APPROVAL OF PLANS
RECOMMENDATION:
It is recommended that the City Council approve and adopt the plans, specifications and
working details,and authorize advertisement for construction bids for City Project#2003-
17, AIP Project No 3-06-0181-37, Security Access Control System (SACS) and Public
Information Display System (PIDS),with the award of an installation contract contingent
upon the receipt of federal funding.
SUMMARY:
Section 7.03.040 of the Procurement and Contracting Code requires that the City
Council approve and adopt plans, specifications and working details, and authorize the
bid request for all public projects in excess of $100,000. Approval of this project will
allow staff to proceed with this public project, with an Engineer's estimate of
approximately $3,000,000.This projectwill befunded by a pending Airport Improvement
Program (AIP) grant from the Federal Aviation Administration (FAA).
BACKGROUND:
The airport's Security Access Control System (SACS) was originally installed in 1992-
1993 as part of Airport Improvement Project (AIP) 12 and in accordance with Federal
Aviation Regulation (FAR) Part 107. The original provider of the system, LINX
Technologies, Inc. was purchased by Mosler, Inc. in 1994. The operating software and
portions of the field hardware were upgraded in 1999 as part of the construction for the
Sonny Bono concourse, with funds provided by AIP 26.
In 2001, Mosler, Inc declared bankruptcy and as such, technical support and
replacement parts have been non-existent since that time. Fortunately, the Airport had
a supply of spare parts and has been able to obtain technical support, as required from
former Mosler employees who are now employed by other companies within the access
control industry.
Without this technical support and spare parts, staff has been working with the FAA to
obtain the necessary funds for the replacement of the system. Since the events of
September 111" and the creation of the Transportation Security Administration (TSA),
new standards for SACS have been issued and as such, have been incorporated into
the design of the proposed system. These new requirements deal with the types of
technology regarding storage and transfer of data, enhanced biometric type devices as
well as othertechnical requirements.Additionally,there are new requirements regarding
the disclosure of this type of information, which is considered "Sensitive Security
Information", or SSI and is governed by Code of Federal Regulations (CFR) Part 1520.
The Public Information Display System (PIDS) involves visual display of security
information, flight information and American with Disabilities Act (ADA) requirements.
The existing system was originally installed in 1994 and was upgraded and expanded
in 1999 as part of the Sonny Bono Concourse construction. Since that time, the

technology available forthese type of systems has undergone significant changes which
reflect the overall growth and changes to the electronics industry. Also, the vendor who
originally installed the system is no longer in business, thus technical support and
replacement parts are no longer available.
The Airport's Division of the FAA have recently adopted new procedures for the
processing of AIP projects. One of these new requirements is that the funding be based
on an actual bid, not an estimate. The FAA has indicated that discretionary funding may
be available in this fiscal years appropriations. In order to get these funds, the Airport
must have a hard bid in place prior to any construction.
Section 7.03.040 of the newly enacted Procurement and Contracting Code requires that
for public projects in excess of$100,000, the City Council approve and adopt the plans,
specifications and working details, and authorize staff to advertise for construction bids.
The bidding process is scheduled to be complete on May 25, 2004 and will be brought
before the City Council in June.
Copies of the plans and specifications are available in the City Clerk's office for review.

NOTICE IS HEREBY GIVEN that Contractor Pre-Qualifications will be received at the Office of the Department of
Procurement and Contracting of the City of Palm Springs, California, 3200 East Tahquitz Canyon Way, Palm
Springs, California 92262 until, 2:00 PM, local time on May 10, 2004. Contractors are encouraged to submit this
pre-qualification package as soon as possible so that they may be notified of omissions of information which need to
be remedied prior to the submission date. Pre-Qualifications must be submitted in sealed envelopes marked on the
outside "SECURITY ACCESS CONTROL AND PUBLIC INFORMATION DISPLAY SYSTEMS
REHABILITATION".
LOCATION OF WORK — The Work to be performed hereunder is located at 3400 E. Tahquitz Canyon Way,
Palm Springs,California.
DESCRIPTION OF THE WORK — The Work to be done includes, but may not be limited to, furnishing all
construction, plant, necessary engineering, architecture, labor, tools, transportation, services, supervision, materials
and equipment required to complete Schedules I and II for the Palm Springs International Airport.

