AMBULANCE SERVICES IN THE SERVICE/MANUFACTURING ZONE, CITYWIDE.
RECOMMENDATIONS
That the City Council order the filing of a Negative Declaration and approve amendments to
Sections 92.23.00 and 92.17.00 of the Zoning Ordinance so as to: a) allow transportation
facilities as a conditional use in the civic center zone and b) modify the requirements for location
of ambulance services in the service/manufacturing zone, citywide.
SUMMARY
The Planning Commission reviewed the proposed amendments at their meeting on April 14,
2004 and voted 5-0 (2 absent) to approve the zoning text amendments to Sections 92.23.00
and 92.17.00.
BACKGROUND
Section 92.23.00 Civic Center Zone is intended for the civic center district to accommodate
governmental uses, facilities, services and incidental uses necessary to support government
facilities. The CC Zone encompasses an area of the City that is approximately '/4 mile north and
south of Tahquitz Canyon Way between El Cielo Road and Civic Drive. The proposed zoning
text amendment is to allow transportation facilities as a conditional use. "Transportation
facilities" are defined as facilities for loading, unloading, and transferring passengers, baggage,
and incidental freight between modes of transportation. Included in the classification are bus
terminals and public transit stations. The proposed amendment may facilitate the re-location of
an inter-city bus company or other transportation service to the boxing club building located at
the northwest corner of El Cielo Road and Arenas Road.
Section 92.17.00 Service/Manufacturing Zone is intended to allow orderly development within
the City's M-1 zones and provide for the development of service industries for commercial and
hotel uses and for industrial uses. The M-1 zone is predominantly located in the area southeast
of the Palm Springs Airport runway and the area north of San Rafael Drive, west of North Indian
Canyon Drive. The proposed amendment to the M-1 zone is intended to allow flexibility in the
location of ambulance services. Currently, ambulance services are only permitted on secondary
or major thoroughfares, as indicated on the general plan, in the M-1 zone. The amendment
proposes to replace that requirement with a new standard that ambulance services be located a
minimum of 500 feet from residentially zoned property.

ANALYSIS
The amendments to the Civic Center zone will facilitate the consolidation of transportation
services around the airport and government uses. The amendment to the
Service/Manufacturing zone will allow flexibility in locating ambulance services such that they
will have an appropriate buffer to residentially zoned property without restricting their location to
only major or secondary thoroughfares.
ENVIRONMENTAL ASSESSMENT AND NOTIFICATION
The City of Palm Springs, in its capacity as the lead agency for this project, under the California
Environmental Quality Act (CEQA) evaluated the potential environmental impacts of the project
through the preparation of an Initial Study for Case No. 5.1000. The City of Palm Springs has
determined that the Zoning Ordinance text amendments pertaining to Section 92.23.00 CC
Zone and Section 92.17.00 M-1 Zone will not have a significant impact on the environment and
a Negative Declaration has been prepared. The Initial Study meets the requirements of the
State of California CEQA, the State CEQA Guidelines, and the City of Palm Springs' Guidelines
for the implementation of CEQA. A Notice of Intent to adopt a Negative Declaration was
published in accordance with State Law with the review period ending on April 13, 2004.
As the proposed Zoning Ordinance amendments are citywide, the number of property owners to
be noticed exceeds 1,000. Pursuant to California Government Code Section 65091, a 1/8 page
advertisement for the proposed amendments was placed in the Desert Sun. In addition, the
Negative Declaration was circulated to local agencies and interested parties for their review.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold a public hearing at its
meeting of May 5, 2004. The City Council meeting begins at 7:00 p.m. in the Council Chamber at City Hall, 3200 East
Tahquitz Canyon Way, Palm Springs,
The purpose of the Hearing is to consider Case No. 5,1000 ZTA, a request initiated by the City of Palm Springs to: A)
Amend the City's Zoning Cade, Chapter 92.00, Section 92.23.00 ("CC" civic center district zone), to allow transportation
facilities as a conditional use in the civic center district zone and B) Amend the City's Zoning Code, Chapter 92.00,
Section 92.17.00("M-1"servicelmanufacturing zone),to modify the requirements for location of ambulance services in the
service/manufacturing zone, citywide. The following is a brief summary of each request:
A)The zoning text amendment for Section 92.23.00 is intended to allow transportation facilities to be permitted in the civic
center district zone ("CC") with a conditional use permit. Transportation facilities are defined as facilities for loading,
unloading,and transferring passengers, baggage, and incidental freight between modes of transportation. Included in this
classification are bus terminals and public transit stations. This zoning text amendment could potentially facilitate the
relocation of the Greyhound bus terminal to the existing building (boxing club building)located at the northwest corner of
El Cielo Road and Arenas Road (225 S. El Cielo Road). The civic center district zone encompasses approximately 32
acres a quarter mile north and south of Tahquitz Canyon Way between Civic Drive and El Cielo Drive.
B) Modifications are proposed to Section 92.17.00 ("M-1" servicelmanufacturing zone) to delete the requirement that
ambulance services be located on a major or secondary thoroughfare. Ambulance services are a conditionally permitted
use in the M-1 zone. The deleted language would be replaced with a new requirement that ambulance services be
located a minimum of 500 feet from residentially zoned property.
The City of Palm Springs, in its capacity as the lead agency for this project, under the California Environmental Quality Act
(CEQA) evaluated the potential environmental Impacts of the project. Pursuant to Section 15063 of CEQA, an Initial
Study has been prepared for Cases Nos. 5.1000A and B. Through the preparation of the Initial Study for Case Nos.
5.0995A and B, the City of Palm Springs has determined that the Zoning Ordinance text amendments pertaining to the
civic center district zone and the service/manufacturing zone could not have a significant impact on the environment.
Therefore, a Negative Declaration has been prepared for the subject proposals, which will be reviewed by the Planning
Commission at the public hearing. The Initial Study meets the requirements of the State of California CEQA, the State
CEQA Guidelines, and the City of Palm Springs'Guidelines for the implementation of CEQA. Members of the public may
view this document, Monday to Friday 8 a.m. to 5 p.m., in the Department of Planning and Zoning, City Hall, 3200 E.
Tahquitz Canyon Way, Palm Springs, and submit written comments to the City Clerk at or prior to the City Council
hearing.
If any group challenges the action in court, issues raised may be limited to only City Council hearing. An opportunity will

