SUBJECT: Gensler Architectural Services Agreement — Amendment No. 13,
Additional Services — Phase II Terminal Rehabilitation/Enhancement

SUMMARY
The passenger terminal rehabilitation/improvement program continues and Phase II is
underway with design. This action seeks City Council concurrence with the results and
determinations of the schematic design phase which includes a number of additional
components to the overall project and adds to the scope of design services.
RECOMMENDATION:
Approve Amendment No. 13 to the Gensler airport architectural design contract,
Agreement No. 4382, for additional airport terminal design work to incorporate
components added during the schematic design process for the Phase II terminal
rehabilitation/enhancement program.
STAFF ANALYSIS:
On June 20, 2007 the City Council approved an amendment to the Gensler architectural
design contract to undertake the next phase of the terminal rehabilitation. The next
phase was anticipated to just include the demolition of the two old temporary hold-
rooms, new landscape and hardscape for the main courtyard, a more defined and
efficient entry into the main terminal, an interior modification to the old checkpoint area
and terminal carpet replacement. The schematic design evaluated each of the above
items under the watchful eyes of a design committee made up of Councilman Mills,
Airport Executive Director, Owner's Representative, Landscape Architect Michael
Buccino and the design team from Gensler.

The new Executive Director, whom arrived about half way into the schematic process,
provided fresh input and ideas that were welcomed by the design committee. As a
result of the process, there was consensus by the design committee to address some
additional functional and aesthetic elements. These include:
1. Removing two antiquated manual push doors in the main lobby and replacing
with contemporary automatic units for improved customer convenience.
2. Replace the old, cracked terrazzo flooring in the middle lobby with new flooring
that provides a more appropriate aesthetic appeal and theme.
3. Consider minor modifications to the airline and TSA outbound bag belt conveyors
to improve the ergonomics of baggage handling.
4. Remove the unattractive concrete K-rail units from the front of the terminal and
replace with a completely redesigned front entry area to the main lobby that
improves customer convenience and is more attractive.
5. Provide a protective canopy between the main courtyard and recently opened
new concourse.
6. Provide for a new Flight Information Display kiosk for passenger convenience
and way-finding in the courtyard area.
7. Include an independent cost estimating firm to facilitate better control of project
costs.
The attached proposal letter from Gensler outlines the specific work to be completed
and the lump sum costs to complete the work. The total proposed additional design
work comes to $95,900 plus $10,000 for reimbursables. The construction of the
additional components has raised the order of project magnitude from an estimated
$5.5 million to $7 million (includes soft and construction costs). It is critical to
emphasize that this project is only in the design stage and other than architectural fees,
there is no financial obligation toward any construction costs until funding sources are
definitive, the project has been bid, and a construction contract has been awarded.
The Airport Commission reviewed the added scope items from the Schematic Design
process at the October 10, 2007 meeting and concurred with the project expansion. At
the time staff reported that the expected increase in design cost would not exceed
$75,000. Staff will return to the Commission at their November meeting to provide the
updated cost. Project timing, so that we can be under construction by May 2008,
requires that we seek City Council approval at this time.
The attached proposed amendment incorporates the additional scope items, the
$95,900 in design fees, the $10,000 in reimbursables, and increases the "construction
budget" provided for in the contract from $4.4 million to $6 million. It is likely that another
increase in fees will be sought if the study of baggage handling systems reveals that
some level of additional design is needed. The purpose for not waiting for this to be
determined is because the program must move forward in order to try and complete it
prior to '08 peak season-

The additional fees included in Amendment No. 13 total $105,900. Funds are available

AMENDMENT NO. 13
AGREEMENT NO 4382 — ARCHITECTURAL SERVICES
THIS THIRTEENTH AMENDMENT to Agreement No. 4382 for contract services,
(herein "Amendment") made and entered into on the day of
2007, by and between the CITY OF PALM SPRINGS (herein "City") and
GENSLER (herein "Architect") is hereby amended effective
as follows:
RECITALS
The City and Architect entered into that certain Contract Services Agreement No.
4283 for Architectural Design Services ("Agreement'), as duly amended from
time to time.
The parties wish to amend the Agreement pursuant to the terms of this
Amendment to add additional services to be performed by the Architect and
increase the Contract Sum to authorize payment for such additional services.
NOW, THEREFORE, the parties hereto agree as follows:
Section 1.
Exhibit "A" Scope of Services is hereby amended by adding the following sub-
task to Task 16:
Sub-task b: FIDS Kiosk: Architect shall design a kiosk to house a FIDS
display outside in the main courtyard. The display will be integrated into the
design of the concession building but shall be able to be constructed as a stand
alone unit. The final selected design shall be incorporated into the working
drawings for implementation.
Section 2.
Exhibit "A" Scope of Services is hereby amended by adding the following sub-
tasks to Task 17:
Sub-task b: Lobby Flooring: Architect will work with Airport to develop two to
three alternative concepts for the flooring in the main lobby, extending from the
front curb to the exit to the central courtyard and between the carpeted areas of
the ticket and baggage wings. The final selected design will be incorporated into
the working drawings for implementation.

Sub-task c: Automatic Sliding Doors: Architect to prepare a design to
integrate new electric doors into the main lobby entrance doors; final design to be
incorporated into the working drawings.
Sub-task d: Baggage Handling Equipment: Architect will sub-contract with
BNP to prepare a study with recommendations for improvements to the out-
bound baggage handling system. If Airport accepts recommendations the
improvements will be incorporated into the working drawings with the fee to be
negotiated at the time of acceptance of recommendations.
Sub-task e: Lobby Front Doors to Front Curb: Architect and its sub-
consultants shall develop a landscape/hardscape design for the area from the
front curb to the main lobby doors (area under the high entry roof). The final
design shall be incorporated into the working drawings for implementation.
Section 3.
Exhibit "A" Scope of Services, is hereby amended by adding the following sub-
task to Task 18:
Sub-task b: Modular Canopy for Concourse Walk-way: Architect, following
the selection of a schematic design from Sub-task 18a, shall complete the design
of a modular canopy system for the concourse walk-way. Said design shall be
incorporated into the working drawings for implementation.
Section 4.
Exhibit "A" Scope of Services is herby amended by adding the following task 20:
Task 20 — Cost estimating-
Sub-task a: Architect shall employee the services of an independent cost
estimating firm. Said firm shall provide cost estimates at Schematic Design,
Design Development, and Final Design phases of the design process.
Section 5.
Exhibit "C Schedule of Compensation, is hereby amended by adding Lump Sum
Fees in the amount of$96,900 as follows:

The reimbursables are hereby amended to be increased by $10,000 to a not-to-
exceed amount of $27,800.
Section 7,
Special Requirements, is hereby amended by modifying the second sentence of
the first paragraph to read as follows: "Architect acknowledges that City has
budgeted the amount of $6 million for the construction phase of the Project, Task
15, 16, 17, and 18 ("Construction Budget')." Further, Architect may sub-contract
with Faithful Gould for cost estimating services and BNP for Baggage Handling
System study.
Section 8.
Full Force and Effect: Except as previously modified herein, all other provisions
of the Agreement shall remain unmodified in full force and effect.
Section 9,
Corporate Authority: The persons executing this Amendment on behalf of the
parties hereto warrant that (i) such party is duly organized and existing, (ii) they
are duly authorized to execute and deliver this Amendment on behalf of said
party, (iii) by so executing this Amendment, such party is formally bound to the
provisions of this Amendment, and (iv) the entering into this Amendment does
not violate any provision of any other agreement to which said party is bound.
