Ready, City Manager C m BY: Department of Planning Services O SUMMARY The City Council will consider an amendment to an approved Planned Development District to establish a Special Sign District under Section 93.20.05(C)(8) of the Palm m Springs zoning Code (PSZC). The Sign District is proposed for the Springs Shopping Center to establish design guidelines for all tenants located in the shopping center at Z the northeast corner of Gene Autry Trail and East Ramon Road. A public hearing is required, and notice has been provided. RECOMMENDATION: 1. Open the public hearing and receive public testimony. 2. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE NO. 5.0984 PD 291-A TO AMEND PLANNED DEVELOPMENT DISTRICT FOR THE ESTABLISHMENT OF A SPECIAL SIGN DISTRICT (SP 07-083) FOR THE X SPRINGS SHOPPING CENTER, LOCATED AT THE NORTHEAST CORNER OF GENE AUTRY TRAIL AND EAST RAMON ROAD, ZONE M-1-P, SECTION 17." PRIOR ACTIONS: On July 9, 2007, the Architectural Advisory Committee (AAC) reviewed the proposed project and voted to restudy the sign district. Item No. 1 . B . City Council Staff Report November 14,2007—Page 2 of 6 5.0984 PD-291-A—Amendment for Special Sign District(SP 07-083) pu On July 23, 2007, the AAC reviewed the revised sign district and recommended r approval to the City Council, provided that the following revisions are made: a 1. Reduce the main sign ("The Home Depot") by 25%. 2. Use lower 1/3 of fascia for pad signs. Z 3. Monument Sign Z a. Make the block pylon taller for better proportioning. b. Use 16 inch stack block variation design. Ill The applicant revised the sign district as requested above, except for the reduction of 0 the main sign by 25%. STAFF ANALYSIS: Background The Springs Shopping Center project consists of the development of approximately m 393,000 square feet of commercial development anchored by a Home Depot on a 37- C acre site at the northeast corner of East Ramon Road and Gene Autry Trail. The project site is located adjacent to the Airport to the west, commercial and industrial uses m to the south and east, and single family dwellings to the north. r Project Description 0 According to the Palm Springs Zoning Code 93.20.5.C.8, "special sign districts" may be established by the City Council for commercial and industrial projects, as follows: 8. Special Sign Districts. m Nothing in this section shall prohibit the city council from adopting special sign Z districts as part of a specific plan, redevelopment plan, planned development district or the like when special sign provisions are necessary or appropriate to implement general plan provisions and goals. The proposed Special Sign District is similar to that of a Sign Program; it will allow all tenants within the Springs Shopping Center to identify the number, size, and design of O signs with the aim of complimenting the architecture of the complex. A summary of the _ requested sign types is below: 1. Complex / Monument signs (A total) ^I 2. Individual signs for Tenants (Anchor, Major, Sub Major, Pad & Retail Tenants) a. Wall and Window signs b. Drive through signage (where applicable) c. Temporary signs 0 Zoning Analysis The proposed Sign District for the Springs project creates design criteria for permanent and temporary signs. The Palm Springs Zoning Code (PSZC) was the first avenue used for analysis. Z • Anchor Tenant Wall Signs — This tenant would be allowed a main wall sign of up to 852 square feet on the primary elevation (146 sq. ft allowed by PSZC) and 300 m square feet on the secondary elevation (87.5 sq. ft. allowed by PSZC). 0 • Major Tenant Wall Signs — This tenant would be allowed a main wall sign of up to 200 square feet on the secondary elevation (94.75 sq. ft. allowed for largest Major Tenant by PSZC). • Sub Major Tenant Wall Signs — This tenant would be allowed an unspecified 0 amount of signs at one square foot of sign area per lineal foot of frontage. The largest Sub Major Tenant would be allowed at least one main sign of Ill approximately 195 square feet (74.38 sq, ft, allowed for largest Sub Major Tenant C by PSZC). • Anchor Tenant Window Signs — This tenant would be allowed a potential 500 m square feet of window signage (4 sq. ft. allowed by PSZC). r For the purpose of consistency, the next approach to staffs analysis was the review of 0 similar approvals for similar projects within the vicinity. The two shopping centers -O analyzed against the Springs Sign District are the Lowe's Shopping Center and the Destination Raman Shopping Center. The bold text below indicates the deviations previously approved for the Lowe's and Destination Ramon Shopping Centers. m Lowe's Z The Lowe's Shopping Center is an approximately 12.6 acre site located across the street from the Springs Shopping Center at 5201 E. Ramon Road. The site was granted a Variance to allow additional sign area as follows: Monument sign (Ramon Rd) — One @ 7 ft. high & 47.5 sq. ft. 0 • Main wall sign (facing Ramon Road) — 329 sq. ft. (145.9 sq. ft. allowed) • Main wall sign (facing San Luis Rey) — 200 sq. ft. (118.8 