U.S. CUSTOMS AND BORDER PROTECTION - GENERAL AVIATION PROCESSING
FACILITY
RECOMMENDATION:
It is recommended that the City Council award a contract for the United States
Customs & Border Protection (USCBP) General Aviation Processing (GAP)facility at
the Palm Springs International Airport (City Project 2004-02) to B.E. McMurray
Construction, Inc in the amount of$396,000.
SUMMARY:
This project will remodel approximately 3,000 s.f. of interior space in the Signature
Flight Support Facility into a General Aviation Processing (GAP) facility, which is
required based on newfacility requirements from the United States Customs& Border
Protection (USCBP) agency, who oversees the Airport's User Fee Program.
BACKGROUND:
In 1994, the Airport applied for and was granted status as a "User Fee" airport by the
United States Customs & Border Protection (USCBP), which allowed overseas
business flights to enter the United States at Palm Springs. The program continues to
be an important service provided to the aviation community. While this program is
primarily supported bythe corporate aviation community, USCBP also provides landing
rights to commercial service operators serving Palm Springs International Airport
(PSP).
In response to the events of September 11", the Airport undertook a modification to
the entrance roadway system and constructed a centralized Vehicle Inspection Plaza
(VIP). As a result of this project, the USCBP office, which was housed in a highly
modified trailer, was temporarily relocated. During the design of this project, USCBP
personnel indicated their willingness to return to their trailer and the Airport agreed to
provide upgraded carpeting, painting and other office equipment.
Midway through the Airport's project,the Los Angeles Port Director for USCBP advised
the Airport that USCBP personnel would not utilize the trailer and that furthermore,
unless a new facility was built in accordance with new USCBP GAP standards, the
Airport would lose its "User Fee" status.
As a result of numerous discussions with the USCBP Port Director and her staff, an
acceptable alternative was agreed to by utilizing the Signature Flight Support facility.
A modification to the lease agreement between Signature Flight Support and the City
was agreed to reflecting these changes.
Plans and specifications were adopted by the City Council on February 4, 2004.

were received on May 6, 2004:

After reviewing all of the bids and the DBE (Disadvantaged Business Enterprise)
commitment,the lowest responsive,responsible bidder is B.E.McMurray Construction,
Inc at a bid price of $396,000 and a DBE commitment of 0%. Documentation was
provided with the bid indicating a "Good Faith Effort" was made to solicit DBE
participation. The DBE minimum participation level for this project is 0%.
This project is included in the Airport's pending Airport Improvement Program (AIP)
grant from the Federal Aviation Administration (FAA) and if funded, the FAA would
reimburse 95%of the construction cost, however, no commitment on funding from the
FAA has been made. As a result of the discussion with the USCBP Port Director and
her staff, it is necessary to move forward with this project as quickly as possible to
avoid the Airport losing its User Fee status.
Funds are available in account no. 415-6400-56061, Customs Remodel, which is
funded by Airport Revenues. No General Fund monies will be used.

I HEREBY CERTIFY that this Minute Order, approving an agreement with
B.E. McMurray Construction, Inc for the construction of a General Aviation
Processing (GAP) facility at the Palm Springs International Airport in the
amount of $396,000, was adopted by the City Council of the City of Palm
Springs, California, in a meeting thereof held on the 2n1 day of June, 2004.