OBTAINING OR INSPECTING CONTRACT DOCUMENTS — A complete set of Contract Documents dated
April 6, 2004 may be obtained on, or after April 12, 2004 at J.P. Reprographics, 224 N. Indian Canyon Drive, Palm
Springs, California 92262, phone(760) 325-3717,fax(760) 325-0817. An additional charge will be made for plans,
specifications and bid documents mailed out.
PROJECT ADVERTISEMENT — The project was advertised for Pre-Qualifications April 6, 2004 and April 13,
2004.
PRE-QUALIFICATION VISIT TO WORK SITE—All interested contractors are advised to examine the site to
become familiar with all site conditions. The project will be shown to interested contractors at 1:00 PM, local time,
on April 23, 2004. Contractors will meet at the Palm Springs hrternational Airport Conference Room, upstairs, for
the Pre-Qualification Conference,
CONTRACTOR'S LICENSE CLASSIFICATION — In accordance with the provisions of California Public
Contract Code Section 3300, the City has determined that the Contractor shall possess a valid Class C-10 Contactor
License at the time the Contract is awarded. Failure to possess the specified license shall render the bid as non-
responsive and shall act as a bar to award of the Contact to any bidder not possessing said license at the time of
award.
The Contractor must be licensed to do business in the City of Pahn Springs in accordance with the provisions of
Chapter 9, Division 3, of the Business and Professions Code, and will be required to obtain a City Construction
Permit No Fee from the Building Department and/or the Public Works Inspection Supervisor, City Hall, Pahn
Springs,California.
WAGE RATE REQUIREMENTS—
(a) State — In accordance with the provisions of California Labor Code Section 1770, 1773, 1773.1,
1773.6 and 1773.7, as amended, the Director of the Department of Industrial Relations has determined the general
prevailing rate of per diem wages in accordance with the standards set forth in Section 1773 for the locality in which
the Work is to be performed. A copy of said wage rates is on file at the Department of Building and Safety, City
Hall, Palm Springs, California. It shall be mandatory upon the Contractor to whom the Work is awarded and upon
any subcontractor under the Contractor to pay not less than said specified rates to all workers employed by them in
the execution of the Work, and shall post a copy of said wage rates at the project site.
(b) Federal — The general prevailing rate of wages, as determined by the Secretary of Labor are
included hereinafter as part of the Contract Documents;provided, that if there is any difference between the State of
Federal wage rate for any given craft or mechanic needed to execute the work, it shall be mandatory upon the
Contractor and any subcontractor to pay the higher of the two rates.
All labor on the project shall be paid no less than the minimum wage rates established by the U.S. Secretary of
Labor.
TRADE RESTRICTIONS—All solicitations, contracts and subcontracts resulting from projects funded under AIP
must contain the foreign bade restriction required by 49 CFR Part 30,Denial of Public Works Contracts to Suppliers
of Goods and Services of Countries That Deny Procurement Market Access to U.S. Contractors.
The Aviation Safety and Capacity Expansion Act of 1990 provides that preference be given to steel and
manufactured products produced in the United States when funds are expended pursuant to a grant issued under the
Airport Improvement Program.
EQUAL EMPLOYMENT OPPORTUNITY AND AFFIRMATIVE ACTION REQUIREMENTS — Each
bidder must complete, sign and furnish,prior to award of the contract, the"Bidders Statement on Previous Contracts
Subject to EEO Clause", a "Certification of Nonsegregated Facilities", and the "Assurance of Disadvantaged
Business Enterprise Participation" as contained in the Bid Proposal. These items must be submitted with his or her
bid.
A Contractor having 50 or more employees and his or her subcontractors having 50 or more employees and who
may be awarded a contact of $50,000 or more will be required to maintain an affirmative action program, the
standards for which are contained in these specifications.
The proposed contract is under and subject to Executive Order 11246, as amended, of September 24, 1965, and to
the Equal Employment Opportunity(EEO)and Federal Labor Provisions.
The EEO requirements, labor provisions, and wage rates are included in the specifications and bid documents and
are available for inspection at the Department of Building and Safety,City Hall,Palm Springs, California.
To be eligible for award, each bidder must comply with the affirmative action requirements which are contained in
the specifications.
Disadvantaged Business Enterprises (DBEs) as defined in 49 CFR Para. 26 shall have the maximurn opportunity to
participate in the performance of contracts under this agreement. Consequently, the DBE requirements of 49 CFR
Part 26 apply to this agreement.
Women will be afforded equal opportunity in all areas of employment. However, the employment of women shall
not diminish the standards of requirement for the employment of minorities.
CONTRACTOR PRE-QUALIFICATION The City of Palm Springs has determined that bidders for the above
named project must be pre-qualified prior to submitting a bid on this project.
1. It is mandatory that all Contactors who intend to submit a bid fully complete this pre-qualification
questionnaire and provide all materials identified herein, and be approved by the City of Pahn Springs to be
on the final qualified Bidders list. No bid will be accepted from a Contractor that has failed to comply with
these requirements for the above named project.