SECTION 92.23.00 CIVIC CENTER DISTRICT ZONE
LEGISLATIVE DRAFT
92.23.00 "CC"civic center district zone
The CC district is intended for the civic center district to accommodate governmental uses, facilities, services
and incidental uses necessary to support governmental facilities. (Ord. 1294(part), 1988)
92.23.01 Uses permitted.
A. Uses Permitted.
1. Accessory structures and uses customarily incident to die above uses and located on the same lot therewith;
2. Governmental facilities;
3. Museums and cultural uses;
4. Nonprofit uses;
5. Public parking areas,not as an accessory to uses permitted in this zone pursuant to Section 93.06.001
6. Public parks.
B. Similar Uses Permitted by Commission Determination. The commission may, by resolution of record,
permit any other uses which it may determine to be similar to these listed above and not more obnoxious or
detrimental to the public health, safety and welfare as other uses permitted in the zone as provided for in Section
94.01.00.
C. Uses Permitted by Land Use Permit.
1. Child care center.
D. Uses Permitted by Conditional Use Pennit.
1. Offices;
2. Residential development subject to the standards of the R-3 zone, Section 92.04.00;

92.23.02 Uses prohibited.

92.23.03 Property development standards.
The following property development standards shall apply to all land and buildings in the CC zone, except that
any lot created in compliance with applicable laws and ordinances in effect at the time of its creation may be used as
a building site.

standards in Section 92.17.03.

1. Uses permitted by land use permit in the M-1-P zone, Section 92.16.01(C);
2. Automobile rental agencies;
3. Classic auto sales;
4. Motorcycle rental;
5. Restaurants within mixed-use developments;
6. Thrift shops operated by charitable organizations;
7. Tire recycling(interior)as an accessory to a permitted main auto use;
8. Vehicle impound yards and towing services.
D. Uses Permitted by Conditional Use Permit. The following uses may be permitted subject to approval of a
conditional use permit,as provided in Section 94.02.00.
1. Adult entertainment(Deleted by Ord. 1511);
2. Ambulance services, and accessory uses customarily incident to the permitted use, provided that the site is

