STAFF ANALYSIS:
The City's M-1 Service / Manufacturing Zone is an area that is intended to
provide for the development of industrial uses which include fabrication, manufacturing,
assembly or processing which do not in their maintenance, assembly, manufacture or
plant operation create by-products to any degree which will adversely affect the resort-
open space environment of the city. The City's C-2 General Business Zone is an area
that is intended to accommodate general commercial business activities.
Over the last several months, staff has observed a troubling trend: The
Greyhound bus station has discontinued its long-established operation at a site in the
downtown area, and has sought to relocate to several sites within the City, including
some in the M-1 Service / Manufacturing Zone. Within the M-1 Zone and the C-2 Zone,
transportation terminals (including bus stations) are permitted by right. Staff believes
that there are locations in the M-1 and C-2 Zones where transportation terminals may
be inappropriate, based on several issues: On-site circulation; off-site parking and
circulation; noise due to proximity to residential and other issues; and the adequacy of
on-site facilities for customer waiting, ancillary customer services and potential vehicular
services. It is a concern of the City that such primary and secondary effects of
transportation terminals may go unmitigated by allowing the use to be established as of
right in the M-1 or C-2 Zones.
In order to ensure the viability and vibrancy of M-1 Service / Manufacturing Zone
and the C-2 General Business Zone and properties within and adjacent to these zones,
staff is recommending that an interim urgency ordinance be adopted that would
essentially prohibit the establishment of transportation terminals, including bus stations,
until a revision to the Zoning Code can be adopted. (This prohibition would not be
applicable to Transportation Terminals proposed in the M-1-P Zone and the CC Zone
since these uses are permitted subject to a conditional use permit in these zones.)
Staff is also proposing that the City's Zoning Code be amended to specifically
require a conditional use permit for any new Transportation Terminal that sought to
establish itself in the M-1 or C-2 Zone.
The proposed interim urgency ordinance would be in effect for an initial period of
45 days. A draft ordinance to establish revised regulations is also being presented for
Council consideration and direction. A report will be submitted to the Council before the

expiration of the interim ordinance and the Council can consider whether the interim
ordinance should be extended.
FISCAL IMPACT:
There should be no fiscal impact on the City except to the extent the review of the City's
code and preparation of an adequate report for Council consideration will affect current
staff workloads.

The City Council of the City of Palm Springs ordains:
SECTION 1. This Interim Urgency Ordinance is adopted pursuant to Section
65858 of the California Government Code and pursuant to the City's authority over
matters of local concern as a charter city.
SECTION 2. For the period of this Ordinance, or any extension thereof, a
transportation terminal shall be considered a prohibited use in any zoning district of the
City, except in the M-1-P Zone where "transportation terminals" are permitted subject to
a conditional use permit and in the CC Zone where "transportation facilities for loading,
unloading, and transferring passengers, baggage, and incidental freight between modes
of transportation" are permitted subject to a conditional use permit. The provisions of
Palm Springs Municipal Code Sections 92.14.01-A-10 and 92.17.01-A-20 are
suspended during the period of this Ordinance or any extension thereof and shall have
no force or effect or confer any rights, privileges, or benefits thereof on any owner or
lessee of property affected.
SECTION 3. The City of Palm Springs shall not issue or approve any general plan
amendment, specific plan, zone change, building permit, conditional use permit,
variance, precise plan of design, license, or other land use entitlement for the use of any
property or a portion thereof as a transportation terminal.
SECTION 4. The City Council hereby finds, determines, and declares that this
Interim Urgency Ordinance is necessary. The City's M-1 (Service / Manufacturing)
Zone is intended to provide for the development of industrial uses, including fabrication,
manufacturing, assembly or processing which do not create or generate by-products
which will adversely affect the resort-open space environment of the city.
Transportation terminals, which includes bus stations, are permitted by right in the M-1
Zone. The City's C-2 (General Commercial) Zone provides for general commercial
business uses. There are locations within the City were the property is zoned MA or C
2 where transportation terminals may be inappropriate due to the impacts on on-site
circulation, off-site parking and circulation, noise due to proximity to residential and
other issues, and the adequacy of on-site facilities for customer waiting, ancillary
customer services, and potential vehicular services. The city Council is concerned that
these primary and secondary effects of transportation terminals may go unmitigated by
allowing the use to be established as of right in the M-1 or C-2 Zone. Such a result
would be harmful to the public welfare.
SECTION 5. Ten days prior to the expiration of this Interim Urgency Ordinance, or
an extension thereof, the City Council shall issue a written report describing the

measures which the City has taken to address the conditions which led to the adoption
of this Ordinance.
SECTION 6. This Interim Urgency Ordinance shall take effect immediately upon
its adoption by a four-fifths (4/5) vote of the City Council. This Interim Urgency
Ordinance shall continue in effect for forty-five (45) days from the date of its adoption
and shall thereafter be of no further force and effect unless, after notice pursuant to
California Government Code Section 65090 and a public hearing, the City Council
extends this Interim Urgency Ordinance for an additional period of time pursuant to
California Government Code Section 65858.
SECTION 7. If any section, subsection, subdivision, paragraph, sentence, clause
or phrase in this Ordinance or any part thereof is for any reason, held to be
unconstitutional or invalid, or ineffective by any court of competent jurisdiction such
decision shall not affect the validity of effectiveness of the remaining portions of this
Ordinance or any part thereof. The City Council hereby declares that it would have
passed this Ordinance and each section, subsection, subdivision, sentence, clause and
phrase thereof, irrespective of the fact that any one or more sections, subsections,
subdivisions, sentences, clauses or phrases be declared unconstitutional.

