The City and the Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1-THE WORK The Contractor shall complete the Work as specified or indicated under the Bid Schedule(s) of the City Contract's contract Documents entitled: Palm Springs Phase II Palm Springs Convention Center Expansion Phase II City Project No 02-27-01 The work is generally described as follows: All that Work set forth in the Trade Bid Schedule of the bid Forms, as awarded by the City of Palm Springs, pursuant to the Contract Documents for the City Project No. 02-27- 01. ARTICLE 2-COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced on the date specified the Notice to Proceed by the City and the Work shall be fully completed within the time specified in the Notice to Proceed. The City and the Contractor recognize that time is of the essence of this Agreement and that the City will suffer considerable financial loss if the Work is not completed within the time specified in said Notice to Proceed, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. The damages suffered by the City would be extremely difficult or impractical to determine in the event of a breach by the Contractor. Accordingly the City and the Contractor agree that the Contractor shall pay the amount provided in Exhibit G of the contract documents attached hereto as liquidated damages, for each calendar day that the work is not completed in the time set forth. ARTICLE 3-CONTRACT PRICE ($369,233.00) The City shall pay the contractor for the completion of the Work hereunder in accordance with the Contract Documents in current funds the Contract Price(s) named in the Contractor's Bid and accepted Bid Schedule. ARTICLE 4-THE CONTRACT DOCUMENTS The Contract Documents consist of : notice Inviting Bids, Instructions to Bidders, the accepted Bid and Bid Schedule, the Schedule of Values, Bid Security or Bid Bond, this Agreement Worker's Compensation Certificate, Performance Bond, Multiple Oblige Rider to Performance Bond, Payment Bond, Notice of Award Notice to Proceed, Notice of Completion, General Conditions of the Contract, Supplementary General Conditions of the Contract, the Technical Specifications, Drawings listed in The Schedule of Drawings in the Supplementary General Conditions or in the Index on the Cover of the Drawings, Addenda numbers 1, 2, and 3 Inclusive, and all Change Orders, and Work Directive Changes which may be delivered or issued after the Effective Date of the Agreement and are not attached hereto. ARTICLE 5- PAYMENT PROCEDUERES The Contractor shall submit Applications for Payment in accordance with the provisions of the General Conditions and the Supplementary General Conditions of the Contract. Applications for Payment will be processed by the City as provided in the Contract Documents. ARTICLE 6- NOTICES Whenever any provision of the Contract Documents requires the giving of written notice, it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address know to the giver of the Notice. ARTICLE 7- MISCELLANEOUS Terms used in this Agreement which are defined in Article 1 of the General Conditions will have the meanings indicated in said General Conditions and Supplementary General Conditions. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically but without limitation monies that may become due and monies that are due many not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. The City and the Contractor each binds itself, its partners, successors, assigns, and legal representatives to the other party hereto, its partners, successors , assigns, and legal representatives in respect of all covenants, agreements, and obligations contained in the Contract Documents. On the basis of the above and further examinations, investigations and studies which the Trade Contractor has made in connection with the Work, Trade Contractor represents and agrees that the Contract Documents and Exhibits are accurate to the best of the Trade Contractor's knowledge and that the Work can be performed in strict accordance with the terms of their Agreement with the City. C. Scope Of Work General Scope: 1. Provide all Selective Demolition Work as required by the Contract Documents. The following items and descriptions of Work are particularly included and are not intended to limit the Trade Contractor's Work but to clarify or emphasize the Work. 2. All items listed under scope of work that are not specifically shown in the Contract Documents, or are necessary to perform this Work to completion, must be included by this Trade Contractor. 3. This Work includes, but is not limited to, all the Work specified in Section(s) 01732, 01735 and 02222 of the Specifications. 4. The word "provide" when used herein shall mean Provide completely, including all costs for labor, material, equipment, travel, hoisting, scaffolding, tools, rigging and any other facilities necessary to complete the Work. 5. The word "remove'when used shall mean remove and dispose, unless otherwise noted. 