sq. ft. allowed) Additionally the site was granted a sign program to allow two secondary convenience signs. One was a "Garden Center' sign at 44.3 square feet and the other was an "Indoor Lumber Yard" sign at 61.6 square feet. 0 Destination Ramon The Destination Ramon Shopping Center is an approximately 30 acre site located at 5601 Ramon Road. The site was granted a Sign Program which deviated from the sign ordinance as follows: • Monument Sign (Ramon Road) — One @ 12 ft high & 144 sq. ft. in sign area (125 sq. ft. allowed). • Monument Sign (San Luis Rey) — One @ 8 ft high & 64 sq. ft. in sign area. (157.5 sq. ft. allowed) a The two shopping centers have been granted approval for sign area and signs that are Z beyond the limitations of the PSZC. Z To ensure consistency with the PSZC and the above deviations granted for Lowe's and m Destination Ramon, staff is recommending conditions of approval in the attached draft resolution. The following summarizes the Conditions staff is recommending the City Council adopt: • Monument Signs — All Monument Signs shall not be taller than twelve feet high O (excluding block pylon) and have a total sign area not to exceed 144 square feet (including "The Springs" sign). (COA # 16, 17 & 18) M • Anchor Tenant Wall Signs — The main sign on the primary elevation may not C exceed 330 square feet of sign area. The main sign on the secondary elevation may not exceed 200 square feet of sign area. (COA # 5 & 6) m • Major Tenant Wall Signs — The secondary wall sign must meet the requirements r of the PSZC for sign area allotment after fifty square feet. (COA# 8 & 9) O • Sub Major Tenant Wall Signs -- The tenant would be required to follow the requirements of the PSZC for number and sign area permitted. (COA # 10 & 11) • Anchor Tenant Window Signs — The anchor tenant's window signage must conform to the PSZC. (COA 19, 20 & 21) These recommended conditions reflect staffs primary concerns with the proposed sign ITl district. Additional conditions are recommended to ensure the sign district is more Z consistent with the PSZC and easier to administer(see COA # 7, 12, 13, 14, 15 & 22). CONCLUSION: The applicant is requesting a sign district that includes deviations well beyond what the 0 PSZC allows. Staff has analyzed other properties within the vicinity and recommends a set of compromise standards to ensure the proposed sign district would be consistent with previous approvals. WHEREAS, according to Palm Springs Zoning Code 93.20.5.C.8, "special sign districts" may be established by the City Council for commercial and industrial projects, "...as part of a specific plan, redevelopment plan, planned development district or the like when special sign provisions are necessary or appropriate to implement general plan provisions and goals"; and WHEREAS, Excel Property Management (the "Applicant") has filed an application with the City pursuant to Section 94.03-00 (E) of the Palm Springs Zoning Cade, for an amendment to Planned Development District 291 to establish a Special Sign District for permanent and temporary signage; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider an amendment to Case Number 5.0984 consisting of an amendment to Planned Development District 291, was given in accordance with applicable law; and WHEREAS, on July 23, 2007, the Architectural Advisory Committee (AAC) reviewed the proposed project and recommended approval to the City Council; and WHEREAS, on November 14, 2007, a public hearing on the application was held by the City Council in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the meeting on the project, including but not limited to the staff report, and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1: Pursuant to the California Environmental Quality Act (CEQA), the project is Categorically Exempt under Section 15311(a)(Accessory Structures)- Section 2: Pursuant to Section 93.20.5.C.8 of the Palm Springs Zoning -Code, the City Council finds that the proposed Special Sign District includes special sign provisions that are necessary or appropriate to implement general plan provisions and Cr),__19 Resolution No Page 2 goals, as follows: Objective — 3,10 — The continuation of existing and development of new commercial uses which serve the everyday needs of the City's residents and visitors and provide employment for the City's residents and the greater region. Objective — 3.12 — The development of commercial facilities as integrated, attractive "centers", with adequate parking, organized traffic movement for motorists, and safety and convenience for pedestrians. The sign district will support the development and success of a new commercial center by creating an identification district through the use of permanent main signage as core identity to the entrances of the development. The sign district will also allow tenants to be easily identified within the commercial center which will provide for organized traffic movement for motorists, and safety and convenience for pedestrians. Furthermore, the proposed signage was reviewed and recommended for approval by the Architectural Advisory Committee to ensure the finished product is a high-quality design. Section 3: The City Council approves an amendment to Case Number 5.0984, amending Planned Development District 291 to establish a Special Sign District (SP 07- 083) for permanent and temporary signage, subject to the Conditions of Approval attached hereto as Exhibit A. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PROJECT SPECIFIC CONDITIONS Administrative 1. All conditions of City Council Resolution No. 21433 (PD-291) shall be in full force and effect, except as modified below. 2. The proposed development of the premises shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes, ordinances and resolutions which supplement the zoning district regulations. 3. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 5.0984 PD — 291 (SP 07- 083). The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or Resolution No, Page 2 abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. 4. That the property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation sidewalks, bikeways, parkways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner's sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. Planning Department Prior to any issuance of any sign permits, the following revisions to the sign district criteria must be completed to the satisfaction of the Director of Planning Services: 5. The following revisions shall replace the sub-bullets in Section F 1,A.9 "Main Wall Sign" of the Anchor Tenant's Wall Signs: One main sign may be allowed on the primary (south) elevation, provided that: a. The tenant's lease space frontage is located more than 100 feet away from the adjacent road right-of-way; b. There is one lineal foot of lease space frontage per square foot of sign area; c. The sign does not exceed 330 square feet; and d. The sign is architecturally compatible with the building as determined by the Palm Springs Planning Department. 6. The following revisions shall replace the sub-bullets in Section F.1.8 "Secondary Elevation Signs" of the Anchor Tenant's Wall Signs: One main wall sign may be allowed on the secondary (east, or as determined by the Director of Planning Services) elevation, provided that: a. There is one lineal foot of lease space frontage per square foot of sign area; b. The sign does not exceed 200 square feet; and c. The sign is architecturally compatible with the building as determined by the Palm Springs Planning Department. 7. Revise F.2.A "Primary Wall Sign" text to read "Primary Elevation Signs". 8. Revise F.2.B "Major Tenant with secondary elevation" text to read "Secondary Elevation Signs 9. Sub Major Tenants in excess of fifty feet of lease space frontage will be entitled to an additional one square foot of sign area per four lineal feet of lease space frontage in excess of fifty feet, up to one hundred feet and an additional one square foot of sign area per eight lineal feet of lease space frontage in excess of one hundred feet- b. The sign must be architecturally compatible with the building as determined by the Palm Springs Planning Department. 12. The following revisions shall be added to Section FA "Pad Tenant' of Tenant Wall Signs: a. Tenants in excess of fifty feet of lease space frontage will be entitled to an additional one square foot of sign area per four lineal feet of lease space frontage in excess of fifty feet, up to one hundred feet and an additional one square foot of sign area per eight lineal feet of lease space frontage in excess of one hundred feet- b. Remove the following text from the second sub-bullet of F.4: "preview menu board and'. Conformance will be strictly enforced. Any installation of non-conforming or unapproved signs shall be brought into conformance at the expense of the tenant, A. GENERAL REQUIREMENTS 1. Each Tenant shall submit to the Landlord/Property Owner, drawings to be reviewed for conformance with this sign program and overall design quality. Approval or disapproval of sign submittals based on aesthetics of design shall remain the sole right of the Landlord/Property Owner, 2, Each Tenant shall submit for approval, in Landlord's/Property Owner's sale and absolute discretion, before fabrication at least three copies of detailed drawings (on 11" x 17" sheets) indicating the location, size, layout design and color of the proposed signs, including all lettering and/or graphics, prior to submitting to the City of Palm Springs for review and approval 3. Landlord/Property Owner has ten (10) days to review and notify Tenant of approval, conditions of approval or denial, 4. All permits for signs and their installation shall be obtained and comply with local planning, building, and electrical codes. These permits shall be obtained by Tenant or Tenant's representative prior to installation S. Tenant's sign contractor will be responsible for obtaining all required city approvals. 6. No exposed lamps, crossovers, conduits, conductors, transformers or similar devices shall be permitted. 