SUMMARY.
The City Council will consider adoption of Ordinance No. 1720,
RECOMMENDATION:
Waive further reading and adopt Ordinance No. 1720, "AN ORDINANCE OF THE CITY
OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 12,20.020 OF THE PALM
SPRINGS MUNICIPAL CODE, RELATING TO THE ESTABLISHMENT OF PRIMA
FACIE SPEED LIMITS OF VARIOUS CITY STREETS."
STAFF ANALYSIS:
At its September 19, 2007, meeting the City Council introduced on first reading the
proposed ordinance.
This report provides for the City Council to waive further reading and adopt the
ordinance. The ordinance shall be effective 30-days from adoption.

AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING SECTION 12.20.020 OF THE
PALM SPRINGS MUNICIPAL CODE, RELATING TO THE
ESTABLISHMENT OF PRIMA FACIE SPEED LIMITS OF
VARIOUS CITY STREETS
City Attornev's Summary
This Ordinance establishes prima facie speed limits in
accordance with the California Vehicle Code.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. REVISED TITLE. Section 12.20.020 "Decrease of State Maximum Speed
Law" is hereby amended to read: Section 12.20.020 "Prima Facie Speed Limits
Established."
SECTION 2. AMENDED CODE. The text of Section 12.20.020 is hereby deleted and
replaced with the following:
In accordance with California Vehicle Code Sections 22357 and 22358, it is determined,
based upon an engineering and traffic survey dated July 13, 2007, prepared by Albert
Grover & Associates at the direction and under the supervision of the City Engineer of
the City of Palm Springs, that a speed greater than 25 miles per hour would facilitate the
orderly movement of vehicular traffic and would be reasonable and safe upon the City
streets so designated herein otherwise subject to a prima facie limit of 25 miles per
hour; and, as the case may be, that the limit of 65 miles per hour is more than is
reasonable or safe upon the City streets so designated herein.
It is declared that the prima facie speed limit shall be as herein set forth on the following
streets designated in this section, when appropriate signs giving notice thereof are
erected upon the street.

In accordance with California Vehicle Code Section 40802(a)(2), the prima facie speed
limits established herein shall remain valid for a period of five (5) years from the date of
the engineering and traffic survey, until July 13, 2012.
In accordance with California Vehicle Code Section 40802(c)(1), the prima facie speed
limits established herein shall remain valid for a period of seven (7) years from the date
of the engineering and traffic survey, until July 13, 2014, provided the criteria associated
with the arresting officer identified therein Section 40802(c)(1) is satisfied.
In accordance with California Vehicle Code Section 40802(c)(1), the prima facie speed
limits established herein shall remain valid for a period of ten (10) years from the date of
the engineering and traffic survey, until July 13, 2017, provided the criteria associated
with the arresting officer identified in Section 40802(c)(1) is satisfied, and the City
Engineer evaluates the prima facie speed limit and determines that no significant
changes in roadway or traffic conditions have occurred, including, but not limited to,
changes in adjoining property or land use, roadway width, or traffic volume.
SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty
(30) days after passage.
SECTION 4. PUBLICATION. The City Clerk is hereby ordered and directed to certify to
the passage of this Ordinance, and to cause the same or a summary thereof or a
display advertisement, duly prepared according to law, to be published in accordance
with law.
