Effective December 14, 2007, no person shall be eligible to serve or continue to serve as a member of the Palm Springs International Airport Commission who has served as a member of the airport land use commission for Riverside County or any airport board or commission within Riverside, Imperial, San Diego, or San Bernardino counties within the twelve month period, immediately preceding service as a member of the Palm Springs International Airport Commission. The Board of Supervisor's appointed representative, Larry Spicer, currently serves on the Jacqueline Cochran Regional Airport Authority; and as such, is no longer eligible to serve on the Palm Springs International Airport Commission, Section 3 of Ordinance No. 1724 provides that the City Clerk notify the appointing authority of such, post and advertise the vacancy pursuant to the Palm Springs City Charter. A Notice of Vacancy was prepared and processed today. The Board of Supervisors may nominate another representative to the Palm Springs International Airport Commission, and submit their nomination and background information to my attention, for ratification and appointment by the Palm Springs City Council. ITEM NO. �� City Council Staff Report October 17, 2007-- Page 2 Airport Commission Membership The proposed ordinance modifies the appointment process so that each of the Coachella Valley cities and the County of Riverside would nominate at least two- candidates for appointment and the Palm Springs City Council would make the final appointment from the list of nominees proposed by the cities and the county. This provision would be applied to vacancies or term expiration that occur after the ordinance becomes effective. While reviewing the current provisions staff noticed inconsistencies with a City Charter provision, Section 602, adopted by the Palm Springs voters in 2002- In 2002, Palm Springs voters amended the Charter to provide that all Commission and Board Members serve at the pleasure of the City Council and shall be subject to removal by the City Council with at least three (3) affirmative votes. Palm Springs Municipal Code Section 2.06.010(f) currently provides that the City Council may only remove a Commission or Board Member when the City Council is the appointing authority. This is in direct conflict with the Charter provision, and the proposed ordinance eliminates the inconsistency. Additionally, the proposed ordinance eliminates any potential conflict or the appearance of a conflict, including potential allegations of incompatible offices that could exist between certain offices. The ordinance imposes an additional restriction on the members of the International Airport Commission by prohibiting service if a member serves on the County of Riverside airport land use commission or airport board or commission for another airport within Riverside, Imperial, San Diego, or San Bernardino counties, and disqualifies any member if the member has served on such a board or commission during the previous 12-month period. CODE, RELATING TO THE MEMBERSHIP OF THE PALM SPRINGS INTERNATIONAL AIRPORT COMMISSION. The City Council of the City of Palm Springs ordains: SECTION 1. Subsection (f) of Section 2,06,010 of the Palm Springs Municipal Code is amended to read: (f) Any member may be removed from office at any time, with or without cause, by a majority vote of the members of the city council. If a member is absent without advance permission of the board or commission or of the member's appointing authority, from three consecutive regular meetings or from twenty-five percent of the duly scheduled meetings of the board or commission within any fiscal year, the chair of the board or commission shall file a certification with the City Clerk that such absences have occurred, and the member's office shall thereupon automatically become vacant and shall be filled as any other vacancy. SECTION 2. Section 2.16.020 of the Palm Springs Municipal Code is amended to read: 2.16.020 Membership—Creation. (a) There is created in the city an international airport commission, which shall consist of nineteen members. The nineteen members shall be appointed in the following manner: ten members, appointed in accordance with Section 2.04.060 of the Palm Springs Municipal Code; eight members, one appointed by the Palm Springs City Council from a list of at least two candidates nominated by each of the city councils of Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, and Rancho Mirage, and the board of supervisors of Riverside County- (b) No member of the international airport commission shall serve, as a member of the airport land use commission for Riverside County or any airport board or commission for another airport within Riverside, Imperial, San Diego, or San Bernardino counties while serving as a member of the international airport commission, created pursuant to the provisions of this section. No person shall be eligible to serve or continue to serve as a member of the international airport commission who has served as a member of the airport land use commission for Riverside County or any airport board or commission for another airport within Riverside, Imperial, San Diego, or San Bernardino counties within the twelve month period immediately preceding service as a member of the international airport commission. The City Clerk shall notify the appointing or nominating authority of any commissioner who is no longer eligible to serve and advertise and post the vacancy pursuant to City Charter Section 602. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
