The City and the Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1- THE WORK The Contractor shall complete the Work as specified or indicated under the Bid Schedule(s) of the City Contract's contract Documents entitled: Palm Springs Phase II Convention Center Expansion Phase II City Project No 02-27-10 The work is generally described as follows: All that Work set forth in the Trade Bid Schedule of the bid Forms, as awarded by the City of Palm Springs, pursuant to the Contract Documents for the City Project No. 02-27- 10. ARTICLE 2-COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced on the date specified the Notice to Proceed by the City and the Work shall be fully completed within the time specified in the Notice to Proceed. The City and the Contractor recognize that time is of the essence of this Agreement and that the City will suffer considerable financial loss if the Work is not completed within the time specified in said Notice to Proceed, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. The damages suffered by the City would be extremely difficult or impractical to determine in the event of a breach by the Contractor. Accordingly the City and the Contractor agree that the Contractor shall pay the amount provided in Exhibit G of the contract documents attached hereto as liquidated damages, for each calendar day that the work is not completed in the time set forth. ARTICLE 3-CONTRACT PRICE ($8,765,000) The City shall pay the contractor for the completion of the Work hereunder in accordance with the Contract Documents in current funds the Contract Price(s) named in the Contractor's Bid and accepted Bid Schedule. ARTICLE 4-THE CONTRACT DOCUMENTS The Contract Documents consist of : notice Inviting Bids, Instructions to Bidders, the accepted Bid and Bid Schedule, the Schedule of Values, Bid Security or Bid Bond, this Agreement Worker's Compensation Certificate, Performance Bond, Multiple Oblige Rider to Performance Bond, Payment Bond, Notice of Award Notice to Proceed, Notice of Completion, General Conditions of the Contract, Supplementary General Conditions of the Contract, the Technical Specifications, Drawings listed in The Schedule of Drawings in the Supplementary General Conditions or in the Index on the Cover of the Drawings, Addenda numbers 1, 2, 3, 2-2, 3-10 inclusive, and all Change Orders, and Work Directive Changes which may be delivered or issued after the Effective Date of the Agreement and are not attached hereto. ARTICLE 5- PAYMENT PROCEDUERES The Contractor shall submit Applications for Payment in accordance with the provisions of the General Conditions and the Supplementary General Conditions of the Contract. Applications for Payment will be processed by the City as provided in the Contract Documents. ARTICLE 6- NOTICES Whenever any provision of the Contract Documents requires the giving of written notice, it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address know to the giver of the Notice. ARTICLE 7- MISCELLANEOUS Terms used in this Agreement which are defined in Article 1 of the General Conditions will have the meanings indicated in said General Conditions and Supplementary General Conditions. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically but without limitation monies that may become due and monies that are due many not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. The City and the Contractor each binds itself, its partners, successors, assigns, and legal representatives to the other party hereto, its partners, successors , assigns, and legal representatives in respect of all covenants, agreements, and obligations contained in the Contract Documents. Scope of Work shall include, but not be limited to,the following Contract Documents: 1. All conditions as set forth in the City's Bid Package 10 Construction Documents, dated February 6, 2004, including the Safety Program dated February 6, 2004 (Exhibit A), Master Construction Schedule for Bidding Information (Exhibit B), dated February 6, 2004, General Liability and Automobile Insurance Limits (Exhibit C), dated February 6, 2004, Document List(Exhibit D), dated February 6, 2004, Construction Manager's Standard Provisions (Exhibit E), dated February 6, 2004, Temporary Utilities for Construction Purposes (Exhibit F), dated February 6, 2004 and Liquidated Damages (Exhibit G), dated February 6, 2004 are to be considered as part of the Work. 2. B. Additional Instructions 1. The Contract Documents do not necessarily indicate or describe all Work required for the full performance of the Structural Steel, Steel Joist, Metal Decking and Misc. Metals Work. Trade Contractor is to provide all items required for the completion of the Work without adjustment to the Price. It is intended that the Trade Contractor shall be solely responsible for the inclusion of adequate amounts to cover all Work indicated, described, or implied, subject to code requirements and the reasonable intent of the Contract Documents. The Trade Contractor acknowledges and represents that they have: a) Visited the site and become familiar with the existing conditions, improvements and the overall physical condition of the site. b) Examined and fully understand the Contract Documents and all other exhibits, attachments, engineering reports, soils reports, special studies, and existing conditions to the extent necessary to perform the Work. The drawings, specifications, and other information listed as Contract Documents indicate the general scope of Work, and do not necessarily indicate or describe everything required for the full performance and completion of the Work. Trade Contractor shall be solely responsible for completing the Work in accordance with code requirements and the reasonable intent of the Contract Documents. c) Had an opportunity to request changes, clarifications and interpretations of errors, ambiguities, omissions and other matters which Trade Contractor has become aware of contained in the Contract Documents and Exhibits. d) Determined all procedures, techniques, phasing, sequencing, and schedules necessary or appropriate to complete the Work. e) Examined and fully understands Safety Manual and its rules, regulations and guidelines. 2. Trade Contractor acknowledges that they will be working in an existing, fully functional Convention Center facility, and the work may include working within public right-of ways. As such, Trade Contractor will allow for the Owner's needs for security, delivery and cleanliness and will perform the Trade Contractor's Work without disruption of the facility or its systems and operations. The level of quality, detail, coordination, scheduling, phasing, sequencing, construction activities and aesthetics is expected to exceed normal industry standards. 