3. Animal,hospitals and kennels;
4. Automobile rental agency fleet sales;
5. Automobile service stations;

8. Check cashing facilities; provided, such facility is located no closer than three hundred (300) feet to a
residential zone or to a church or mortuary at the time of their establishment;
9. Chemical plating shop;
10. Drive-in theater;
11. Drive-through and drive-in facilities;
12. Heavy equipment storage and rental;
13. Junk yards and into wrecking yards;
14. Manufacturing, processing, fabrication, and service uses, wholesaling and warehousing other than of uses
as listed above in Section 92.17.01(A), subject to the property development standards and performance standards in
Section 92.17.03 with such modifications as the commission and council deem necessary;

16. Nightclubs/cocktail lounges as a primary use; provided that, at the time of their establishment, such

Subject: Notice of Availability of an Initial Study/Environmental Assessment that evaluates Case
5.1000 A and B, various zoning text amendments that address the Architectural Review
Ordinance, Hillside Development Ordinance, and the C-S-C Zone.
The City of Palm Springs has prepared an Initial Study/ Environmental Assessment (IS/EA), which
evaluates Case 5.1000 A and B, various zoning text amendments as follows: A) Request initiated by the
City of Palm Springs to amend the City's Zoning Code, Chapter 92.00, Section 92.23.00 ("CC" civic
center district zone), to allow transportation facilities as a conditional use in the civic center district zone
and B) Request by the City of Palm Springs to amend the City's Zoning Code, Chapter 92.00, Section
92.17.00 ("M-1" service/manufacturing zone), to modify the requirements for location of ambulance
services in the service/manufacturing zone, citywide.
The City has authorized the release of the IS/EA for public review and comment for the project
summarized above. A copy of the IS/EA and related processing materials can be reviewed or obtained
from City at the address above. The period of review and comment will be from March 24, 2004 to April
13, 2004. Written comments on the IS/EA should be submitted to Jing Yeo, Principal Planner, City of
Palm Springs, at the above address no later than April 13, 2004.
The Planning Commission will review the proposed project at its meeting on April 14, 2004. At that
meeting the Planning Commission may recommend that the City Council adopt a negative declaration at

The zoning text amendment for Section 92.23.00 is intended to allow transportation facilities to

If the zoning text amendment is approved, the City may enter into a lease with Greyhound for
the boxing club building located at 225 S. El Cielo Road. In addition, the Redevelopment
Agency anticipates reimbursing the City, through a reimbursement agreement, for some costs
related to tenant improvements for the boxing club building.
The zoning text amendment for Section 92.17.00, "M-l" service/manufacturing zone, is to
delete the criteria for ambulance services to be located on major or secondary thoroughfares.
Ambulance services are conditionally permitted in the M-1 Zone. The deleted language will be
replaced with a requirement that there be a 500 hundred foot setback from ambulance services to
residentially zone land.

3.a-e) NO IMPACT. The applicable air quality plan for the project area is the 2003 Air Quality
Management Plan (2003 AQMP). CEQA requires that projects be consistent with the applicable
AQMP. Any proposed development resulting from the zoning text amendments will conform to the
SCAQMD 2003 AQMP. The SCAQMD CEQA Air Quality Handbook indicates in Chapter 6 that the
SCAQMD considers a project to be less than significant if its impact is mitigated below the identified
thresholds. Additionally,the project site is located in the Coachella Valley, which is under the recently
adopted 2002 Coachella Valley PMto State hnplementation Plan. The CVPMteSIP requires the

concentrations and/or objectionable odors.

SO AS TO MODIFY THE REQUIREMENTS FOR LOCATION OF
AMBULANCE SERVICES IN THE SERVICE/MANUFACTURING
ZONE, CITYWIDE.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 92.23.00 is amended to read as follows:
92.23.00 "CC"civic center district zone
The CC district is intended for the civic center district to accommodate governmental uses, facilities, services and
incidental uses necessary to support governmental facilities. (Ord. 1294 (part), 1988)
92.23.01 Uses permitted.
A. Uses Permitted.
1. Accessory structures and uses customarily incident to the above uses and located on the same lot
therewith;
2. Governmental facilities;
3. Museums and cultural uses;
4. Nonprofit uses;
5. Public parking areas,not as an accessory to uses permitted in this zone pursuant to Section 93.06.001
6. Public parks.
B. Similar Uses Permitted by Commission Determination. The commission may, by resolution of record,
permit any other uses which it may determme to be similar to these listed above and not more obnoxious or
detrimental to the public health, safety mid welfare as other uses permitted in the zone as provided for in Section
94.01.00.
C. Uses Permitted by Land Use Permit.
1. Child care center.
D. Uses Permitted by Conditional Use Permit.
1. Offices;
2. Residential development subject to the standards of the R-3 zone, Section 92.04.00;