6. All required fees, sales taxes, haul route permits, freight or other ancillary charges associated with the performance of this Work are included. The Building Permit will be obtained and paid for by others. 7. Provide the complete Selective Demolition to meet all the criteria of the Contract Documents, Exhibits, and all governing agencies. Selective Demolition Trade Contractor shall coordinate with other Trade Contractors to ensure the areas during after demolition are safe for work to continue. Coordinate all Area, Utility, Service and Equipment shutdowns with Turner and other Trade Contractors. 8. Trade Contractor shall be responsible for providing Protection of adjacent surfaces. Sanitary protection of all loads or items being transported through or around the Existing Building of the Convention Center Facility. 2 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 9. Parking will be included in areas designated by the Project Superintendent at the City's discretion. 10. Remove general debris and leave Work area broom clean on a daily basis. Trade Contractor shall deposit all debris in trash bins. 11. Food & beverages will be allowed in designated areas only. The designated area will be located outside of existing and new building areas and may be located offsite. Designated areas will be determined by Turner Construction Company. 12. A City Business License must be obtained within ten business days after the start of the project. 13. Move-ins: As required to meet the schedule and performance of the Selective Demolition portion of work. 14. The Working hours for the project will be 7:00 a.m. —3:30 p.m, daily. All off-hour work deliveries must be scheduled through the Construction Manager. 15. Provide, install and coordinate all hoisting, rigging, scaffolding, fall protection and temporary bracing necessary for the safe execution of your Work required by OSHA and the City's Safety Program, whichever is most stringent will apply. 16. Work to be performed in areas: All Work areas shown or on Contract Documents. 17. Trade Contractor is responsible for performing an existing damage survey in areas of Trade Contractors Work in existing areas within five (5) days prior to beginning work. In addition, submit a video tape of existing facility with a typed list to Turner Construction Company on your Company's letterhead with the pertinent Company Representative certifying all damage noted is true and the list is complete. Any items not listed by the Trade Contractors will be the responsibility of the Trade Contractor to correct to the satisfaction of Turner Construction Company and the Owner. Survey should encompass all areas to be used during demolition and construction; including, but not limited to, all areas of demolition and construction within or around the public areas, mechanical, plumbing and electrical rooms, mechanical, plumbing and electrical equipment and utilities, back of house, offices, stairways, storage, closets, lobbies, exhibit hall, service areas, corridors, exteriors, roofs, ceilings, site, offsites, ramps, docks, etc. 18. Include traffic control, flagmen and staging for all activities, vehicles and equipment related to your work including deliveries. 19. Delivery of materials and equipment shall be scheduled and coordinated with Turner. 20. Provide layout/verification as required for the work unless noted otherwise. Reference lines and grades only will be provided by City's surveying. Provide any required grade/elevation surveys. 21. All excavations shall be shored and braced as required. Loadings from existing structures and utilities and services shall be accounted in the shoring and bracing requirements. Engineered plans for shoring and bracing shall be provided if required. Provide required access/egress/ventilation into all trenches, excavations or confined spaces for all workers and governing agency inspections. 22. All required utility and systems shut-downs, or all area closures are to be scheduled and coordinated in advance with all agencies having jurisdiction of the work, including, but not limited to, the City, Building Department, Engineering, Public Works, Fire Department,Verizon, SCE, Gas Company, DWA, Fire Alarm Monitoring, Building Management Systems, Security and other agencies having jurisdiction, and with the Convention Center through Turner. Perform shut- downs and closures related work on off-hours, or approved schedule time frame as not to cause disruption of the facility or its systems and operations, as required. Provide 72 hour notification for any scheduled shut down. 3 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 23. Storage space on site is extremely limited. Use, placement and size of Trade Contractor jobsite office trailers and storage bins shall be reviewed and approved by Turner, and may not be allowed. Storage area will be located at the 5 Acre East Lot located at the Southeast corner of Avenida Caballeros and Amado Road, as noted in the Proposed Site Logistics plan, dated February 6, 2004. Limited Office Trailer space is available to the Trades that are required to provide onsite jobsite offices as noted in the Temporary Utilities for Construction Purposes (Exhibit F), dated February 6, 2004. 