7. All Tenants must have installed approved signs before opening for business. S. Any damage to the building fascia or sign area resulting from the installation or removal of any sign by Tenant will be repaired by the Landlord/Property Owner at the Tenant's expense. 9. All signs shall meet U.L. specifications. 10. Tenants shall be responsible for the fulfillment of all the requirements and specifications set forth in this sign program 11, Before commencing work on property, sign contractor will provide to Landlord/Property Owner an original Certificate of Insurance naming the Landlord/Property Owner as "Additional Insurer". � 7 �� 1 B. GENERAL SPECIFICATIONS 1. Tenant's sign contractor shall have a C-45 license and be insured by an admitted carrier for the total aggregate of$1,000,000.00 and provide proof acceptable to Landlord/Property Owner that Landlord/Property Owner is named as an additional insured on the certificate of insurance. 2. No projection above or below the sign will be permitted. Sign must be within dimensional letter limits as indicated in this sign program. 3. Tenant shall be responsible for the installation and maintenance of its sign. 4. Tenant shall be fully responsible for the operations of the Tenant's sign contractor. 5. Tenant's sign contractor shall repair under Landlord's/Property Owner's supervision, any damage caused by installation. 6. Electrical service to all signs will be connected to Tenant's electrical meter. C. CONSTRUCTION REQUIREMENTS 1. No labels will be permitted on the exposed surface of signs, except those required by local ordinance, which shall be placed in an inconspicuous location. 2. Design, layout, and materials for tenants' signs shall conform in all respects with the sign design drawings included with this sign program. 3. All penetrations of building structure required for sign installation shall be sealed in a watertight condition and shall be patched to match adjacent finish- 4- All signs are required to be individually internally illuminated with 30NU neon gas system or LED illumination-GELcore Tetra LED System. Color to be approved by Landlord/Property Owner. Home Depot color-Red/Orange. 5. The interior of sign shall be painted glossy white. 6. Dual-lite and channel letters shall have a minimum three-quarter(3/4) inch trim cap edge. 7. Letter sides to be finished in automotive enamel finish over primer undercoat. S. Letters to be mounted on exterior side of wall. Electrical system is to be contained in transformer box with flex crossovers on interior wall 9. Tenant wall sign length may not exceed seventy-five (75) percent of lease space frontage. r I o- � 2 D. DESIGN SPECIFICATIONS Tenants are encouraged to be creative in designing their sign. The Landlord/Property Owner requests a"Mixed Media" three (3) dimensional approach combining several different fabrications and lighting techniques in designing their sign. Tenant's sign contractors are encouraged to consider the architectural style of the fapade, the scale of the proposed sign,viewing angles and sight lines when designing. All architectural elements can be limited within the maximum sign height and lengths which may differ from the general guidelines within the criteria. Note: Landlord/Owner at Landlord's/Property Owner's discretion reserves the right to approve or reject any proposed design. The following are acceptable sign designs and lighting,- ]- Standard channel letters 2. Reverse pan channel constructed letters/halo three (3) inch deep 3. Dual-lite channel letters 4. Mixed media/dimensional signs using images, icons or logo's 5, Dimensional geometric shapes 6. Exposed neon if used as an accent or within open faced channel letters 7. Routed aluminum faces with one-half('/2) inch minimum pushed through acrylic plastic. A second surface vinyl overlay is encouraged. 8. LED lighting sources. Colors and font styles will be subject to Landlord's/Property Owner's approval, Logo can signs will be allowed only at the discretions of the Landlord/Property Owner and may not exceed twenty-five (25) percent of the total sign area. TENANT WALL SIGNS 1. Anchor Tenant(100,000 Square Feet or More of Lease Space) A. Primary Elevation Sign (South Elevation) 1. Main Wall Sign • Anchor Tenant signage on South Elevation will be allowed 1.5 square feet of sign area per each lineal front foot of lease hold frontage. • Letter height may not exceed six(6) feet overall height. 2. Secondary Wall Sign (South Elevation) • Anchor Tenant will be allowed secondary wall signage on South Elevation with no more than three (3) secondary wall signs. • Each secondary wall sign may not exceed twenty-four (24) inches in height and no more than fifty (50) square foot of the sign area per each secondary wall sign. (See Exhibits 3, 4 and 5) B. Secondary Elevation Signs (East Elevation) • Anchor Tenant will be allowed secondary elevation signage and will be limited to four (4) feet in overall height. • Square foot of sign area may not exceed one (1) square foot of the sign area per each lineal front foot of lease hold space. • No secondary wall signs will be allowed. 