SUMMARY
Approval of this Amendment No. 5increases the total authorized Regional Measure A
amount by $340,720 to $16,693,563 for Design Engineering, Environmental and
Construction of the Indian Avenue/Interstate-10 Interchange, City Project No. 00-14.
RECOMMENDATION:
1) "APPROVING AMENDMENT NO. 5TOTHE CVAG/CITY AGREEMENT NO-4317,
FOR ALLOCATING AN ADDITIONAL $340,720 IN REGIONAL MEASURE A
FUNDS AND AMENDING THE TOTAL PROJECT COST TO $16,693,563 FOR
THE INDIAN AVENUEIINTERSTATE-10 INTERCHANGE, CITY PROJECT
NO. 00 14.°
2) Authorize the City Manager to execute all necessary documents.
STAFF ANALYSIS:
On December6,2000,City Council approved the initial Master ReimbursementAgreement
with CVAG (A#4317) for the Indian Avenue/Interstate-10 Interchange ("Indian/1-10") and
CVAG designated the City of Palm Springs as the Lead Agency for the project. On
November 14, 2001 City Council approved Amendment#1, allocating$9,000 towards City
Preliminary Administrative costs for the project. On May 1, 2002 City Council approved
Amendment#2 to the agreement allocating $15,300,000 in Federal State Transportation
Improvement Plan Grant Funds toward the construction phase of the Indian/1-10 Project.
On January 2, 2003 City Council approved Amendment#3, allocating $50,000 for Project
Administration costs. On May 21, 2003 City Council approved Amendment#4, allocating

$50,000 for Additional Design and Environmental Services required by Caltrans and the
Federal Highway Administration. This Amendment #5 in the amount of $340,720 is for
additional work by the Design Consultant due to changes and revised requirements by
Caltrans resulting in the initial phase of the project being extended from the anticipated one
or two years to more than five years_
The details of the changes are included in the attached October 4, 2006 City Council staff
report, wherein Amendment #2 to Contract Service Agreement #4318 with Dokken
Engineering for the Design of the project was approved by Council. The CVAG Executive
Committee has approved this Amendment #5 on September 25, 2006, has received an
executed copy from the County of Riverside and submitted the document on September
28, 2007 to the City of Palm Springs for approval and execution.
FISCAL IMPACT:
An Offsetting Budget Adjustment has already increased the Indian/1-10 Interchange Project
Account 134- 497-50185 to cover this Amendment pursuant to Council's October4, 2006
action. There is no cost to the City's General Fund,

AMENDMENT NUMBER FIVE/ADDITIONAL ENGINEERING DESIGN FUNDS
THIS AMENDMENT NUMBER FIVE is made and entered into this_Day of
2007, by and between the City of Palm Springs ("Lead Agency"), the County of
Riverside("Agency"),and the Coachella Valley Association of Governments,a California
jointpowers agency,("CVAG"),and is made with reference to the following background facts and
circumstances:
This amendmentobligates andauthorizes forexpenditure,fundsnotpreviouslyautbonzed
under the terms of the existing reimbursement agreement for the"Indian Avenue Interstate 10
Interchange DesigpEngineeringandEnviromneatal"("the Project"),datedDecember 6,2000,
amendment numberone,dated November 14,2001,amendment number two,dated May 1,2002,
amendment number three, dated December 8, 2003, and amendment number four. A.11 other
provisions are considered in force.
This amendment number five shall authorize additional design engineering funds in the
amount not to exceed$340,720. The Lead Agency is requesting additional funds forthe Design
Consultantdueto thePA/ED(ProjectApprovaL EnvironmenWDocument)Pbase ofthepmjectthat
has been extended from the anticipated two years to more than five years_
