PALM SPRINGS STADIUM CONCERT POLICY Director Heider said that this matter is being brought to the commission for discussion at the request of Chair McCormick.She reviewed the staff reportwith the commissioners and distributed copies of an April 5,1995 staff report to City Council, which recommended that City Council approve a policy prohibiting band concerts in Palm Springs (Angel)Stadium with the exception of concerts associated with approved sporting events and/or the July 4`"celebration. Director Heider said that prior to 1995, a number of concerts were held at the stadium; however, issues arose with using that facility for concerts, such as its proximity to residential and commercial neighborhoods, including nursing homes and an assisted living complex, the capacity of the adjoining parking and restroom facilities, and the noise created by concerts, which affect those residents. Staff also identified a number of complaint calls to City Council Members and staff of the Police and Parks and Recreation departments when concerts were held in the stadium. In 2000,the Parks and Recreation Director at the time made a presentation to City Council about having a"Santana" concert in the stadium.This concept was rejected by the City Council based on the historic impacts to the community. Director Heider said that at the July 11 Parks and Recreation Commission, a local radio station inquired about the use of the stadium for youth concerts and Chair McCormick has requested discussion of recommendation to City Council to repeal the ban on concerts and allow a limited number of youth concerts that would end at 8:00 p.m. After discussion,a motion was made and seconded to ask City Council to review the current stadium concert policy to allow teen/youth concerts that are recommended by the Parks and Recreation Commission and reviewed by the City's Special Events Planning Team(SEPT) until 8:00 p.m. M/S/C (McCormick/Meredith)610 (Sims not present at time of vote) B. BASKETBALL HOOPS AT 13ARISTO PARK Director Heider reviewed a July 26 memorandum from her to Assistant City Manager Troy Butzlaff regarding the removal/installation of basketball hoops at Baristo Park. She said that approximately three or four years ago, staff began receiving phone calls from the residents in the area about people playing basketball at the park at2:00 a.m.and disturbing their sleep, and reports of other illegal and/or unsavory activities were also received. The department's director at that time instructed staff to remove the basketball hoops.Within a couple of months,staff received calls from people complaining that their children had no place to play basketball now that the hoops were gone, so staff reinstalled the hoops.This"take down"/"put back up' scenario continued for the next several years,until the director Finally said the hoops should be taken down permanently. Director Heider said that several months ago, Council Member Chris Mills asked that this matter be considered by the commissioners. Discussion followed, with several commissioners making suggestions as to howto handle the noise and illegal/unsavory activities.Manager Oltean also suggested that the person filling the new Park Ranger position could assist with this situation. After additional discussion, a motion was made and seconded to reinstall the basketball hoops at Baristo Park and request that the 10:00 p.m. closing time be enforced by regularly scheduled patrol by the Police Department and additional signs to patrons about the closing time. General Comments Commissioner Aiello asked about the status of allowing dogs in the park.Director Heider Said that with other urgent mattters taking precedence,this matter has not gone before City Council as yet;however,she will take this to City Council in the next month or so Commissioner Aiello said that he has noticed that the gym equipment at the Wellness Park is well used. He also asked that the sprinklers at Ruth Hardy Park along Tamarisk Road and Avenida Caballeros be adjusted so they do not spray the sidewalks.He also suggested that because coyotes have been seen in the area,lights be placed along the sidewalks at Ruth Hardy Park; this will allow for better visibility for those people walking in the area. COMMISSION (Continued) 1. General Comments(Continued) Commissioner Aiello asked forwhat purpose the two 12'x 15'pads at the southeast corner of the Wellness park were designed. Director Heider said she will check the plans and advise at next month's meeting. Commissioner Meredith said she likes what is being done with the tree wells in the downtown area.Director Heider said that Facilities Division staff and Economic Development Administrator Cathy Van Horn are responsible for these changes. Commissioner Meredith asked that she be advised about the"historic'banners in the downtown area and when they will be reinstalled. Commissioner Sullenger asked about the response to the new trash containers downtown. Director Heider said that opinions have been mixed.She said that some people do not like to touch the trash cans and some articles, such as pizza boxes, do not fit the openings Commissioner Meredith suggested that since there are no recycling bins downtown, perhaps every other trash containers could be marked as a recycling bin. Director Heider said that there are some recycling bins downtown, but people do not use them properly by placing wrong types of items, such as food and drinks,in them.Therefore, when all of the bins are collected and dumped into the main container,all of those recyclable items are ruined and Cannot be recycled.Commissioner Meredith asked that this matter be placed on next month's commission agenda. Director Heider said she will ask Recycling Coordinator Gary Calhoun to attend the meeting. 