SECTION 2. Section 92.17.00 is amended to read as follows:
92.17.00 "M-l"service/manufacturing zone.
A. The "M-l" service/manufacturing zone is intended to provide for the development of service industries
for cormnercial and hotel uses and for industrial uses which include fabrication, manufacturing, assembly or
processing of materials that are in already processed form and which do not in their maintenance, assembly,
mi
manufacture or plant operation create smoke, gas, odor, dust, sound, vibration, soot, glare or lighting to any degree
which might be obnoxious or offensive to persons residing in or conducting business in either this or any other zone.
B. No industrial use shall be permitted which,by the nature of its development or operation, will in any way
adversely affect the resort-residential environment of the city. (Ord. 1294(part), 1988)
92.17.01 Uses permitted.
A. Uses Permitted. Buildings, strictures, and land shall be used and buildings and structures shall hereafter
be erected, altered, or enlarged only for the following uses. All uses shall be subject to the standards in Section

B. Similar Uses Permitted by Commission Determination. The commission may, by resolution of record,
permit any other uses which it may determine to be similar to those listed above, in conformity with the intent and
purpose of this zone, and not more obnoxious or detrimental to the public health, safety and welfare, or to other uses
permitted in this zone, as provided in Section 94.01.00. All uses shall be subject to the property development
standards in Section 92.17.03.
C. Uses Permitted by Land Use Permit.
1. Uses permitted by land use permit in the M-1-P zone, Section 92.16.01(C);
2. Automobile rental agencies;
3. Classic auto sales;
4. Motorcycle rental;
5. Restaurants within mixed-use developments;
6. Thrift shops operated by charitable organizations;
7. Tire recycling(interior)as an accessory to a permitted main auto use;
8. Vehicle impound yards and towing services.
D. Uses Permitted by Conditional Use Penult. The following uses may be permitted subject to approval of a
conditional use permit,as provided in Section 94.02.00.
1. Adult entertahmnent(Deleted by Ord. 1511);
2. Ambulance services, and accessory uses customarily incident to the permitted use, provided that the site
is located no closer than five htmdred(500)feet from residentially zoned property;
3. Auimal,hospitals and kennels;
4. Automobile rental agency fleet sales;

6. Bail bond offices; provided, such facility is located no closer than three hundred (300) feet to a
residential zone or to a church or mortuary at the time of their establishment;

8. Check cashing facilities; provided, such facility is located no closer than three hundred (300) feet to a
residential zone or to a church or mortuary at the time of their establishment;
9. Chemical plating shop;
10. Drive-in theater;
11. Drive-through and drive-in facilities;
12. Heavy equipment storage and rental;
13. Junk yards and auto wrecking yards;
14. Manufacturing,processing, fabrication, and service uses,wholesaling and warehousing other than of uses
as listed above in Section 92.17.01(A), subject to the property development standards and performance standards in
Section 92.17.03 with such modifications as the commission and council deem necessary;
15. Micro-brewery;
16. Nightclubs/cocktail lounges as a primary use; provided that, at the time of their establishment, such
facilities are not located closer than three hundred(300)feet to a residential zone or to a church or mortuary;
17. Pawn brokers, provided such facility is located no closer than three hundred (300) feet to a residential
zone or church or to a church or mortuary at the time of their establishment;
18. Planing mill;
19. Recycling/salvage center;
20. Retail uses not otherwise regulated;
21. Truck and general freight terminals;
22. Video/amusement arcades as a primary or secondary use subject to the provisions of Section

SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30)
days after passage.
SECTION 4. PUBLICATION. The City Clerk is hereby ordered to and directed to certify to the
passage of this Ordinance, and to cause the same or summary thereof or a display
advertisement, duly prepared according to law, to be published in accordance with law.
