2004 AIDS ASSISTANCE PROGRAM'S 11T"ANNUAL "EVENING UNDER THE STARS"
RECOMMENDATION:
That City Council consider adopting a resolution suspending certain regulatory
ordinances to allow the 2004 AIDS Assistance Program's 11'h Annual "Evening
Under the Stars" event at O'Donnell Golf Course on Saturday, May 8.
SUMMARY:
The AIDS Assistance Program is conducting its 111h Annual "Evening Under the
Stars" event on Saturday, May 8, at O'Donnell Golf Course. The event features
several activities, including a seated dinner, silent auction, and live entertainment
throughout the evening. The evening's entertainment is predominately performed
by a 15-piece"big band"-style orchestra, playing solo and backing up several acts.
The gala is scheduled for run from 5:30 p.m. to 10:00 p.m., concluding with a
stage show by renowned signer Nancy Wilson at 9:00 p.m. The AIDS Assistance
Program is requesting that City Council suspend certain regulatory ordinances to
allow the event to occur at O'Donnell Golf Course and accommodate the
possibility of encore performances up until 10:30 p.m. No funds are being
requested for this event.
BACKGROUND:
The AIDS Assistance Program is a local charitable organization that either
produces or participates in the production of various fund raisers throughout the
year. The "Evening Under the Stars" gala is the primary fund raiser for the
organization and is produced by the AIDS Assistance Program.
The AIDS Assistance Program has been operating for 13 years and receives more
than 80% of its funding from private sources. The program provides nearly
$500,000 in direct services each year to low income families earning less than
$15,000 annually. This support is in the form of much needed food vouchers.
Revenuefrom the"Evening Underthe Stars"gala accounts for approximately one-
third of the annual funds needed by the AIDS Assistance Program to support its
worthy cause. This year alone, the AIDS Assistance Program will be supplying
food vouchers to about 475 men, women and children who are in need of its
financial support.

No funds are being requested of the City to support this event. The AIDS
Assistance Program is only asking that certain regulatory ordinances routinely
suspended in support of special events in the community be waived to
accommodate the live music performances occurring at O'Donnell Golf Course.
Staff is seeking City Council's consideration and approval of this request and has
attached a Resolution suspending the required ordinances.

Dear Scott,
At your suggestion, I am writing to follow up on our phone conversation and my request
for a noise abatement waiver for the AIDS Assistance Program's 11'h Annual "Evening
Underthe Stars", which is being held on Saturday, May 81h on the greens of the
O'Donnell Golf Club here in downtown. Last year was the first year we were back on the
greens after two years of less than desirable weather and the evening was magical.
Unfortunately we did have a few complaints that night even though our entire event was
self contained within the walls of the O'Donnell. In an effort to avoid any unforeseen
problems this year as a result of delays or possible performance encores, we are asking
that the Palm Springs City Council approve a 30 minute waiver to the 10:00 PM noise
ordinance.
An outline of our-gala evening is as follows:
5:30 PM—guests arrive at Belardo&Amado with approximately an hour of hosted
cocktails. There is a jazz combo that will be playing on the greens during this time.
6:30 PM—Guests are asked to take their seats for dinner. It takes some time to get
approximately 1000 people seated but their salads are pre set.
7:00 PM—Our MC will welcome everyone, do thank you's and during this hour we will
be presenting 5 awards to distinguished community members. There will be background
music during dinner from the 15 piece Dry Martini Orchestra.
8:00 PM—We announce the close of the Silent Auction and our auctioneer is introduced
and takes the stage to proceed with the Live Auction, which should take 20 to 25
minutes.
8:30 PM—The Rat Pack Review will take the stage to open the entertainment portion of
the evening with a 30 minute set. They too are backed by the 15 piece orchestra.
9:00 PM—The lead with the Rat Pack will then introduce Ms. Nancy Wilson as she takes
the stage for an hour long concert. Ms. Wilson will also be accompanied by the Dry
Martini Orchestra.
10:00 PM— Nancy Wilson should be finished by now, but it is open ended to
accommodate audience response and expected encores.
From the above (10 PM) line you can see why we need that 30 minute leeway in the
guidelines. Scott, anything you can do to help accommodate us in this instance will be
greatly appreciated. If you have any further questions please feel free to give me a call

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, TEMPORARILY SUSPENDING CERTAIN
REGULATORY ORDINANCES TO FACILITATE THE 2004 AIDS
ASSISTANCE PROGRAM'S 11T" ANNUAL "EVENING UNDER
THE STARS"
WHEREAS the City Council desires to facilitate the staging of events by local charitable
organizations; and
WHEREAS the City Council finds that certain regulatory ordinances, which are generally
deemed desirable and necessary, may,nonetheless, impede the conduct of special events;
and
WHEREAS the City Council finds that in holding special events, the public interest and the
benefits derived therefrom outweigh the temporary public inconvenience; and
WHEREAS the City Council has enacted Ordinance #1310 authorizing temporary
suspension of regulatory ordinances.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California, as follows:
Section 1. A. That the 2004 AIDS Assistance Program's 111h Annual "Evening Under the
Stars" is a special event beneficial to the community.
B. That the date and time of the 2004 AIDS Assistance 11`h Annual 2004 AIDS
Assistance Program's 11`hAnnual"Evening Underthe Stars"Evening Under
the Stars" is Saturday, May 8, from 5:30 p.m. to 10:30 p.m.
C. That the AIDS Assistance Program is the event promoter, along with its
construction personnel and staff.
D. That the venue is O'Donnell Golf Club in downtown Palm Springs.
Section2. That the following ordinances are hereby temporarily suspended for the special
event designated in Section 1 above: Sign Ordinance, Zoning Ordinance,
Noise Ordinance, Nuisance Ordinance and Dances Ordinance.
Section 3. That the regulatory ordinances designated in Section 2 above shall remain in
full force and effect as to the event, date and persons or organizations as
designated in Section 1 above.