4. Trade Contractor fully understands that the existing Convention Center will remain open for business and will be fully operational. This Contractor further acknowledges that occasionally the progress of the work will be impeded as a result of operating the existing facility. Any demobilization, remobilization, or any other associated costs related to this type of delay is not reimbursable. 5. Contractor to provide all drinking water containers, ice, cups, trash receptacles, etc. as necessary for Contractor's employees. 6. Trade Contactor acknowledges that Turner is the Construction Manager and as such has no field forces or material handling capability to assist Trade Contractor. 7. On the basis of the above and further examinations, investigations and studies which the Trade Contractor has made in connection with the Work, Trade Contractor represents and agrees that the Contract Documents and Exhibits are accurate to the best of the Trade Contractor's knowledge and that the Work can be performed in strict accordance with the terms of their Agreement with the City. C. Scope Of Work General Scope: 1. Provide all Structural Steel, Steel Joist, Metal Decking and Misc. Metals Work as required by the Contract Documents. The following items and descriptions of Work are particularly included and are not intended to limit the Trade Contractor's Work but to clarify or emphasize the Work. 2. All items listed under scope of work that are not specifically shown in the Contract Documents, or are necessary to perform this Work to completion, must be included by this Trade Contractor. 3. This Work includes, but is not limited to, all the Work specified in Section(s) This Work includes, but is not limited to, all the Work specified in Section(s) 01732, 01735, 05120, 05210, 05300, 05400, 05500 and 05700 of the Specifications. 4. The word "provide"when used herein shall mean Provide completely, including all costs for labor, material, equipment, travel, hoisting, scaffolding, tools, rigging and any other facilities necessary to complete the Work. 5. The word "remove"when used shall mean remove and dispose, unless otherwise noted 6. All required fees, sales taxes, haul route permits, freight or other ancillary charges associated with the performance of this Work are included. METALS February 6, 2004 8. Provide the complete Selective Demolition of the structural steel work to meet all the criteria of the Contract Documents, Exhibits, and all governing agencies. Selective Demolition must be coordinated with the Selective Demolition Trade Contractor and other Trade Contractors to ensure the areas before, during and after demolition are safe for work to continue. Coordinate all Area, Utility, Service and Equipment shutdowns with Turner, and other Trade Contractors. 9. Trade Contractor shall be responsible for providing Protection of adjacent surfaces. Sanitary protection of all loads or items being transported through or around the Existing Building of the Convention Center Facility, 10. Parking will be included in areas designated by the Project Superintendent at the City's discretion. 11. Remove general debris and leave Work area broom clean on a daily basis. Trade Contractor shall deposit all debris in trash bins. 12. Food & beverages will be allowed in designated areas only. The designated area will be located outside of existing and new building areas, and may be located offsite. Designated areas will be determined by Turner Construction Company. 13. A City Business License must be obtained within 10 business days after the start of the project. 14. Move-ins: As required to meet the schedule and performance of the Structural Steel, Steel Joist, Metal Decking and Misc. Metals portion of work. 15. The Working hours for the project will be 7:00 a.m. —3:30 p.m, daily. All off-hour work, deliveries must be scheduled through the Construction Manager. 16. Provide, install and coordinate all hoisting, rigging, scaffolding, fall protection and temporary bracing necessary for the safe execution of your Work required by OSHA and the City's Safety Program, which ever is most stringent will apply. 17. Work to be performed in areas: All Work areas shown or on Contract Documents. 18. Trade Contractor is responsible for performing an existing damage survey in areas of Trade Contractors Work in existing areas within five (5) days prior to beginning work. In addition, submit a typed list to Turner Construction Company on your Company's letterhead with the pertinent Company Representative certifying all damage noted is true and the list is complete. Any items not listed by the Trade Contractor's will be the responsibility of the Trade Contractor to correct to the satisfaction of Turner Construction Company and the Owner. Survey should encompass all areas within or around the limits of the demolition and construction. 19. Include traffic control, flagmen and staging for all activities, vehicles and equipment related to your work including deliveries. 20. Delivery of materials and equipment shall be scheduled and coordinated with Turner. 21. Provide travel expenses, including airfare, hotel, car rental for Turner's staff to conduct Trade contractor's fabrication plant during fabrication of the steel. A total of two (2) persons for two (2) days traveling during each visit. Include two (3) such trips during fabrication. 22. Provide layout/verification as required for the work unless noted otherwise. Reference lines and grades only will be provided City's surveying. Provide any required grade/elevation surveys. 3 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 23. All excavations shall be shored and braced as required. Loadings from existing structures and utilities and services shall be accounted in the shoring and bracing requirements. Engineered plans for shoring and bracing shall be provided if required. Provide required access/egress/ventilation into all trenches, excavations or confined spaces for all workers and governing agency inspections. 