Dear Mayor Oden:
The Palm Springs City Council will be considering adoption of Ordinance No. 1724 an
November 7, 2007, relating to the membership, appointment process and criteria for
appointment to the Palm Springs International Airport Commission.
The proposed appointment process will require each city to nominate two candidates
and for the Palm Springs City Council to consider appointing one of the two nominated
from each city. The Indian Wells City Council respectfully disagrees with this process
and recommends that only one candidate be nominated for consideration. The Palm
Springs City Council may then accept or reject the nomination — or later remove that
person at the pleasure of your council. Additionally, we disagree with the probation of
board members from sitting on other airport boards. In the rare event that a potential
conflict exists, the board member may abstain from participating in both receiving the
information and voting on a matter, similar to how council members handle conflicts of
interest.

This report provides for the City Council to waive further reading and adopt the
ordinance- The ordinance shall be effective 30-days from adoption.

PROPOSED ORDINANCE NO. 1724
AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING SECTION SUBSECTION (f) OF
SECTION 2.06.010 AND 2.16.020 OF THE PALM
SPRINGS MUNICIPAL. CODE, RELATING TO THE
MEMBERSHIP OF THE INTERNATIONAL AIRPORT
COMMISSION.
The City Council of the City of Palm Springs ordains:
SECTION 1. Subsection (f) of Section 2.06.010 of the Palm Springs Municipal Code is
amended to read:
(f) Any member may be removed from office at any time, with or without cause, by a
majority vote of the members of the city council. If a member is absent without advance
permission of the board or commission or of the member's appointing authority, from
three consecutive regular meetings or from twenty-five percent of the duly scheduled
meetings of the board or commission within any fiscal year, the chair of the board or
commission shall file a certification with the City Clerk that such absences have
occurred, and the member's office shall thereupon automatically become vacant and
shall be filled as any other vacancy.
SECTION 2. Section 2.16.020 of the Palm Springs Municipal Code is amended to read:
2.16.020 Membership--Creation.
(a) There is created in the city an international airport commission, which shall
consist of nineteen members. The nineteen members shall be appointed in the following
manner: ten members, appointed in accordance with Section 2.04.060 of the Palm
Springs Municipal Code; eight members, one appointed by the Palm Springs City
Council from a list of at least two candidates nominated by each of the city councils of
Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quint@, Palm
Desert, and Rancho Mirage, and the board of supervisors of Riverside County.
(b) No member of the international airport commission shall serve, as a member of
the airport land use commission for Riverside County or any airport board or
commission for another airport within Riverside, Imperial, San Diego, or San Bernardino
counties while serving as a member of the international airport commission, created
pursuant to the provisions of this section. No person shall be eligible to serve or
continue to serve as a member of the international airport commission who has served
as a member of the airport land use commission for Riverside County or any airport
board or commission for another airport within Riverside, Imperial, San Diego, or San
Bernardino counties within the twelve month period immediately preceding service as a
member of the international airport commission.

SECTION 3. The City Clerk shall notify the appointing or nominating authority of any
commissioner who is no longer eligible to serve and advertise and post the vacancy
pursuant to City Charter Section 602.
SECTION 4. The Mayor shall sign and the City Clerk shall certify to the passage and
adoption of this Ordinance and shall cause the same, or the summary thereof, to be
published and posted pursuant to the provisions of law and this Ordinance shall take
effect thirty (30) days after passage.

Dear Members of the City Council,
I hope this isn't perceived as presumptuous.
But it has occurred to me and several other Palm Springs Airport Commissioners that there may be an
unwanted and negative reaction with adoption of the proposed ordinance provision, which would require"down-
Valley" cities to submit two names or candidates for each future opening on the Commission. Let me add that I
fully-understand the rationale and Impetus for introduction of this ordinance revision, and that it primarily is a
response to comments made by two individuals at a Commission meeting last spring,
Increasingly, our airport serves the entire Coachella Valley and its expanding number of year round residents
and seasonal visitors. We, of course, want this growth to continue,with enthusiastic support and
encouragement of neighboring cities who will help promote and advocate for our Airport, particularly in the face
if increased competition from Ontario Airport--and the need for Valley cities to be unified in promoting and
marketing_new air routes and direct flights to New York and possible other East coast destinations.
Provincialism and pettiness has, in the past, existed among neighboring cities, as evidenced by the jealousy
and hostility we've observed toward our city at times, by other cities' councils and council members who like to
take potshots at our city and the "brand recognition"we enjoy. Mayor Oder, Mr. Ready and others can recall
past efforts by some cities to remove the words "Palm Springs"from the CVA's official name. This was
particularly evident during mid-2005 when some of us participated in developing the CVA Reorganization
Committee's recommendations.
If would be unfortunate if the proposed revision in the long-standing methodology or appointing respective
dawn-Valley (and Riverside County)Airport Commissioners triggered a backlash or otherwise damaged
relations between Palm Springs and--or support from--our Coachella Valley 'Airport partners."
Inasmuch as the proposal would not affect any of the existing down-Valley Airport Commissioners, I wanted to
at least raise the question before you consider final adoption of this portion of the pending ordinance. None of
us wants to precipitate a regression in our City's or Airport's relations with other Coachella Valley cities or with
Riverside County, which could somehow result in diminishing their enthusiasm and support for our expanding
Airport. I fear this could occur when other cities learned that their traditional method of selecting their
respective Airport Commissioner has suddenly been changed.
Thanks for letting me express this perspective, which is solely based on concern for our City and Airport.