24. Notify DIGALERT (1-800-277-2600) a minimum of two (2) days before commencement of all excavating or trenching. 25. Provide on-site dust control and clean-up of soil, including the adjacent sites and streets, during the execution of the work. The PM-10 and SWPPP plans will be provided and maintained by the Site Demolition and Grading Trade Contractor through the duration of the project. However, coordination, removal and replacement of PM-10 and SWPPP measures to accommodate your work will be this Trade Contractor's responsibility. Coordinate your work, including impacts to the above plans, with the Site Demolition and Grading Trade Contractor prior to start of your work. 26. All clean up of streets, adjacent properties and site debris, generated by execution of its work will be the responsibility of this Trade Contractor. 27. Provide all water required for construction, including dust control. The temporary water consumption costs will be paid for by the City of Palm Springs. 28. Protect in place all new and existing work within the demolition and construction limits, and the existing Convention Center that will be remaining, reused, reworked or reconnected, unless otherwise noted. 29. References to Selective Demolition Trade Contractor shall mean Selective Demolition Trade Contractor. References to Selective Demolition Trade Contractor shall mean Selective Demolition Trade Contractor. 30. Specifically refer to Cutting and Patching, specification section 01732, and Selective Demolition, and Appendix Demolition Photographs, specification section 01735 for additional demolition, patching, reuse, rework or reconnect work required by your scope of work. 31. Site shall be enclosed with construction fencing with the boundaries conveyed on the proposed Site Logistics plan, dated February 6, 2004. All temporary removal, relocation and replacement of fencing to perform your work will be this Trade Contractor's responsibility. Coordinate removal, relocation and replacement of fencing with Turner 72 hours in advance of commencement of work. Specific Scope: 1. Provide all Selective Demolition Work as required by the Contract Documents, but not limited to, all labor, equipment, materials, dumpsters, shoring, layout, sawcutting, breaking, removal, demolition, disposal, haul-off, barricades, protection, concrete, utility and MEP make-safe coordination, and temporary protection, for the safe, fully and complete Selective Demolition scope of work. The items and descriptions of Work are particularly included and are not intended to limit the Trade Contractor's Work but to clarify or emphasize the Work. 4 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 2. Provide all, but not limit to, demolition of all slab-on-grades, foundations, continuous footings, spread footings, grade beams, building curbs, trellis patio structures, porte cochere, east main lobby prefunction, storage buildings, concrete walls, trench drains, rebar, masonry footings, masonry walls, steel angles, pipe bollards, bollards footings, channels, stairs railings, guardrail, ships ladder and frame, loading dock angles, loading dock slab, dock levelers and controllers, loading dock bumpers, columns, beams, angles, bracing, tube steel, metal deck, wood, roofing, roof ballast, framing, exterior and interior walls, framing and partitions, ElFS, drywall, sheetmetal, louvers, parapets, millwork, door frames, doors, thresholds, roll-up door and frame, storefront, glazing, soffits, chases, enclosures, fireproofing, acoustical ceilings, acoustical grids,wall finishes, carpet, carpet pad, wall carpet, ceramic tile, ceramic tile base, finishes, electrical devices and conduit, floor drains, areas drains, inlets, roof drains, overflows and piping, eyewash fixtures, wall expansion joints, ceiling expansion joints, hose bibbs, light fixtures, outlets, switches, and devices and conduits, low-voltage conduits, cables and devices, feeders, panels, sprinklers and associated appurtenances, ductwork and grilles to complete the Selective Demolition scope of work. The items and descriptions of Work are particularly included and are not intended to limit the Trade Contractor's Work but to clarify or emphasize the Work. 3. Provide a Project Superintendent to oversee the overall demolition scope of work, as well as any subcontracted scope of work, and a fully qualified field foreman or foremen. All subcontracted work must provide a fully qualified superintendent or field foremen. 4. Coordinate all MEP and utility sating and demolition with other Trades in and around the areas of demolition and in accordance with the Contract Documents. 