24. All required utility and systems shut-downs, or all area closures are to be scheduled and coordinated in advance with all agencies having jurisdiction of the work, including, but not limited to, the City, Building Department, Engineering, Public Works, Fire Department, Verizon, SCE, Gas Company, DWA, Fire Alarm Monitoring, Building Management Systems, Security and other agencies having jurisdiction, and with the Convention Center through Turner. Perform shut- downs and closures related work on off-hours, or approved schedule time frame as not to disruption of the facility or its systems and operations, as required. Provide 72 hour notification for any scheduled shut down. 25. Storage space on site is extremely limited. Use, placement and size of Trade Contractor jobsite office trailers and storage bins shall be reviewed and approved by Turner, and may not be allowed. Storage area will be located at the 5 Acre East Lot located at the Southeast corner of Avenida Caballeros and Amado Road, as noted in the Proposed Site Logistics plan, dated February 6, 2004. Limited Office Trailer space is available to the Trades that are required to provide onsite jobsite offices as noted in the Temporary Utilities for Construction Purposes (Exhibit F), dated February 6, 2004. 26. Notify DIGALERT (1-800-277-2600) a minimum of two (2) days before commencement of all excavating or trenching. 27. Provide on-site dust control and clean-up of soil, including the adjacent sites and streets, during the execution of the work. The PM-10 and SWPPP plans will be provided and maintain by the Site Demolition and Grading Trade Contractor through the duration of the project. However, coordination, removal and replacement of PM-10 and SWPPP measures to accommodate your work will be this Trade Contractor's responsibility. Coordinate your work, including impacts to the above plans with the Site Demolition and Grading Trade Contractor prior to start of your work. 28. All clean up of streets, adjacent properties and site debris, generated by execution of its work will be the responsibility of this Trade Contractor. 29. Provide all water required for construction, including dust control. The temporary water consumption costs will be paid for by the City of Palm Springs. 30. Protect in place all new and existing work within the demolition and construction limits, and the existing Convention Center that will be remain, reused, reworked or reconnected, unless otherwise noted. 31. References to Steel Trade Contractor shall mean Structural Steel, Steel Joist, Metal Decking and Misc. Metals Trade Contractor. References to Structural Steel, Steel Joist, Metal Decking and Misc. Metals including, but not limited to, labor, material, equipment, cranes, hoisting, lifting, deliveries, detailing, shoring, jacking, torquing, welding, cutting, removal, barricades, cable railing, protection, anchor bolts, anchor bolt templates, shims, columns, beams, beam seats, girts, saddles, base plates, plates, tube steel, bent plate, moment frames, tension bracing, box girder, girders, collection truss, steel truss, steel joist, bridging, doublers, bracing, x-bracing, ledgers, channels, ladders, roof ladders, pipe bollards, pylon framing, veneer framing, roll-up door frames, frames at louvers, angles, loading dock angles, roof and floor penetration frames and supplement steel supports, equipment supplement support steel, lavatory supports, toilet partition supports, all thread, folding panel partition supports, glass curtain supports, rigging assemblies, metal stairs, handrails, guardrails, sleeves, bolts, threaded rods, high strengths bolts, nuts, washers, fasteners, stiffeners, gussets, connection plates, connectors, rbs, coping, slots, hole, UT testing, notches, caps, hangers, metal decking, perforated metal decking, priming, nelson studs, rebar, closures, closure strips, etc, to complete all the Structural Steel, Steel Joist, Metal Decking and Misc. Provide all submittals, certificates, mill certificates, test reports, shop drawings, details, (including connection details), as necessary to properly and accurately depict, acquire approval from Record Engineer, fabricate and install the Structural Steel, Steel Joist, Metal Decking and Misc. Metals. 4. Trade Contractor shall provide all field measurements necessary to assure that the Structural Steel, Steel Joist, Metal Decking and Misc. Metals properly and accurately fit into the new and existing conditions under which they are being installed. This field measuring shall occur both during the shop drawing and during the fabrication phase to minimize any potential problems that may occur during installation. 5. Shop drawings erection drawings will include all vertical and horizontal "dimensions" for complete layout and location information. 6. Provide a Project Superintendent to oversee the overall Structural Steel, Steel Joist, Metal Decking and Misc. Metals scope of work, as well as any subcontracted scope of work, and a fully qualified field foreman or foremen. All subcontracted work must provide a fully qualified superintendent or field foremen. 7. Provide Structural Steel, Steel Joist, Metal Decking and Misc, Metals in accordance with the Contract Documents. 8. Trade Contractor to provide complete anchor bolt plan with complete dimension layout from Column line reference points for use by Concrete Trade Contractor. This plan will be submitted to the ArchitecUEngineer for approval, and delivered to the Concrete Trade Contractor prior to setting of anchor bolts. METALS February 6, 2004 9. placement of all cast in anchor bolts to ensure correction location prior to concrete pours. Additionally, the Trade Contractor's qualified representative shall be present during concrete pours to monitor that bolts are not moved during pours. Concrete Trade Contractor shall assist in these observations. Provide notification to Turner should locations be determined incorrect. Additionally, Trade Contractor shall provide field verification and as-built study of each bolt prior to and during fabrication of all steel. Any discrepancies in location vertically or horizontally shall be noted and reported to Turner. 10. Trade Contractor shall specifically include scaffolding, shoring, bracing, hoisting, lifting, cranes, etc., to complete the all the Structural Steel, Steel Joist, Metal Decking and Misc. Metals work. 11. Trade Contractor shall include all shimming and leveling of all Structural Steel, Steel Joist, Metal Decking and Misc. Metals work. This includes, but not limited to, the metal decking joints at the "sloped" West Canopy, Pre-Function and Registration roof to ensure joint with the roof insulation is not transferred to the finished roof material. Coordinate this installation with the Roofing Trade Contractor. 12. Trade Contractor shall coordinate locations of staging and hoisting, including the path (including below) of any hoisted material, including crane hoisted. Trade Contractor shall properly barricade areas and path of hoisting. 13. Trade Contractor shall notify the Airport of all crane staging and hoisting, 72 hours in advance. This notification shall be scheduled through Turner. 