2. Major Tenant (99,999 to 25,000 Square Feet of Lease Space) A. Primary Wall Sign 1. Main Wall Sign Tenant will be allowed one (1) square foot of sign area per each lineal foot of lease space frontage with a maximum of one (1) wall sign for their primary elevation. Major Tenant with Frontages facing a street or parking lot. Square foot of sign area per each lineal foot of lease space frontage will be calculated by the following: • Major Tenant in the excess of fifty (50) feet of lease space frontage will be entitled to an additional one (1) square foot of sign area per four(4) lineal feet of lease space frontage in excess of fifty (50) feet, up to one hundred (100) feet and an additional one(1) square foot of sign area per eight (8) lineal feet of lease space frontage in excess of one hundred (100) feet. • Major Tenant primary wall sign shall not exceed four(4) feet in overall height. 2. Secondary Wall Sign •• Major Tenant will be allowed secondary wall signage. No more than two (2) additional secondary wall signs may be allowed. •• Major Tenant secondary wall signs may not exceed twenty-four(24) inches in height. •• Each secondary wall sign may not exceed the allowed sign area and/or fifty (50) square feet of the sign area per each sign- 4 B. Major Tenant with secondary elevation • Major Tenant that has an additional elevation facing a street (West Elevation) may be allowed an additional wall sign. • Sign area to be allowed will be one (1) square foot of the sign area per each lineal front foot of the lease hold space, but not to exceed two hundred (200) square feet of the sign area. • No secondary wall signs are allowed. • A.maximum letter height of four (4) feet high for secondary elevation wall sign. 3. Sub Major Tenant (24,999 to 1.0,000 Square Feet of Lease Space) A.Primary Wall Sign Sub Major Tenant will be allowed one (1) square foot of sign area per each lineal foot of lease space frontage with a maximum of one(1) wall sign for their primary elevation. • Sub Major Tenant in the excess of fifty (50) feet of lease space frontage will be entitled to an additional one (1) square foot of sign area per four (4) lineal feet of lease space frontage in excess of fifty (50) feet, up to one hundred (100) feet and an additional one(1) square foot of sign area per eight(8) lineal feet of lease space frontage in excess of one hundred (100) feet. • Sub Major Tenant primary wall sign shall not exceed four(4) feet in overall height. • No secondary wall signs will be allowed. B. Secondary Elevation Wall Signs + Tenant with elevations (two (2) or more) facing a street or parking lot will be allowed secondary elevation signs. • Wall signs may not exceed three (3) feet in overall height. • Square footage for secondary elevation signs will be calculated at one(1) square foot of the sign area per each lineal front foot of the lease hold space. • No secondary wall signs will be allowed. 4. Pad Tenant Pad Tenant will be allowed one (1) square foot of sign area per each lineal foot of lease space frontage with a maximum of one (1) wall sign for their primary elevation. Pad Tenant will be allowed signage on four(4) sides of the building as long as each elevation faces a street or parking lot. Pad Tenant wall sign height shall not exceed three (3) feet in overall height for single or double line of copy. There may not be more than one (1) wall sign per elevation. • Pad Tenant that are food uses and have drive thru windows will be allowed menu boards and directional signage. • Square footage of preview menu board and menu boards may not exceed thirty-two (32) square feet of sign area and six (6) feet in overall J height 1 5 • Overall square foot of directional signs may not exceed 4.5 square feet of sign area and four(4) feet overall height. • Pad Tenant may not have more than four(4) directional 5. Retail Tenant(In-Line Tenant 9,999 Square Peet or Less of Lease Space) In-Line Tenant will be allowed one (1) square foot of sign area per each lineal foot of lease space frontage with a maximum of one (1) wall sign for their primary elevation. Secondary wall signage will be allowed for In-Line Tenant with frontages facing a street or a parking lot. Square foot of sign area per each lineal foot of lease space frontage will be calculated by the following: • In-Line Tenant in the excess of fifty (50) feet of lease space frontage will be entitled to an additional one (1) square foot of sign area per each four(4) lineal feet of lease space frontage in excess of fifty (50) feet, up to one hundred (100) feet and an additional one (1) square foot of sign area per eight(8) lineal feet of lease space frontage in excess of one hundred (100)feet. • In-Line Tenant primary elevation not to exceed three (3) feet. Monument Sign Type A (Tenant must be 20,000 square feet or more to obtain sign rights to Tenant Panels) • Square footage of tenant sign panel on monument sign may not exceed one hundred twenty-five (125) square feet. • Overall height of monument sign to be eighteen (18) feet, one(1) inch