5. Provide pedestrian control in and around the areas to be demolished. 6. Provide all layout and engineering for your work from control lines established by others. All survey control, including benchmarks, lines and grades, lost or damaged by this Trade Contractor's operation will be this Trade Contractor's responsibility. 7. Selective Demolition Trade Contractor acknowledges that there are areas which the structure is being demolished and /or retrofitted, and as such, the Selective Demolition Trade Contractor will coordinate with the Structural Steel Trade Contractor, and all other related Trade Contractors. In certain areas, specifically the existing Loading Dock Canopy between H.9 and LA, the will be provided by the Selective Demolition Trade Contractor. However, the demolition of Loading Dock Canopy Steel framing between LA and approximately L.8 will be demolished by the Structural Steel Trade Contractor. Selective Demolition Trade Contractor shall remove the loading dock canopy in this area to the structural steel framing including the removal of EIFS at the north exterior wall at the Loading Dock Canopy tie-in. Provide engineering shoring of Loading Dock Canopy structure immediately east of L.8 prior to demolition and throughout relocation and reconstruction of the column and area of this area. This area of demolition and reconstruction shall be phased. 8. Remove concrete encasement of the column at approximately gridline 34.6 and immediately west of Q.1. Preserve and monitor the structural integrity of the steel column during removal of encasement. The Structural Steel Trade Contractor will demolish the steel column and connection. Provide engineered shoring in this area prior to demolition and throughout relocation and reconstruction of the column and area. Selective Demolition Trade Contractor shall remove ample area of EIFS and framing above to allow removal and relocation of columns in this area. Selective Demolition Trade Contractor shall remove the slab-on-grade area to allow removal and relocation of columns in this area. Concrete and EIFS will be repaired by the respective Trade Contractors. This area of demolition and reconstruction, including slab-on-grade demolition, shall be phased. 5 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO, 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 9. Provide demolition of the east Main Lobby Pre-function, including but not limited to, exterior wall structures, storefront, roofing, roof ballast, interiors, ducts, conduits, light fixtures, exit signs, switches, outlets, conduits, ceiling wires, sprinkler piping and heads, masonry walls, masonry footings, grade beams, footings, drywalls, soffits, framing, doors, frames, ceramic tile, base, carpeting, lobby fountain, roof ballast, lightweight concrete, EIFS exteriors, all exposed drywall after structure is removed, steel columns, tube steel, bracing, metal decking, fireproofing, and concrete slab-on-grades. The prefunction will include the area approximately between Z.5 and AA.5 and gridlines 25.5 and 32.5 and between gridlines W.3 and Z.5 and 32 to 33.5. For clarity of selective demolition work, including complete interior demolition in this area, refer to Contract Documents, including but not limited to, the architectural and structural demolition plans, and A1.0.01. The columns located at Z.5 and 26 and 32 and between will be demolished by the Structural Steel Trade Contractor. Selective Demolition Trade Contractor shall remove existing footings, specifically at gridline Z.5 at 26 and 32, and in between after shoring is in place and accepted. The engineered shoring required, along with the structural rework/demolition of the girder/beams/moment frames and support steel connected to the columns at Z.5 at 26 and 32, and in between, will be provided by the Structural Steel Trade Contractor. Demolition shall remove acoustical ceilings, drywall and EIFS for shoring access locations. Coordinate this work with the Structural Steel Trade Contractor. Furthermore, the structural steel framing being shored and remaining to support the existing structure, including all columns, beams and bracing after demolition work between gridlines Z.5 and AA.5 and gridlines 25.5 and 32.5 and between gridlines W.3 and Z.5 and 32 to 33.5 will be demolished by the Structural Steel Trade Contractor. The Structural Steel Demolition will include engineered shoring to support the structure while existing columns are removed and replaced, as such; the Selective Demolition Trade Contractor shall coordinate its demolition with the shoring operation. Prior to the demolition in these areas, the demolition and sequence must be reviewed onsite with the Architect and/or Engineer, Structural Steel, Selective Demolition and MEP Trade Contractors prior to commencement of work. The demolition of the footings at