Ready, City Manager BY: Department of Planning Services SUMMARY The project is an amendment to the Palm Springs Zoning Code which would change "transportation terminals" from a use permitted by right in the C-2 and M-1 zones to a use subject to approval of a Conditional Use Permit. A public hearing is required. RECOMMENDATION: 1. Open the public hearing and receive public testimony. 2. Waive further reading and adopt Ordinance No. 1726, "AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 91.00.00, SUBSECTION D OF SECTION 92.14.01, AND SUBSECTION D OF SECTION 92.17.01, AND REPEALING PARAGRAPH 20 OF SUBSECTION A OF SECTION 92.14.01 AND PARAGRAPH 10 OF SUBSECTION A OF SECTION 92.17.01 OF THE PALM SPRINGS MUNICIPAL CODE, RELATING TO THE ESTABLISHMENT OF TRANSPORTATION TERMINALS AS A USE PERMITTED PURSUANT TO CONDITIONAL USE PERMIT IN THE C-2 AND M-1 ZONES." On October 17, 2007, the City Council enacted an urgency ordinance prohibiting transportation terminals in the C 2 and M-1 Zones. The Council directed staff to prepare an ordinance amendment for consideration by the Planning Commission and City Council. The ordinance was later extended by Council action. On November 14, 2007, the Planning Commission conducted a public hearing and adopted a recommendation (7 to 0) to allow transportation terminals subject to a Conditional Use Permit in the C-2 and M-1 Zones. City Council Staff Report Page 2 of 2 5.1180—Zoning Ordinance Amendment—Transportation Terminals in the C-2 and M-1 Zones December 12,2007 STAFF ANALYSIS: The proposed ordinance would alter how "transportation terminals" are treated in the C- 2 General Commercial and M-1 Service / Manufacturing zones. The ordinance would remove "transportation terminals" from the list of permitted uses in C-2 and M-1 zones, and require that a Conditional Use Permit be obtained before the use could be established in these zones. The Planning Commission reviewed the proposed change and concurred that a Conditional Use Permit would be an appropriate oversight mechanism for transportation terminals. The Commission concluded that the CUP would assure that site-specific and neighborhood impacts could be evaluated and addressed on a case-by-case basis. ENVIRONMENTAL DETERMINATION Staff has evaluated the potential environmental impacts of the proposed amendment ("project") and determined that the project is exempt pursuant to the "General Rule" [Section 15061(b)(3)] that CEQA applies only to projects that have the potential to cause a significant impact on the environment. The proposed amendments are process-oriented, requiring additional levels of review through the permit process for each applicable future project. Consequently, there is no possibility that the proposed amendments could have a significant effect on the environment. CityAttorney's Summary The Palm Springs Municipal Code does include a definition of "Transportation Terminals," a use that is permitted in the C-2 and M-1 Zones. This Ordinance will add a definition of "Transportation Terminals"and allow such use in the C-2 and M-1 Zones subject to a conditional use permit. The City Council of the City of Palm Springs ordains: SECTION 1. The following definition of the term "Transportation Terminals' is added to Section 91.00.00 of the Palm Springs Municipal Cade: "Transportation Terminals" means facilities for loading, unloading, and transferring passengers, baggage, and incidental freight between modes of transportation. This classification includes but is not limited to bus terminals and public transit stations. SECTION 2. Subsection D of Section 92.14.01 is amended by adding "Transportation Terminals" as a use permitted subject to a conditional use permit in the CC Zone. SECTION 3. Subsection D of Section 92.17.01 is amended by adding "Transportation Terminals" as a use permitted subject to a conditional use permit in the M-1 Zone. SECTION 4. Paragraph 20 of Subsection A of Section 92.14.01 is repealed. SECTION 5. Paragraph 10 of Subsection A of Section 92.17.01 is repealed. SECTION 6. Ordinance Nos. 1725 and 1727 are repealed. SECTION 7. Presently, transportation terminals are permitted "by right" in these zones. The proposed amendment would require approval of a conditional use permit by the Planning Commission before such use could be established. A public hearing is required. RECOMMENDATION That the Planning Commission conduct a public hearing and forward to the City Council a recommendation to require a conditional use permit for transportation terminals in the C-2 and M-1 zones. PRIOR ACTIONS On October 17, 2007, the City Council enacted an urgency ordinance prohibiting transportation terminals in the C-2 and M-1 zones. BACKGROUND AND ANALYSIS In response to concerns that transportation terminals, including bus stations, may cause adverse traffic and other impacts on surrounding properties, the City Council adopted an urgency ordinance to prohibit the establishment of such terminals. In addition, the Council initiated a zone text amendment and directed staff and the Planning Commission to consider regulatory options, including requiring a conditional use permit for any new transportation terminal. A draft ordinance has been prepared that would require a CUP in the C-2 and M-1 zones for transportation terminals. The Commission may consider other options, including the use of Land Use Permits or the prohibition of such use in these zones. Staff believes that the underlying nature of both the C-2 General Commercial and M-1 Service / Manufacturing Zone is generally appropriate for transportation terminals. However, individual site and neighborhood conditions need to be evaluated against traffic, noise, lighting, outdoor assembly, and other effects of transportation terminals. The conditional use permit provides the appropriate means for addressing site-specific issues, including the requirement for environmental review (CEQA) and a noticed public hearing to allow neighborhood input.