City Attorney's Summary
The Palm Springs Municipal Code does include a definition
of "Transportation Terminals,"a use that is permitted in the
C-2 and M-1 Zones. This Ordinance will add a definition of
`Transportation Terminals" and allow such use in the C-2
and M-1 Zones subject to a conditional use permit.
The City Council of the City of Palm Springs ordains:
SECTION 1. The following definition of the term "Transportation Terminals" is
added to Section 91.00,00 of the Palm Springs Municipal Code:
"Transportation Terminals" means facilities for loading, unloading, and
transferring passengers, baggage, and incidental freight between modes of
transportation. This classification includes but is not limited to bus terminals and
public transit stations.
SECTION 2. Subsection D of Section 92.14.01 is amended by adding
"Transportation Terminals" as a use permitted subject to a conditional use permit
in the CC Zone.
SECTION 3. Subsection D of Section 92.17.01 is amended by adding
"Transportation Terminals" as a use permitted subject to a conditional use permit
in the M-1 Zone.
SECTION 4. Paragraph 20 of Subsection A of Section 92.14.01 is repealed.
SECTION 5. Paragraph 10 of Subsection A of Section 92.17.01 is repealed.
SECTION 6. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary

RE; URGENCY ORDINANCE for Proposed Greyhound Bus Stop on San Rafael Road
Dear Mayor Odin and City Council Members,
We respectfully request you pass an Urgency Ordinance to postpone the proposed installation of
a Greyhound Bus stop at 410 San Rafael Road to allow the City adequate time to review the
feasibility and sound judgment behind this matter.
As owners of the 6.5 acre parcel (future site of Desert Palms Indus. Lofts; Project#3.2826) we
are extremely concerned about the proposed installation of a bus stop in front of the Mama Ole's
"restaurant" for several critical reasons,
1. Mama Ole's is a known locale for illegal activity, includinp drug sales and prostitution. We
have witnessed drug transactions as recently as October 6' . This chronic illegal activity is
documented by the PS Police Dept.
2, Installing a bus stop at the subject location will invite more transients to the area-who will
have no access to local transport, food or lodging -thereby inviting more vagrancy, litter and
illegal activity. There are no hotels, motels, taxi stands, public phones, nor restaurants to serve
the people (pedestrians!) who arrive and/or depart by Greyhound bus.
Logic dictates that a bus stop be installed in the center of the City-where such services are
readily accessible. A bus stop on E San Rafael Road does not serve the residents or business
owners of the community— nor the bus passengers.
3.We have partnered diligently with the City of Palm Springs for several years in the
development of our property, which will contribute substantially to the revitalization of this
neighborhood. Installing a bus stop next to our property will seriously impact our ability to sell
units and threaten the safety of those who purchase the units and work there.
Diesel fumes, the noise of idling busses, vagrancy, a lack of facilities to accommodate bus
travelers will all profoundly negatively impact our project and its fiscal viability.
Who will be liable for the actions of the bus travelers—the City or the private owner on whose
property the bus stop is located?
In speaking with neighboring homeowners and businesses the consensus is everyone (except
Mama Ole's) is strongly opposed to this matter and will be joining us in seeking a sane resolution.
In fact, the community is holding a meeting Saturday, October 13 to strategize on the matter.
We sincerely appreciate your taking this matter under consideration by adding it to agenda for
the October 17t City Council meeting and inviting those who will be most impacted by it to
provide public opinion to the Council.

provide for the development of industrial uses, including fabrication, manufacturing,
assembly or processing which do not create or generate by-products which will
adversely affect the resort-open space environment of the city. Transportation
terminals, which includes bus stations, are permitted by right in the M-1 Zone. The
City's C-2 (General Commercial) Zone provides for general commercial business uses.
There are locations within the City were the property is zoned M-1 or C-2 where
transportation terminals may be inappropriate due to the impacts on on-site circulation,
off-site parking and circulation, noise due to proximity to residential and other issues,
and the adequacy of on-site facilities for customer waiting, ancillary customer services,
and potential vehicular services. The city Council is concerned that these primary and
secondary effects of transportation terminals may go unmitigated by allowing the use to
be established as of right in the M-1 or C-2 Zone. Such a result would be harmful to the
public welfare.
Ten days prior to the expiration of this Interim Urgency Ordinance, or an extension
thereof, the City Council shall issue a written report describing the measures which the
City has taken to address the conditions which led to the adoption of this Ordinance.

This Interim Urgency Ordinance shall take effect immediately upon its adoption by a
four-fifths (4/5) vote of the City Council. This Interim Urgency Ordinance shall continue
in effect for forty-five (45) days from the date of its adoption and shall thereafter be of no
further force and effect unless, after notice pursuant to California Government Code
Section 65090 and a public hearing, the City Council extends this Interim Urgency
Ordinance for an additional period of time pursuant to California Government Code
Section 65858.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this
Ordinance or any part thereof is for any reason, held to be unconstitutional or invalid, or
ineffective by any court of competent jurisdiction such decision shall not affect the
validity of effectiveness of the remaining portions of this Ordinance or any part thereof.
The City Council hereby declares that it would have passed this Ordinance and each
section, subsection, subdivision, sentence, clause and phrase thereof, irrespective of
the fact that any one or more sections, subsections, subdivisions, sentences, clauses or
phrases be declared unconstitutional.