14. Trade Contractor shall remove all existing fireproofing and paint/primer as necessary to weld steel to the existing steel. New steel shall be prepped accordingly to accommodate sprayed on fireproofing material. Coordination meeting with the Drywall/Metal Stud Framing/EIFS/Insulation/Fireproofing Trade Contractor shall be required. 15. Coordinate Structural Steel, Steel Joist, Metal Decking and Misc. Metals work with Convention Center, through the CM, since new steel may be located over or near existing public occupied areas. Pre-planning staging and hoisting meeting and plans will be submitted to Turner. 16. Shop prime all Structural Steel, Steel Joist, Metal Decking and Misc. Metals except where steel is required to be galvanized or fireproofed, or welded in the field. After welding, areas not to receive galvanizing or fireproofing shall be primed painted. 17. Provide welding curtain to shield arc-welding operations from site by other trades, workers, employees, conventioneers, public view, etc. Provide welding curtain, including rooftop welding where adjacent Hotel/Condominium guests and residents, could sustain eye damage from observing roof top welding unintentionally. 18. Obtain flame permit (hot work) on daily basis from CM for all welding operations. All hot work to be signed off as safe at conclusion of each work day. 19. Provide fire watch after each day's welding operations (hot work) to ensure all threat of ignition to existing structure is eliminated. Return flame permits after each day's welding operation and fire watch is completed. 20. All welders shall be certified and qualified as per ASWS standards. Trade Contractor shall furnish welding procedures and certifications for all welders performing work. 21. Provide welding truck with its self-contained power source, and proper leads, as temporary power to welders will not be available. 6 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 22. Provide all channel and tube steel frames, including angle frames, at roll-up coiling doors. 23. Provide steel frames at all new louver openings. 24. Include the following embedded items for installation of the misc. metals by other trades. The items include, but not limited to, angles, pipe bollards, anchor bolts and accessories. Coordinate installation with Concrete and other Trade Contractors. 25. Provide continuous bent plate for attachment of metal stud framing. Coordinate the installation of the structural steel continuous bent plates with Drywall/EIFS Trade Contractor. 26. Provide all anchorage, fasteners, supports, and welding for installation of your work. 27, Coordinate, through Construction Manager, welding, bolt testing and nelson stud welding with Deputy and City Inspections. 28. Include all costs, permits and fees associated for the loading and unloading of steel, including crane, street use and access permits. 29. Provide all holes, cutouts, and copings at steel. 30. Properly tag and permanently identify all new steel, including all FOB items, delivered to the project. 31. Provide all grinding, sanding, and touch-up of surfaces and weld joints to prepare metal products for paint and other finishes. 32. Provide all layout and engineering for your work from control lines established by others. All survey control, including benchmarks, lines and grades, lost or damaged by this Trade Contractor's operation will be this Trade Contractor's responsibility. 33. Trade Contractor shall review other pertinent Contract Drawings for the coordination of steel with other trade's scopes of work. 34. Coordinate and schedule all deliveries and hoisting with the Turner seventy-two (72) hours in advance. 35. Coordinate installation of this work with other Trade Contractors through the Construction Manager. 36. Provide daily clean up and removal for all debris generated by your work. 37. Provide Daily Construction Reports to Construction Manager. 38. Provide fully engineered shoring with structural calculations for all shoring at areas or structures to be demolished or demolished, retrofitted and reconstruction. Engineered shoring plans and calculations shall be submitted to the Structural Engineer through Turner for ample time to allow review and comment. Shoring areas shall include, but not limited to, existing loading dock canopy framing at gridlines LA, L.8, and Q.1, and building structure at gridlines H.9, M.2 and Z.5. Shoring shall be in place prior to demolition, removal or re-construction. 39. Provide new steel supports and framing at all new roof and wall openings, including but not limited to, roof intake vents, roof drains, and mechanical equipment openings. 40. Coordinate temporary weather protection materials at existing roof and wall tie-in of new steel to existing steel. Remove and replacement to accommodate work shall be this trade contractor responsibility. 7 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE 11 CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 41. Provide bent plate edge form/closures at perimeter edges and openings. 42. Provide embed plates, anchors, nelson studs, etc. where structural steel is supported by or attached to CMU. CMU wall will be built prior to structural steel erection. This includes at new roof structure steel at loading dock electrical room. 43. Provide two (2) erection crews to erect the Structural Steel, Steel Joist, Metal Decking and Misc. Steel generally within two (2) areas of the facility. The two (2) areas generally include the Exhibit Hall / East Mezzanine / Loading Dock / Administration Areas, and the West Canopy, West Pre- function / West Registration / Ballroom / West Mezzanine, and Kitchen areas. Provide detailing, shop drawings, fabrication and delivery to allow the above referenced work to commence as noted. 44. If the steel erection requires the crane to be located within the footprint of the building, coordinate with the Grading, Concrete and Utility's Trade Contractor for a safe path of travel without damage to foundation concrete or utilities, or an area of native graded surface to stage crane. 45. Provide prime paint at structural steel that is not encased in concrete, galvanized, to receive spray on fireproofing, or in contact with surfaces of high strength bolted connections. Include cost to touch-up all field welds with primer or galvanizing. 46, Provide all non-vertical Nelson anchors and rebar attached to structural steel. Nelson studs associated with the installation of the metal deck with be provided and installed by the metal deck Trade Contractor. Provide all field welding of rebar to structural steel. 