SUBJECT: PALM SPRINGS STADIUM CONCERT POLICY

SUMMARY
On November 14, 2007, the City Council directed staff to prepare a resolution to
allow youth concerts at the Palm Springs Stadium. This action authorizes the use
of the Palm Springs Stadium for youth concerts under certain conditions
including a cut-off time of 8:00 pm.
RECOMMENDATION:
1. Adopt Resolution No. "A Resolution of the City Council of the City of
Palm Springs Authorizing a Policy to use the Palm Springs Stadium for
Teen/Youth Concerts ending at 8:00 p.m.".
2. Authorize the City Manager to sign all documents necessary to effectuate
this action.
STAFF ANALYSIS:
Palm Springs Stadium was originally constructed with bond funds for
professional baseball and, while it has generally been used in tkat capacity,
there have been exceptions over the years. Events like the July 4 celebration
have been held and, prior to 1995, several band concerts were also held at the
stadium.
In April 1995, the City Council approved a policy that prohibits "primary" band
concerts in the stadium, with the exception of "secondary" concerts associated
with approved sporting events and/or the July 4 th celebration.
Recently, the Parks and Recreation Commission had a tentative request to use
the stadium for youth concerts. Since the commission is seeking ways to
increase youth programs, the matter was brought before the Parks and

Council review the current Palm Springs Stadium concert policy to allow
teen/youth concerts that are recommended by the Parks and Recreation
Commission and reviewed by the City's Special Events Planning Team (SEPT)
until 8:00 p.m.
On November 14, 2007, the City Council considered this item and directed staff
to prepare a resolution allowing youth concerts in the Palm Springs Stadium with
certain conditions. These conditions include a time cut-off of 8:00 p.m. and a
limitation on the number of people in attendance. In addition, all requests to hold
youth concerts at the Palm Springs Stadium must be reviewed and approved by
the Parks and Recreation Commission.
FISCAL IMPACT:
Although youth/teen concerts may create new revenue, the actual amount of
revenue generated is not entirely known at this time.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS
CALIFORNIA, AUTHORIZING A POLICY TO USE THE. PALM
SPRINGS STADUIM FOR TEEN/YOUTH CONCERTS ENDING
AT 8:00 P.M.
WHEREAS, the City endeavors to promotes cultural and artistic events for the
benefit of our residents and visitors; and
WHEREAS, the City desires to provide appropriate and appealing events to
engage our youth; and
WHEREAS, the Palm Springs Stadium would provide a venue to host teen/youth
concerts.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. CONCERT POLICY FOR PALMS SPRINGS STADIUM
a. Application to provide a teen or youth concert shall be made to
the Department of Parks and Recreation-
b. The application shall include a letter of intent or proposed
contract, state the names of the performers, description of the
show, targeted audience, where the event will be advertised,
and anticipated number of attendees.
c. The applicant shall meet with the City's Parks and Recreation
Director or designee, and the Neighborhood Liaison if deemed
appropriate, to consider the event, and prepare a preliminary
estimate of required City services for use by the promoter and
consideration by the Parks and Recreation Commission.
d. The application shall be reviewed by the Parks and Recreation
Commission, who will either approve or disapprove the request.
Appeal of this decision may be made in writing to the City
Manager. The City Manager's opinion will be final.
e. The applicant will meet with the City's Special Event Planning
Team (SEPT) to coordinate the needs of the event and confirm
the preliminary estimate and adjust as necessary.
f. Events must conclude by 8!00 p.m. and the City reserves the
right to control concert volumes based on readings registered

on monitoring devices. A city designee shall be available at
sound checks and at the event to monitor noise levels.
g. The maximum attendance per day shall not exceed 5,000.
h. Within seven (7) working days following approval of the event,
Promoters shall submit a refundable deposit of $2,500 to be
held as security against violation of City policies. The deposit
shall be in the form of cashiers check, cash or money order,
personal checks are not acceptable. The $2,500 shall be
forfeited should any of the City policies be violated.
i. The estimated fees, including rental, police, parks personnel,
fire, building maintenance personnel, shall be paid and proof of
insurance provided two weeks prior to the event.
I. A pre-event meeting shall be called no later than seven (7)
working days prior to the concert. This meeting will include the
promoter, representatives from City Police, Fire, Building, Parks
and Recreation, and others deemed necessary by the Special
Event Coordinator. This meeting will finalize all plans and
confirm permits.
