaints have been the result of loud music. If the City Council wishes to facilitate the 2004 event, certain regulatory ordinances that would normally impede such an event will need to be temporarily suspended. These ordinances include the Noise Ordinance, Noise Nuisance, Dances, and Sign Ordinance. BACKGROUND This year, the White Party is scheduled from April 9-11, 2004. Main events are the Opening Party on April 9, the White Party on April 10, the Tea Dance/Carnival on April 11, and the Closing Party on April 11. The promoter will need to apply for a Land Use Permit for only the Arenas Road Tea Dance/Carnival. Other events where live entertainment is provided are being held indoors this year (at the Wyndham Hotel, Hilton Hotel, and Convention Center) in response to noise complaints received from the previous year's event. Last year, outdoor events with live entertainment were held at the Wyndham Hotel pool and Knott's Soak City. These events are not proposed this year. This event was reviewed by the Special Events Planning Team (SEPT) on March 9, 2004 where a number of key issues were discussed. As has been the case in previous years, the promoter has agreed to work with the City in reducing noise and other safety concerns through the implementation of crowd control measures, on-site security, traffic control, medical aid, and contracted Police and Fire services. The promoter will have parade barricades erected by a private contractor, private security, and 2 California Highway Patrol officers with up to 3 additional Palm Springs Police officers at the Tea Dance in response to crowd and traffic control concerns at last year's event. The promoter is also required to submit a traffic control plan, subject to the City Engineer's approval, due to street closures for the Sunday, April 11, 2004 Tea Dance at the northeast corner of Arenas Road and Calle Encilia. A site plan showing street closures is attached to this report. The Tea Dance will include an 8-minute pyrotechnic display, near the conclusion of the event, that does not consist of aerial or concussion-type shells. The promoter and pyrotechnic company shall submit certificates of insurance accompanied by an additional insured endorsement form showing the City as an additional insured party with the standard coverage of$1,000,000. The Tea Dance will include a ferris wheel. Safety inspections for the ferris wheel are under the authority of Cal-OSHA and the Palm Springs Fire Department. In the interest of providing public information and responding to any complaints received during the course of the White Party events, a non-emergency number will be provided along with a list of contacts from the promoter's team for each event. In addition, the promoter is required to notify all surrounding neighbors in writing of the date and times of all planned activities along with the non-emergency phone number. A notice shall also appear in The Desert Sun prior to the event. The notice sent to the neighbors will also be provided to staff via e-mail. The promoter is not requesting that the City pay for any event production or operational costs. The City will invoice the promoter for any costs immediately following the event. (t,A � . OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, SUSPENDING NOISE ORDINANCE (CHAPTER 11.74.00), NOISE NUISANCE (CHAPTER 11.08.040), DANCES (CHAPTER 5.12), AND SIGN ORDINANCE (CHAPTER 93.20.00), AND APPROVING A CARNIVAL ON APRIL 9, 10, AND 11, 2004 TO FACILITATE THE PLANNED EVENTS FOR "WHITE PARTY FIFTEEN". WHEREAS, the City Council desires to facilitate the White Party; and WHEREAS, the City Council finds that certain regulatory ordinances, which are generally deemed desirable and necessary, may, nonetheless, impeded the conduct of special events; and WHEREAS, the City Council finds that in holding special events, the public interest and the benefits derived therefrom outweigh the temporary public inconvenience; and WHEREAS, the City Council has enacted Ordinance No. 1310 authorizing temporary suspension of regulatory ordinances. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs, California, finds as follows: Section 1: A. That the White Party is a special event beneficial to the community and its visitor-oriented economy. B. That the dates of the 2004 White Party are from April 9 through April 11, 2004. C. That J.S. Enterprises is the event promoter along with the Palm Springs Wyndham Hotel, the Palm Springs Hilton Hotel, and the Palm Springs Convention Center. D. That the venues of the White Party will be the Palm Springs Wyndham Hotel, Palm Springs Hilton Hotel, vacant lot at the northeast corner of Arenas Road and Calle Encilia, and Palm Springs Convention Center.