2. Committee Reports a. YouthITeen Activities None. b. Trails Maintenance Chair McCormick said he was contacted by a man from hikelocal.com.When Chair McCormick checked that website, he said he found that Palm Springs trails were listed with Los Angeles and other cities. Chair McCormick called the man and was told that Palm Springs trails will be separated into a list of its own.When the City's website is redesigned, Chair McCormick would like a link listed to the hikelocal.com website. C. STAFF I. DeMuth Park Batting Cages Update Director Heider said there have been discussions regarding demolishing this site and the costs range from $23.000 to $40,000. Staff has received calls about homeless persons living at the facility and much of the facility has been vandalized.She asked if the commission's recommendation would be to demolish the facility and,if so,should the concrete be left.She noted that there are positives and negatives in leaving the concrete. The positive would be that if another batting cage facility was established,there would be some cost savings; the negative would be that youth could use it for skateboarding and graffiti.If the concrete is removed,turf could be placed there.Commissioner Sims suggested that this area be used for a BMX track.After discussion,staff was directed to demolish the facility and remove the concrete. 2. Director's Report Director Heider asked if there were any questions regarding the Director's Report;there were none. Coordinator Cirone-Collier then brought the commissioners up to date with all of the concerts and special events that are and will be taking place until the end of the years. She distributed several flyers regarding the concert series that started on Tuesday,September 11.Director Heider asked if any commissioner would like to participate in the concert series by welcoming the attendees and introducing the musicians. Commissioners Sullenger, Meredith and Starke said they would volunteer.Coordinator Cirone-Collier will contact them regarding dates,times, and duties. Director's Report(Continued) Director Heidersaid thatthe reason we did not meet at the Tahquitz Creek Golf Resort as originally planned is that Golf Club Drive is closed. She said that she will attempt to get next month's meeting scheduled for that location. ADJOURNMENT! There being no further business to come before the commission,the meeting was adjourned at 3:45 p.m. The next regularly scheduled meeting of the commission will be held at 2:30 p.m. on Wednesday, October 10,2007, at a location to be determined. Ready, City Manager BY: Department of Parks and Recreation SUMMARY Concerts are currently prohibited at the Palm Springs Stadium. Mayor Oden had requested that this issue be agendized to consider whether to amend the existing policy to allow limited types of concerts, particularly those intended for youth/teens, with a time limit of 8:00 P.M. The Parks and Recreation Commission has also considered this matter and recommends approval of a policy change. RECOMMENDATION: Consider this matter and if acceptable direct staff to prepare a resolution amending the existing policy to allow for limited types of concerts, particularly those intended for youth, to be held at the Palm Springs Stadium under certain conditions. STAFF ANALYSIS: Palm Springs Stadium was originally constructed with bond funds for professional baseball and while it has generally been used in that capacity, there have been exce0ions over the years. Events such as the Mounted Police Rodeo and July 4 celebration have been held. Also, prior to 1995, several band concerts were held at the stadium. Previously, issues associated with concerts at the Stadium have been related to noise levels, particularly due to the proximity of residences and certain businesses, including nursing homes and an assisted living complex. Hence, in April 1995, the City Council approved, by Minute Order, a policy that prohibits "primary" band concerts in the stadium, with the exception of "secondary" concerts associated with approved sporting events and/or the July 4 celebration. Item 5 . E . City Council Starf Report November 14, 2007-Page 2 Palm Springs Stadium Concert Policy The Parks and Recreation Commission considered this issue at their September 12, 2007 meeting. Following discussion, a motion was passed to unanimously recommend that the City Council amend the current policy to allow for concerts specifically oriented to teen/youth. The proposed modification includes a time limit of 8:00 p.m. It was also recommended that any such concert proposals be submitted to the Parks and Recreation Commission for review and recommendation to the City. FISCAL IMPACT: No fiscal impacts are associated with changing this policy.