Z.5 and 26 and 32, and between should be included as a separate move-in. 10. Demolition Contractor recognizes that a portion (L.8 to N.9) of the east portion of the existing loading dock shall remain in use until the new loading dock is constructed and accepted for use. This area will be demolished after the new loading dock is complete and useable. Therefore the construction of the new loading dock is crucial to the schedule, and as such, the new BOH Circulation #408, between the existing loading dock and the new loading dock, must be demolished. The Selective Demolition Trade Contractor therefore will provide demolition and barricades in this area. Selective Demolition shall include all existing construction to allow for new BOH Circulation #408, including but not limited to, exterior framing, EIFS, drywall, masonry, doors and frames, expansion joints, hangers, ships ladder and frame, concrete pads and curbs, and abandoned or"made-safe" electrical conduits, fixtures, switches and outlets, plumbing piping and fixtures, fire protection piping and heads, as required to construct the new BOH Circulation #408. This area includes new work performed by other trades and shall be phased accordingly. This other work involves, but is not limited to, new partitions from slab to underside of deck, underground services, foundations, masonry wall, new door relocation and associated framing and EIFS, emergency eyewash relocation, light fixtures, switches and outlet relocation, infill of mezzanine ships ladder opening, relocation of the electrical MCC and emergency generators, and the relocation of the gas meter and associated piping. Include all demolition of MEP located on demolished walls, ceilings or floors. Selective Demolition shall provide temporary barricades to separate and secure the new BOH Circulation from the existing mechanical room, the existing loading dock from the new BOH Circulation and the new loading dock from the BOH Circulation. These temporary barricades shall be located to allow for the construction to progress without interruption. 6 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 11. Provide protection of existing equipment, including MCC, emergency generator and the gas meter and associated piping and conduit until demolition is complete. 12. Provide 8' masonite sheets at exterior of East Main Lobby Pre-function exterior glass storefront near box office at remaining storefront doors and glass block. 13. Provide 8' masonite sheets at exterior of West Exit Lobby exterior glass storefront, and storefront doors. Masonite shall be cut and applied to fit the glazing, including doors. 14. Provide 8' masonite sheets at the exterior of the Mesquite Meeting Rooms A, B, C & D. 15. Remove, salvage and deliver to Owner all granite countertops. 16. Demolish all kitchen equipment within the northside area of the east Main Lobby Pre-function area. 17. Remove, salvage, and store all carpet tile and wall within areas of demolition areas. This includes, but is not limited to, Oasis#1, Oasis#2, Oasis#4 and Oasis#5. Carpet tile and wall tile shall be ,stored by the Selective Demolition Trade Contractor and will be delivered to Owner's Carpet Trade Contractor after areas are ready for floor finishes 18. Selective Demolition Trade Contractor shall provide demolition of the Oasis #5 meeting room, along with the exterior wall (EIFS), framing, insulation and drywall at the existing Oasis#5 Meeting Room/West Mechanical Mezzanine. Selective Demolition of this area, shall include but not be limited to, the exterior walls, EIFS, Framing, drywall, soffits, acoustical ceilings, acoustical sound wall panels, wall carpeting, carpet tiles, base, ducts, grilles, light fixtures, exit signs, switches, outlets, conduits, ceiling wires, sprinkler piping, masonry walls, masonry footings, grade beams, footings, roll-up doors and frames, door and frames. Including the curb removal for new door at west wall of West Mechanical Mezzanine. The exterior wall demolition cannot commence until Drywall EIFS Trade Contractor has completed support modification for the upper portion of the exterior wall to remain. This exterior wall demolition will be included as a separate move-in from the interior demolition. 19. Demolish all acoustical wall panels within the demolition areas, specifically at Oasis #1, Oasis#2 and Oasis#5. 20. Remove structural steel rigging points, hangers, and framing at Oasis #5 structure to acoustical/drywall ceilings and soffits. 21. Existing exterior HIM doors and frames at perimeter of Oasis #5 will remain until new temporary partitions are in place. 22. Demolish drywall soffits, drywall and framing at Oasis#1 . Coordinate with Drywall/EIFS and MEP Trade Contractors prior to and throughout demolition. 23. Remove EIFS, framing and drywall for access to new columns, and the demolition of existing columns and wall grits along H.9 line at the exterior wall of Oasis#4. Coordinate this work will the Steel and Drywall/EIFS Trade Contractors. 