47. Furnish FOB Jobsite, all foundation anchor bolts and templates for installation by others. Templates shall not interfere with the placement of reinforcing steel. Steel Trade Contractor shall be onsite to verify anchor bolt installation prior to and during all concrete placement. Prior to the start of structural steel erection, this Trade Contractor shall survey and verify anchor bolt and top of concrete footing locations and notify Turner of any discrepancies between actual location and the shop drawings. One leveling nut per anchor bolt pattern will be set to elevation by others. Steel Trade Contractor will be responsible to transfer this elevation to other leveling nuts. 48. Furnish, install and maintain all ladders required for access to the Work by Trade Contractors, Turner, inspectors, etc. 49. Provide all power as required for welding and all aspects of the Work. 50. Provide steel support and metal decking as required to infill the existing mezzanine opening at the demolished ships ladder located approximately between gridlines Q.1 and R.2 and 34 and 36. 51. Provide any temporary shoring and bracing required for the erection of the Work, including but not limited to, all miscellaneous iron angles, braces, shoring or framing required to maintain the integrity of the structural steel work. 52. Provide traffic control, signalmen, and barricades as necessary for the performance of the Work while entering and exiting the jobsite. Traffic control personnel shall wear orange safety vests and have stop/slow signs when directing traffic in the street at all times. Trade Contractor will supply any traffic cones or signs required by the City of Palm Springs- 8 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 53. All Trade Contractor and Subcontractor's employees shall be fully tied-off(100% fall protection) at all times when exposed to a fall exposure of 6 feet or greater. Provide safety cables and tie-off points to provide accordingly. 54. Provide two (2) strands of 3/8" safety cable and toeboard around the perimeter of each floor and roof level and at all interior openings. Cable shall be located at code heights measured after concrete decks are placed. This includes locations of where demolition of roof, structural and parapets at gridlines, LA, L.8 and Z.5. Include intermediate posts as required to comply with OSHA regulations so that installation of exterior metal studs, stairs, shaft wall, and other nearby work can occur unimpeded. Cable shall remain in place until it is no longer required, at which time cable shall be removed by this Trade Contractor. Safety cable and installation shall meet all OSHA requirements to provide tie-off for fall protection. The two (2) strand perimeter safety cable shall have a turnbuckle, on each strand, at each corner of a building area, and at certain other bays as may be required. Trade Contractor shall coordinate the location with Turner of eyebolts and/or any device welded to steel columns or beams that are used to support the safety cable. Provide cable tabs on all sides of all columns, capable of restraining OSHA required fall protection loads, for the metal deck workers, or other Trades as required, to install their own cable for fall protection tie-off. 55. Provide safety post at locations to be coordinated with Turner at locations to eliminate conflicts with future trades, and at perimeter to eliminate conflicts with exterior wall trades. A minimum of three (3) clamps shall be required on all safety cable. Provide a second set of posts and cable 3' from the perimeter of all roofs and setback areas, or coordinate the location of the roof perimeter protection so that it can be left in place during and after the roof parapet construction where feasible. Safety post shall remain in place until it is no longer required, at which time the safety post shall be removed by this Trade Contractor. 56. Delivery of material FOB furnished, shall be delivered, phased or sequenced, so as not to impede the work of other Trade Contractors. 57. Trade Contractor shall furnish all labor, material and equipment necessary to receive and hoist to the appropriate floor and/or roof level metal deck, nelson stud anchors, closure angles/plate and accessories. Decking accessories shall be bundled with decking lifts. Trade Contractor shall provide chokers, slings and/or any other apparatus required for the complete hoisting of the metal deck (hook and unhook truck to floor and/or roof). This operation shall be coordinated with Turner decking shall be place with such timeliness so as to permit its use as safety planking and/or a working deck for the erection of the structural steel. During the time the metal decking is used for safety planking and/or a working deck, Trade Contractor shall be responsible for damage to the metal deck caused the performance of the Work. Metal decking removed by the Trade Contractor shall be replaced and tack welded as needed. 58. Trade Contractor shall furnish all labor, material and equipment necessary to receive and hoist to the appropriate floor and/or roof level, reinforcing steel and welded wire mesh reinforcing for the Concrete Trade Contractor. Hoisting of these items shall be done in the same fashion as the metal deck hoisting. 59. Provide licensed shoring contractor to shore and make safe the existing areas which require shoring. Shoring contractor shall provide jacking of existing structure as required for the installation of new, removed or modified steel. 9 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE 11 CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA _ TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 60. Structural Steel, Steel Joist, Metal Decking and Misc. Metals Trade Contractor acknowledges that there are areas which the structure is being demolished and /or retrofitted, and as such, the Structural Steel, Steel Joist, Metal Decking and Misc. Metals Trade Contractor will coordinate with the Selective Demolition Trade Contractor, and all other related Trade Contractors. This Trade Contractor shall demolish structural steel and metal decking at the existing Loading Dock Canopy between LA and L.8 as necessary for complete reconstruction of this area in accordance with the new steel and the intent of the Contract Documents. Provide engineering shoring of existing Loading Dock Canopy structure prior to this demolition and throughout relocation and reconstruction of the steel in this area. This area of demolition and reconstruction shall be phased. 