CONVENTION CENTER TRADE CONTRACTS -AWARD OF BIDS
RECOMMENDATION:
It is recommended that City Council award the second round of Trade Contracts for
the Convention Center Phase II Expansion Project, City Project 02-27, subject to City
Council approval of Bond Documents.
SUMMARY:
This action would result in the awarding of Trade Contracts for the Convention Center
Phase II Project contingent upon the future approval of Bond Documents.
BACKGROUND:
The City Council has previously authorized the bidding of Trade Contracts for the
Convention Center Phase II Expansion Project. There will be a total of 35 separate
Trade Contracts bid on this project along with a separate purchase of Equipment.
On March 23, 2004 the following Trade Contracts will be bid:

Bids were opened on March 16, 2004 for the Masonry/stone trade with the following
results:

With an estimate/budget of$1,446,201, staff was pleased with the low bid but concerned
about the bid spread. Soon after opening the bids Mr Barajas notified the city of a
clerical error in the amount of $407,000. The city staff has reviewed his documentation
of the clerical error and recommends that the city accept his bid withdrawal for clerical
error and returns his bid bond. With the other three bidders being so far over the
designated budget staff recommends that all bids be rejected and that staff be
authorized to re-bid the project. A resolution is attached for City Council consideration.

CALIFORNIA, ACCEPTING THE CLERICAL ERROR, ALLOWING
THE WITHDRAWAL OF BID AND RETURN OF BID BOND TO
JOHN BARAJAS MASONRY FOR THE PALM SPRINGS
CONVENTION CENTER EXPANSION,CITY PROJECT NO.02-27,
TRADE CONTRACT NO.9 MASONRY/STONE,AND REJECT ALL
REMAINING BIDS AND AUTHORIZE STAFF TO IMMEDIATELY
REBID THE TRADE.
WHEREAS,on March 16,2004 Trade Bid No.9 forthe Convention Center Expansion project,
City Project No. 02-27, was opened with a pre-bid estimate/budget of$1,446,201; and
WHEREAS, bids were received from John Barajas ($1,164,452), Winegardner Masonry
($2,100,000), DBM/Hatch ($2,228,841) and Kretschmer & Smith ($2,568,000); and
WHEREAS, shortly after the bid opening the city was advised by the low bidder that he had
discovered a large clerical error in his bid and was requesting a withdrawal of his bid; and
WHEREAS, upon receipt of official correspondence from Mr Barajas outlining the specifics
of the clerical error, staff conducted a review of the evidence submitted and concurs that a
clerical error did occur; and
WHEREAS, the remaining three bids are all well in excess of the established budget,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as
follows:
Section 1. That the City finds that the low bidder John Barajas Masonry, submitted a bid with
a clerical error and hereby allows the bids withdrawal and release of the bid
bond ; and
Section 2. That all other bids received for Trade Bid No. 9, Masonry/Stone, were in excess
of the established budget and that they are all hereby rejected and staff is
authorized to immediately rebid the Trade.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA,ACCEPTING THE CLERICAL ERROR,ALLOWING
THE WITHDRAWAL OF BID AND RETURN OF BID BOND TO
JOHN BARAJAS MASONRY FOR THE PALM SPRINGS
CONVENTION CENTER EXPANSION,CITY PROJECT NO.02-27,
TRADE CONTRACT NO,9 MASONRY/STONE,AND REJECT ALL
REMAINING BIDS AND AUTHORIZE STAFF TO IMMEDIATELY
REBID THE TRADE.
WHEREAS,on March 16,2004 Trade Bid No.9 forthe Convention Center Expansion project,
City Project No. 02-27, was opened with a pre-bid estimate/budget of$1,446,201; and
WHEREAS, bids were received from John Barajas ($1,164,452), Winegardner Masonry
($2,100,000), DBM/Hatch ($2,228,841) and Kretschmer& Smith ($2,568,000); and
WHEREAS, shortly after the bid opening the city was advised by the low bidder that he had
discovered a large clerical error in his bid and was requesting a withdrawal of his bid; and
WHEREAS, upon receipt of official correspondence from Mr Barajas outlining the specifics
of the clerical error, staff conducted a review of the evidence submitted and concurs that a
clerical error did occur; and
WHEREAS, the remaining three bids are all well in excess of the established budget,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as
follows:
Section 1. That the City finds that the low bidder John Barajas Masonry,submitted a bid with
a clerical error and hereby allows the bids withdrawal and release of the bid
bond ; and
Section 2. That all other bids received for Trade Bid No. 9, Masonry/Stone, were in excess
of the established budget and that they are all hereby rejected and staff is
authorized to immediately rebid the Trade.