24. Provide demolition of doors at the interior/exterior of Oasis #4 along gridlines at H.9. This work cannot commence until new structure is erected and "dryed" in. This demolition work shall be phased. 25. Remove exterior drywall on existing wall at W.3 between 32.5 and 34 where demolition occurred. 26. Demo existing soffit at Oasis#!1  as required to install new soffit and coffers. 27. Remove loading dock slab-on-grade walls and footings. Loading Dock slab-on-grade ramp will be removed by the Site Demolition and Grading Trade Contractor. 7 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 28. Demolish interior masonry wall, grade beams and footings, generally at gridline Z.5 29. Provide demolition of louvers and steel frames at north wall of mechanical mezzanine exterior wall. Protect openings with fireproofing Visqueen. Remove Visqueen when framing in-fill commences. Note louvers and frames cannot be demolished until after mechanical mezzanine roof intakes have been added. 30. Provide phasing of the existing Loading Dock ramp, slab, walls, columns and canopy will be demolished in a minimum of three (3) separate phases. The first move-in will commence with the demolition of the existing loading dock ramp, wall, footings, columns, and slabs and canopy structure, including structural steel from approximately gridline H.9 to gridline LA. The second move-in will commence with demolition of additional canopy structure in a separate move in conjunction with the Structural Steel Trade Contractor between LA and approximately L.8. Selective Demolition Trade Contractor shall remove the loading dock canopy in this area to the structural steel framing, including removal of fireproofing. The Structural Steel Trade Contractor will remove the structural steel between LA and L.8. Please note shoring of structure will be required during demolition of canopy structure in this area. The third move-in will commence with the demolition of the easterly remaining portion of the loading dock ramp, slab, walls, foundations, and slab-on-grade after the new loading dock is complete and useable. 31. Coordinate site structure demolition with Site Demolition and Grading Trade Contractor. 32. Provide on-site dust control and clean up. Include street sweeper or water trucks, if necessary, to keep the street clean. 33. Provide continuous clean-up of all interior, exterior, or structure demolition areas. 34. Comply with all regulations and laws applicable to handling and disposing of any demolished material. 35. Protect existing gas meter for duration of work until relocation of gas meter and tie-in and switch over. 36. Provide exterior masonry screen wall demolition. Include demolition of EIFS and door frame demolition. 37. Coordinate demolition of doors to be reused with the Door Trade Contractor. 38. Provide demolition for relocation of existing door at the existing mechanical room/new electrical room. Provide demolition of wall framing, EIFS and drywall as required to others to complete the door relocation and wall reconstruction work. 39. Provide barricades to protect the Convention Center pedestrians, employees, conventioneers and other Trade Contractors working near and around the areas of demolition. Provide all safety notification signage within the interior and exterior of the area for notification of ongoing demolition throughout the project. 40. Provide barricades to protect the Convention Center pedestrians, employees, conventioneers and other Trade Contractors working near and around the loading dock during the demolition of the loading dock area. Provide shoring or grading cut back of soil, if required, at location of demoed loading dock walls. 41. Temporary walls note #37, Architectural Sheet, A1.0.01 required to "block-off demolition and reconstruction at Oasis #1, Oasis #2, Oasis #4 & Oasis #5 will be provided by the Drywall/EIFS Trade Contractor. 8 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE 11 CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 1 SELECTIVE DEMOLITION February 6, 2004 42. All complete demolition, including "high" work shall take into consideration the safety of all workers, pedestrians, employees, conventioneers, and with no impact to the existing structures, facilities and systems. 43. Provide PM-10 plans for the exterior and site structure demolition as required by City of Palm Springs and SQAQMD during the Selective Demolition work. Coordinate PM-10 plan with PM-10 to be provided by Site Demolition and Grading Trade Contractor. 44. If dance floor scaffolding is provided for demolition of high ceiling areas of demolition. Engineered scaffolding to accommodate demo and material handling loads. Provide loading and unloading zones. Provide one time scaffolding training session by licensed and certified scaffolding company, on proper OSHA usage of scaffolding for all Trade Contractors required to work concurrent with the demolition and utilize the dance floor scaffolding. 