61. Demolition Trade Contractor shall remove concrete encasement of the column at approximately gridline 34.6 and immediately west of Q.1. This Trade Contractor will demolish the steel column and connection at this location, and shall provide the new column shown, immediately north of the column to be demolished. Steel Trade Contractor shall coordinate this work with the Selective Demolition Trade Contractor. Shoring in this area prior to demolition and throughout relocation and reconstruction of the column shall be provided by the Selective Demolition Trade Contractor. Selective Demolition Trade Contractor shall remove ample area of EIFS and framing above to allow removal and installation of the column and beam connections in this area. This area of demolition and reconstruction shall be phased. 62. Steel Trade Contractor shall remove structural steel at gridlines Z.5 between 26 and 32 as required to complete the new box girder work. Provide engineered shoring of the girder/beams/truss at Z.5 at approximately 26 and 32 for column removal at gridlines 26 and 32. Trade Contractor shall remove existing columns and provide new columns at 26 and 32 after footing have been replaced. Existing footings at 26 and 32 will be removal by the Selective Demolition Trade Contractor. Shoring shall remain until new work is complete and acceptable to the Structural Engineer. Any subsequent shoring of beams supporting existing structures at the demolished column locations, and the reconnection of existing beams to the new columns will be completed by this Trade Contractor. The structural steel removal in this area will include engineered shoring to support the structure while existing columns are removed and replaced, as such; the Steel Trade Contractor shall coordinate its demolition with the shoring operation, Demolition and Concrete Trade Contractors. Provide all jacking as required to complete this work. Provide all moment frame modifications to existing as required. Prior to the demolition in these areas, the demolition and sequence must be reviewed onsite with the Architect and/or Engineer, Concrete, Demolition and MEP Trade Contractors prior to commencement of work. 63. Selective Demolition Trade Contractor shall provide demolition of the EIFS exterior wall and framing where required to at gridlines 33.9, H.9 and M.2. This work cannot commence prior to Drywall/EIFS has provide connections to support the upper portion of the exterior walls to remain at gridlines 33.9, H.9 and M.2. 64. Provide structural steel rigging points with supplemental steel supports at new Ballroom and new Exhibit Hall expansion. Coordinate rigging heights with finish ceiling and locations with other trades and the PSCC. 65. Provide removal of columns and shore structure along gridline H.9. Replace columns after new steel and footings that conflict/interfere are installed. 66. Provide new ships ladder and railing assemblies. 67. Provide installation of all railings/guardrails. This includes coring of concrete and installation of grout epoxy where sleeves are not provided or practical. 10 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. Coordinate remove of EIFS, framing and drywall for access to new to existing or new to new structural steel or the demolition of existing structural steel, including wall columns at H.9 line at the exterior wall of Oasis #4. Coordinate this work will the Demolition and Drywall/EIFS Trade Contractor's. 69. Provide steel framing at roof opening for mechanical mezzanine roof intake vents. 70. Trade Contractor shall acknowledge that the existing Loading Dock ramp, slab, walls, columns and canopy will be demolished in a minimum of three (3) separate phases. The 1" phase will commence with the demolition of the existing loading dock ramp, wall, footings, columns, and slabs and canopy structure, including structural steel from approximately gridline H.9 to gridline LA by the Demolition Trade Contractor. The 2n0 phase will commence with demolition of additional canopy structure in a separate move-in conjunction with the Structural Steel Trade Contractor between LA and approximately L.8. The Selective Demolition Trade Contractor shall remove the loading dock canopy in this area to the structural steel framing and metal deck. Upon completion of the Selective Demolition Trade Contractors work this Trade Contractor will remove the structural steel and metal decking between LA and L.B. Please note shoring of structure will be required during demolition of canopy structure in this area. 71. Comply with all regulations and laws applicable to handling and disposing of any demolished material. 72. Provide barricades to protect the Convention Center pedestrians, employees, conventioneers and other Trade Contractors working near and around the areas of Structural Steel, Steel Joist, Metal Decking and Misc. Metals work. Provide all safety notification signage within the interior and exterior of the area for notification of ongoing steel erection throughout the project. 73. Provide barricades to protect the Convention Center pedestrians, employees, conventioneers and other Trade Contractors working near and around the areas of structural demolition. Provide shoring as required, and all safety notification signage within the interior and exterior of the area for notification of ongoing steel demolition throughout the project. 74. Demolition of east Main Lobby Pre-function will not commence until after temporary partitions are installed and utilities & MEP that are routed through the demolition areas are re-routed and service is re-established. In addition, shoring plan must be engineered, approved and in place. 75. Provide coordination of demolition of existing E.1 F.S. and exterior metal stud framing walls with the Drywall/EIFS Trade Contractor's. Work will be phased and completed in conjunction with Steel and Framing operations. Demolition of EIFS at locations where new structure attaches to existing, this shall include but not limited to, area of new loading dock canopy, new west registration, new east exhibit hall, new loading canopy structure, new "mesquite corridor" structure, existing loading dock canopy, new kitchen shell and new Ballroom. Demolition of this EIFS system is the Selective Demolition Trade Contractor's responsibility. Provide protection barricades and fall protection, including OSHA approved safety notification signage over all penetrations and openings until permanent construction is in place. 76. Coordinate Structural Steel, Steel Joist, Metal Decking and Misc. Metals erection with the all Trade Contractors. 77. Provide ventilation for any exhaust/fume-producing equipment within the building or confined spaces. 