December 19, 2007 Consent Agenda SUBJECT: CONSTRUCTION PROJECT OWNER'S REPRESENTATIVE — ADD TO 2007-08 HOURLY PROJECT ASSIGNMENTS FROM: David H. Ready, City Manager BY. City Manager SUMMARY The City has under contract an Owner Representative for construction project administration and this action item will provide additional Project Assignments for 2007- 08. RECOMMENDATION: 1. Approve Amendment No. 1 to Agreement No. 5488 adding construction project administration hourly assignments for 2007-08 for the City's Owner Representative, Allen F. Smoot & Associates. 2. Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The City, in June of 2007, entered in Agreement No. A5488 with Allen F. Smoot & Associates to provide Owner Representative services for a variety of City construction projects. The contract contemplated both full-time large construction projects, such as the current hold-room project, as well as smaller hourly projects such as the demolition of the temporary hold-rooms. The larger projects are compensated based on a flat fee and the smaller projects are compensated based on an hourly rate. The larger projects are assigned to the contract when actual project construction contracts are awarded by the City. For the smaller projects the contract contemplates that the City Manager would make the work assignments, however, City Council approval must establish the funding. Item No. 2 . N . City Council Staff Report December 19, 2007 -- Page 2 Owner Representative 2007-08 Project Assignments Amendment No. 1 is attached for City Council consideration that would approve a list of additional Capital Improvement hourly projects for 2007-08 and would approve funding for those projects by invoking the City Manager authority to approve Purchase Orders to cover the specific work. FISCAL IMPACT: The funding for the services contemplated in the Amendment will come from Bond Proceeds as well as other project specific capital accounts. David H. A5488 — OWNER REPRESENTATIVE SERVICES THIS FIRST AMENDMENT to Agreement No. 5488 for consulting services, (herein "Amendment") made and entered into on the _day of , 2007, by and between the CITY OF PALM SPRINGS (herein "City") and ALLEN F. SMOOT & ASSOCIATES (herein "Consultant') is hereby amended effective as follows: RECITALS WHEREAS, City and Consultant entered into that certain Consulting Services Agreement No. 5488 for Owner Representative Services ("Agreement"), as duly amended from time to time; and WHEREAS, the parties wish to amend the Agreement to add work assignments. NOW, THEREFORE, for good and sufficient consideration, the parties agree as follows. Section 1. Exhibit "B" is hereby amended to read as follows: EXHIBIT "B" SCHEDULE OF COMPENSATION AND WORK ASSIGNMENTS Consultant shall be compensated monthly based on the following: Monthly Rate Schedule: On all construction projects that are assigned to consultant for owner representative services Consultant shall be paid a flat rate of $15,500 commencing on the date that the City Council awards the construction contract for the specific project and shall continue sixty (60) days following the recording of the Notice of Completion for the project. HourlV Rate Schedule: For pre-construction services Consultant shall be paid an hourly rate of $132 per hour for all work performed at the request of the City. Work Assignments: The following project work assignments shall be carried out by the Consultant: Protect Title/Description Not to Exceed Account No. 1. Animal Shelter/Pre-construction $46,200 Bond Proceeds 2. Triangle Parcel/Pre-construction 13,200 Project Spec. Acct. 3. Driving Range/Pre-construction 10,560 Project Spec. Acct. 4. Convention Center Parking 13,200 Project Spec. Acct. Pre-construction Amendment No. 1 To Agreement No. A5488 Project Title/Description Not to Exceed Fee Account No. 5. Miscellaneous Downtown Projects 15,840 Project Spec, Acct, 6. Miscellaneous Special Projects 26,400 Project Spec. Acct. TOTAL $125,400 Rate Adjustment: For both of the above rates, they shall be adjusted on each one year anniversary of this Agreement based on the previous years CPI. Section 2. Full Force and Effect: Except as previously modified herein, all other provisions of the Agreement shall remain unmodified in full force and effect.