45. If lifts are used for high demolition work, they shall be protected with barricades so that falling debris cannot"bounce" and strike the lift being operated. 46. Provide all temporary utilities as listed under the Construct Documents, Bid Package 1, Exhibit "F", dated February 6, 2004. 47. Demolition of east Main Lobby Pre-function will not commence until after temporary partitions are installed and utilities & MEP that are routed through the demolition areas are re-routed and service is re-established. 48. Existing storefront and storefront doors at south end of the existing Oasis/Palm Corridor will remain until new structure west of gridline line M.3 is erected, tied-in and closed in. 49. Provide coordination of demolition of existing E.I.F.S. and exterior metal stud framing walls with the Steel and Drywall/EIFS Trade Contractor's. Work will be phased and completed in conjunction with Steel and Framing operations. Demolition of EIFS at locations where new structure attaches to existing, this shall include but not limited to, area of new loading dock canopy, new west registration, new east exhibit hall, new loading canopy structure, new "mesquite corridor" structure, existing loading dock canopy, new kitchen shell and new Ballroom. Demolition of this EIFS system is this Trade Contractor's responsibility. Provide temporary weather protection and maintenance for all exposed wall and roof openings. 50. Provide protection barricades and fall protection, including OSHA approved safety notification signage over all penetrations and openings until permanent construction is in place. 51. Provide fire resistant Visqueen (black-out) at the interior of the existing storefront and doors at existing East Lobby (corridors) outside Springs Meeting Rooms. Plastic shall be cut and applied to fit the glazing, including doors. 52. Provide complete interior demolition at interiors of existing corridors Hallways #1, # 2, #3 & #4. For clarity refer to sheet A1.0.01, note #26. This demolition will also include Lobby area located south of the north public restrooms. 53. Provide demolition of wall located at gridline 32 between U.7 and W.3. Remove and salvage public phones in this area. 54. Provide removal of all furniture in demolished area and deliver to Owner. 55. Demolish all HVAC Equipment, ductwork and piping in areas to be demolished. Coordinate with HVAC Trade Contractor. 56. Demolish all Fire Protection/Sprinkler equipment, devices, risers, piping, fire hose cabinets, and supports, and wiring in areas to be demolished. Fire Protection Trade Contract will responsible for the fire protection/sprinkler utility safing and reconstruction in certain areas. Mock-Ups—As noted in the Contract Documents, including but limited to, the following: 1. None I. Schedule 1. All Work is to be performed in accordance with the Master Project Construction Schedule, Exhibit B, dated 216/04. A detailed schedule will be required from all Trade Contractors within 10 days from award of Contract, and will be review for compliance with the Master Project Construction schedule's intent. Trade Contractor's will acknowledge that the Master Project Construction Schedule will include "multiple move-ins', "out of sequence," and "phasing" of the work. 2. Trade Contractor shall be responsible for the cost of all overtime, shift time differentials, off hour work and other premium time costs required to "expedite" or "make-up" delays to the schedule caused by this Trade Contractor. This includes, but is not limited to, work in excess of eight hours per day, forty hours per week, and/or work on Saturdays, Sundays and Holidays. All off-hour work must be scheduled through the Construction Manager. 3. All "tie-ins" or "shut-downs" and other impacts must be scheduled through Turner at least 72 hours in advance. All related costs, including overtime, phasing and off hour work are included in the Trade Contract price. 4. Whenever an actual or potential labor dispute, involving the Trade Contractor, delays or threatens to delay the timely performance of the work, the Trade Contractor shall promptly give notice thereof in writing to Turner. If as a result of any labor dispute, a special gate is designated by Turner for ingress and egress by the Trade Contractor to the job site, the Trade Contractors and suppliers will comply with the requirement to use only the designated gate. Special badging may be required as long as the Trade Contractor is restricted to the reserved gate. 5. A detailed schedule of this trades' work, including submittals/shop drawings, material/equipment fabrication, delivery, installation, start-up/testing/commissioning and closeout, will be provided with ten (10) days of award of contract. 7. Punchlist items are to be completed within 10 days of the punchlist issuance.