78. Provide diligent efforts so that exhaust/fumes are not introduced into the Building Outside Air Supply, louvers, or building Air Intake locations during steel work. METALS February 6, 2004 79. Provide diligent efforts so that exhaust/fumes are not introduced into the Building return air system, louvers, or building Air Intake locations during steel work. This specifically includes louvers located at mezzanine mechanical room. 80. Protect all existing finishes and materials to remain. 81. Provide fire extinguishers at all welding locations for protection and safety. 82. Structural Steel, Steel Joist, Metal Decking and Misc. Metals Trade Contractor shall provide all of its own dumpsters for the Structural Steel demolition scope of work. These dumpsters are not the dumpsters to be provided for"other trades" under the provisions listed in the Contract Document, Bid Package 1, Exhibit"F", dated February 6, 2004. 83. Provide all cranes, cabling, ladders, scaffolding, lifts, safety equipment, etc. as required to safety and fully complete this trades scope of work. 84. Grind smooth all cut welds clean after removal of Structural Steel during the steel demolition. 85. Provide a list of all areas where existing fireproofing has been removed in order to weld to existing. List shall be provided to Turner for patching of fireproofing by others. 86. Provide and install protection where work occurs over finishes to remain and finished areas during the steel work. 87. Maintain protection of storefront at Mesquite Meeting Rooms during steel work. 88. Provide coordination of all structural steel demolition and removal to be demolished by this Trade Contractor with the Selective Demolition Trade Contractor prior to start of work by either Trade Contractor. 89. Provide coordination of all drywall and E.I.F.S. demolition to allow access with Drywall/ E.I.F.S. Trade Contractor. 90. Provide fall protection and barricades at all roof opening or leading edges, where parapet or structure has been demolished. This specifically includes at the east Exhibit hall, Oasis#1 , and adjoining areas roof where the new structure meets the old structure and the west edge of the demolished loading dock canopy, at LA and L.8. 91. Provide all detailing, welding, steel beams, columns, angles, bracing, channels, plates, rings, and all related supplemental steel components for the complete pylon structures steel. Gauge studs and blocking will material shall be provided by Drywall/EIFS Trade Contractor. Coordinate connection plates locations and installation with the Drywall/EIFS, Masonry and Trade Contractors. 92. Provide steel and bracing with connectors for the glass curtain wall. Coordinate with the Drywall/EIFS and Glazing Trade Contractors. 93. Provide all detailing, welding, steel beams, channels, angles, bracing, plates, all-threaded and related components for the complete toilet partitions support steel. Coordinate with Toilet Partition Trade Contractor. 94. Provide all detailing, welding, steel beams, channels, angles, bracing, plates, and related components for the complete folding panel partition support steel. Provide sliding beam seat assemblies, including but not limited to, sliding beam seat assemblies as shown on S7.4.05. 103. Provide tension bracing with stiffener and connection plates. Remove paint/primer for field welding to existing structure. Prime welds after tie-in of new and existing is complete. Tension bracing reconnection to existing truss will be schedule as a separate phase as the work west of the temporary wall must be coordinated with the Convention Center as the exhibit hall may be in use. Provide protection of surfaces and finishes during welding operation. Coordinate bracing prior to installation of temporary wall installed by Drywall/EIFS Trade Contractor. 104, Provide all steel members where gauge framing attaches to structural steel. Coordinate this work with the Drywall/EIFS Trade Contractor. 105. Provide rebar at all bent plate, including but not limited to, rebar at bent plate as shown on S7.3.01. Coordinate the installation of the structural steel continuous bent plates with Steel and Drywall/EIFS Trade Contractors. 120. Provide all anchors, fasteners, supports, and welding for installation of your work. 121. Provide patching of deck at all holes and cutouts, including locations of cable railing and safety posts. 122. Provide metal decking cut out at new roof and deck openings, including but not limited to, roof intake vents, roof drains, and mechanical openings. 123. Provide continuous tie-down of metal decking material due to high winds common in the area. 124. All metal decking shall be welded-off, inspected securely fastened prior to other trades proceeding with work upon the deck. 125. All metal decking above work areas below(slab on grade and elevated decks) shall be welded-off, inspected securely fastened prior to other trades proceeding with work below the deck. 126. Provide bent plate edge form/closures at perimeter edges and openings. 127. Provide repair of metal decking at location of new columns at existing mechanical mezzanine as shown on S5.0.17. Metal Decking will be removed for access and replaced/repaired after new columns are installed. 128. Provide metal decking removal and repair at roof opening for mechanical mezzanine roof intake vents at existing roof. Provide fall protection at all openings. 129. Provide cleaning of all metal decks. Decks to be"blow-off' by others. 130. METALS February 6, 2004 131. Provide 'leave-outs" at metal decking to allow for new HVAC equipment within the new building areas. Provide protection around 'leave-outs" until decking is secured by this Trade Contractor after equipment is set. Scope of Work Allowances: A log of hours used will be kept and a credit will be provided by this Trade Contractor to the City at the end of the project for any remaining unused hours. Turner Construction Company Field Superintendent will issue a Superintendent Instruction to Trade Contractor (SIS) authorizing your Firm to begin the utilizing the allowance hours. The Trade Contractor will provide a Daily Time Ticket with a description of work, manpower quantity, and the number of man-hours worked. Trade Contractor Daily Time Ticket must be presented daily to Turner Construction Company for approval. Upon completion of the Work performed within a given month, the Trade Contractor is to present those monthly costs to Turner Construction Company in the form of a Trade Contractor Request for Change Order with Daily Time Tickets that reflect the cost attached. All Final Costs associated with the Work, upon Turners approval, will be reconciled and issued to your Firm in the form of a Trade Contractor Change Order by the City. A Change Order must be executed by both the City and the Trade Contractor prior to billing for this work. The following Allowances are specifically included in the workspace: 1. Include a cost allowance of 100 man-hours of Journeyman Steel Erector for miscellaneous work, to be used only at the direction of Turner Superintendent. D. Exclusions The following items are specifically excluded from the Work: 1. Building Permit fees by Owner. 