Tenant sign copy area overall height not to exceed thirteen (13) feet. • Monument structure to be fabricated from split-face concrete masonry units and painted to match Home Depot building (ICI No. 211, "Brickdust", MP# 50YR 25/142) • Steel column to be twelve (12) inches in diameter with a powder coated anodized finish. • Tenant panels and cabinet to be fabricated from .090 inch thick aluminum and painted to match Home Depot building (ICI No. 485, "Eldorado Tan", MP# 1OYY 61/136) • Tenant sign copy to be routed-out with one (1) inch pushed through acrylic plastic with second surface vinyl overlay. • Provide 800 MA fluorescent lighting for internal illumination. • Monument sign shopping center identification to be open-face channel letters, with exposed neon tube illumination-color of neon to be determined. 2. H. MISCELLANEOUS REQUIREMENTS Anchor Tenant(100,000 square feet or more of Lease Space) shall be permitted to place upon each entrance of its premises, decal application signage not to exceed 50% of the total glazing area, indicating hours of operations, emergency telephone numbers, tenant identification and other similar information. 1. Anchor Tenant will submit to Landlord/Property Owner their proposed hours of operation, emergency telephone numbers, tenant identification and other similar identification on an eleven(11) inch by seventeen (17) inch layout showing size, colors and type of application. Anchor Tenant will not be limited to In-Line Tenant's specifications. a. All other Tenant shall be permitted to place upon each entrance of its premises, not more than four (4) square feet of gold leaf decal application lettering, not to exceed four (4) inches in height, indicating hours of operation, emergency telephone numbers, tenant identification and other similar identification. 2. Identification (address) numbers shall be applied to buildings in compliance with local jurisdiction regulations and in accordance with specifications to be supplied by Landlord/Property Owner. 3. Except as provided herein, no advertising placards, banners, pennants, names, insignia trademarks or other descriptive signs or materials shall be affixed or maintained upon the glass paue supports of the show windows and doors, or upon the exterior walls of the building, without the prior written approval of the Landlord/Property Owner and the City of Palm Springs. 4, No signage projections beyond the Sign Area will be permitted. The Sign Area is to be held to within the limits as indicated by the Landlord/Property Owner and the criteria. 5. No animated, flashing or audible signs will be permitted. 6. Immoral or Unlawful Advertising: Signs shall not exhibit, post or display anything of an obscene, indecent, or immoral nature or unlawful activity. 7. Temporary signs may be permitted subject to Landlord/Property Owner and the City of palm Springs Planning Department approval and shall be in conformance with sections 93,20.08 (A) (3), 93.20,08 (A) (4), and/or 93.20.08 (A) (5) of the City of Palm Springs zoning code. S. Signs on'Vehicles: No person shall drive, operate, move in or along, or park on any street or on public or private property, any truck, trailer, carriage, wagon, sled or other vehicle on which is attached or maintained any sign displaying any commercial or noncommercial advertising matter for the sole or primary purpose of displaying such advertising matter, except for the following: 7 a. The driving, operation and movement of vehicles displaying political campaign advertisements for candidates for public office and ballot measures, provided, the same is not otherwise prohibited by this section- b. The identification of a business enterprise upon a vehicle used primarily for the purpose of and in the usual business of the owner for transporting or servicing goods or persons for commercial or other business purposes, provided that, the identification is painted on or otherwise affixed so as not to project from the unusual profile of the vehicle. c. The incidental display of noncommercial stickers, plates, license plate brackets, and the like; or of customary small identifications on license plate brackets or elsewhere, of vehicle manufacturers, models or types of vehicle, or dealers or entities from whom vehicles bearing the same were purchased or otherwise obtained. 9. Tenant's sign contractor shall be liable for repairs and any work damaged by their activity. 10. The entire signage display shall be guaranteed for a period of one(1) year against defects in materials and workmanship. Defective parts shall be replaced at no charge. 11. Any signs not in conformance with the Criteria and all local jurisdiction regulations are subject to rejection and removal at the Tenant's expense. 12. Tenant signs installed without approval from the Landlord/Property Owner and the City of Palm Springs including the issuance of building permit(s) is subject to rejection and removal at Tenant's expense. Tenant is responsible for any fines or citations issued by the City's code enforcement agency. �a 8 I.