2. Contractors may submit pre-qualification packages during regular working hours on any day that the offices
of the City of Palm Springs are open. Contractors are encouraged to submit this pre-qualification package as
soon as possible so that they may be notified of omissions of information which need to be remedied prior to
the submission date. Contractors who submit a complete pre-qualification package will be notified of their
qualification status no later than five(5)business days after submission of the information.
3. Answers to questions contained in the pre-qualification questionnaire, information about current bonding
capacity, notarized statement from surety and the most recent reviewed or audited financial statements, with
accompanying notes and supplemental information are required. The City will use these documents as the
basis of rating Contractors in respect to the above named project. The City reserves the right to check other
sources available.The City's decision will be based on objective evaluation criteria.
4. The City reserves the right to adjust, increase, limit, suspend or rescind the pre-qualification rating based on
subsequently learned information. Contractors whose rating changes sufficient to disqualify them will be
notified and given an opportunity for a hearing consistent with the hearing procedures described below for
appealing a pre-qualification rating.
5. While it is the intent of the pre-qualification questionnaire and documents required therewith to assist the City
in determining bidder responsibility prior to bid and to aid the City in selecting the lowest responsible,
responsive bidder, neither the fact of pre-qualification, or any pre-qualification rating will preclude the City
from a post-bid consideration and determination of whether a bidder has the quality, fitness, capacity and
experience to satisfactorily perform the proposed work and has demonstrated the requisite trustworthiness.
6. The City reserves the right to waive minor irregularities and omissions in the information contained in the
pre-qualification package submitted, to make all final determinations and to determine at any time that the
pre-qualification procedures will not be applied to a future public works project.
7. The City of Pahn Springs may refuse to grant pre-qualification where the requested information and materials
are not provided by May 10, 2004.There is no appeal from a refusal for an incomplete or late application, but
re-application for a later project is permitted. The closing time for submission will not be changed in order to
accommodate supplementation of incomplete submissions or late submissions.
8. The pre-qualification package (questionnaire and financial statements) submitted by Contractors are not
public record and are not open to public inspection. All information provided will be kept confidential to the
extent permitted by haw.However,the contents may be disclosed to third parties for purpose of verification or
investigation of substantial allegations, or in the appeal hearing. State law requires that names of Contractors
applying for pre-qualification status shall be public records subject to disclosure and the first page of the
questionnaire will be used for that purpose.
9. Each questionnaire must be signed under penalty of perjury in the manner designated at the end of the form
by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. If
any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the
City and provide updated accurate information in writing,under penalty of perjury.
10. Where a timely and completed application results in a rating below that necessary to pre-qualify, an appeal
can be made. An appeal is begun by the Contractor delivering notice to the City of its appeal of the decision
with respect to its pre-qualification rating, no later than two (2) business days prior to the closing time and
date for the receipt of information for this project.Without a timely appeal, the Contractor waives any and all
rights to challenge the decision of the City, whether by administrative process,judicial process or any other
legal process or proceeding.
a. NOTE: A Contractor may be found not pre-qualified for bidding on a specific contract to be let by the
City of Palm Springs until the Contractor meets the City's requirements. In addition, a Contractor may
be found not pre-qualified for either:

PRE-BID VISIT TO WORK SITE —All bidders are advised to examine the site to become familiar with

2004. Contractors will meet at the Signature Flight Support Facility for the Pre-Bid Conference.
COMPLETION OF WORK— Time is of the essence, The Work must be completed within 90 calendar
days after commencement date stated in the Notice To Proceed.
AWARD OF CONTRACT—
(a) The Work hereunder is set forth in the Bid documents. The award of contract will be based
on the lowest total bid, conditioned upon satisfying the requirements established by the Sponsor to
evaluate efforts of the bidder to meet the Disadvantaged Business Enterprise Participation contract
goals included in the Bid Conditions. The City reserves the right to award any or all parts of the various
schedules to the lowest responsive, responsible bidder, and to reject all other bids, as it may best serve
the interests of the City. The City reserves the right to waive any informality in or to reject any or all
portions of the various low bids from qualified contractor bid items. The City further reserves the right
after opening bids to reject any or all bids, or to waive any minor informality (non-responsiveness) in a
bid. The award of the contract is subject to the approval of the Federal Aviation Administration.
The Sponsor further reserves the right to negotiate changes with the low bidder in the scope of project,
extent of the work, or to increase or decrease the size of the project, if so desired, all to the best
interest of the Owner, prior to award of the contract. Additional information is included in BID
CONDITIONS.
(b) As a condition of award, the successful bidder will be required to submit bonds and
insurance, prior to the execution of the Agreement by the City. Failure to meet this requirement shall
constitute abandonment of the Bid by the Bidder and forfeiture of the Bid Bond. The Contract will then
be awarded to the next lowest bidder.
BID SECURITY — Each bid shall be accompanied by a certified cashier's check or Bid Bond in the
amount of 10 percent of the total bid price (all schedules), payable to the City of Palm Springs, as a
guarantee that the Bidder, if its Bid is accepted, will promptly obtain the required Bonds and Insurance
and will prepare the required submittal document and execute the Agreement.
BIDS TO REMAIN OPEN — The Bidder shall guarantee the Total Bid Price for a period of 45 calendar
days from the date of Bid Opening.
CONTRACTOR'S LICENSE CLASSIFICATION — In accordance with the provisions of California
Public Contract Code Section 3300, the City has determined that the Contractor shall possess a valid
Class B Contractor License at the time the Contract is awarded. Failure to possess the specified

RETAINAGE FROM PAYMENT — The Contractor may elect to receive 100 percent payments due
under the Contract Documents from time to time, without retention of any portion of the payment by the
City, by depositing securities of equivalent value with the City in accordance with the provisions of
Section 22300 of the Public Contract Code. Such securities, if deposited by the Contractor, shall be
valued by the City, whose decision on valuation of the securities shall be final. Securities eligible for
Investment under this provision shall be limited to those listed in Section 6430 of the Government Code
or bank or savings and loan certificates of deposit.
ADDRESS AND MARKING OF BIDS —The envelope enclosing the Bid shall be sealed and addressed
to the City of Palm Springs, and shall be delivered or mailed to Harold E. Good, CPPO, Director of
Procurement and Contracting, at 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262. The
envelope shall be plainly marked in the upper left hand corner with the name and address of the Bidder
and shall bear the words "GENERAL AVIATION PROCESSING FACILITY, PALM SPRINGS
INTERNATIONAL AIRPORT, CITY PROJECT 2004-20", followed by the date and hour of opening
Bids. The certified or cashier's check or Bid Bond shall be enclosed in the same envelope with the Bid.