2. Testing for or removal of Hazardous Material by Owner. 3. Temporary Boundary Fencing. 4. Demolition of Porte Cochere/Trellis Steel. E. Taxes 1. All sales, use and other taxes which may be required must be included. F. Insurance Requirements 1. Provide the following insurance for Combined Single Limit or Aggregate, in the amounts described: A. Comprehensive General Liability, in the amount of 5,000,000.00, including: a. Premises and Operation b. Elevators c. Independent Contractors d. Blanket Contractual Including Liability Assumed by Insured under the Subcontract. 15 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. METALS February 6, 2004 B. Comprehensive Automobile Liability in the amount of 1,000,000.00, including: a. Owned b. Non-owned C. Hired Automobile Exposures. 2. Turner Construction Company shall be named as additionally insured on all required insurance certificates/policies G. Material Delivery, Handling and Protection 1. This Trade Contractor shall securely store all their jobsite materials to prevent the occurrence of any condition which could contribute to a hazardous material contamination, fire, explosion or other calamity. 2. Provide traffic control and signal men as necessary for deliveries to the jobsite. 3. No staging area will be provided due to the limited Work space of the Project. All material deliveries must be scheduled and approved in advance. 4. All material handling equipment required for loading, transportation, receiving, unloading and disbursement is included. 5. Construction security will not be provided. Trade Contractor shall be responsible for its materials and equipment stored on the project until installed and accepted by the Owner. 6. Trade Contractor fully understands that there is limited storage space onsite for materials. Stockpiling on floors to be minimized and located as directed by Turner. From time to time, relocation of stockpiled materials and equipment on floors and on site may be required as directed by Turner. Trade Contractors will not be entitled to additional compensation for relocating equipment or materials as necessary to allow for the efficient progression of the work. H. Mock-Ups—As noted in the Contract Documents, but including but not limited to: 1. A Pylon structure will be complete as a mock-up and therefore the steel framing will be necessary to commence with other trades for Architect's review and acceptance of the finishes. 2. A portion of the curtain wall will be completed as a mock-up and therefore the steel support steel will be necessary to commence with other trades for Architect's review and acceptance of the finishes. I. Schedule 1. All Work is to be performed in accordance with the Construction Manager's Project Construction Schedule, Exhibit B, dated 2/6/04. A detailed schedule and corresponding Schedule of Values will be required from all Contractors within 10 days from award of Contract, and will be used in developing, updating and modifying the Construction Manager's Project Construction schedule. Trade Contractor's will acknowledge that the Project Construction Schedule will include "multiple move-ins', "out of sequence," and "phasing" of the work. Trade Contractor shall provide a three (3)week look ahead schedule of its work on a weekly basis. 16 PALM SPRINGS CONVENTION CENTER EXPANSION PHASE II CITY PROJECT NUMBER: 02-27 TURNER PROJECT NO. 8640MA TRADE BID NUMBER: 10 STRUCTURAL STEEL, STEEL JOIST, METAL DECKING AND MISC. The Trade Contractor shall provide, within ten (10) days of Contract award the following: a) A detailed schedule of values, with the appropriate system/work breakdown, for each building, which shall be used for monthly progress billings. The schedule of values shall be prepared on the AIA G702/703 forms or a similar form as approved by Turner and City. b) A breakdown, with detail by system as required, of material and labor percentages. c) A detailed schedule of this trades' work, including submittals/shop drawings, material/equipment fabrication, delivery, installation, start-up/testing/commissioning and closeout. d) An estimate of the monthly value of work-in place and manpower. e) Provide schedules, progress updates, submittal dates and shipping and delivery confirmations as requested by the Constriction Manager. 2. Trade Contractor shall be responsible for the cost of all overtime, shift time differentials, and other premium time costs required to "expedite" or "make-up" delays to the schedule caused by this Trade Contractor. This includes, but is not limited to, work in excess of eight hours per day, forty hours per week, and/or work on Saturdays, Sundays and Holidays. All off-hour work must be scheduled through the Construction Manager. 3. All "tie-ins' or "shut-downs" and other impacts must be scheduled through Turner at least 72 hours in advance. All related costs, including overtime, are included in the subcontract price. 4. Whenever an actual or potential labor dispute, involving the Trade Contractor, delays or threatens to delay the timely performance of the work, the Trade Contractor shall promptly give notice thereof in writing to Turner. If as a result of any labor dispute, a special gate is designated by Turner for ingress and egress by the Trade Contractor to the job site, the Trade Contractors and suppliers will comply with the requirement to use only the designated gate. Special budging may be required as long as the Trade Contractor is restricted to the reserved gate. 5. Punchlist items are to be completed within 10 days of the punchlist issuance. Any Turner supervision costs required to complete punchlist items after the 10 day period will be backcharged to the appropriate Trade Contractor. 6. In addition, Trade Contractor shall complete various portions of, or acknowledges special conditions regarding the Work. The following is not to limit this Trade Contractor's Work, but to emphasize various or special conditions regarding the schedule. The items are as follows: a. Steel demolition and shoring areas will be considered separate move-ins. b. Construction of east portion of kitchen shell will commence existing east portion of loading dock is demolished and new loading dock has been completed. This area will be considered a separate phase. b. Trade Contractor shall expedite the structural steel in accordance with the Master Construction Schedule. c.
