EXTENDING TERM OF THE JULY 1, 2000 - JUNE 30, 2004
MEMORANDUM OF UNDERSTANDING (MOU)
BETWEEN THE MUNICIPAL EMPLOYEE RELATIONS
REPRESENTATIVE (MERR) AND THE
PALM SPRINGS POLICE OFFICERS' ASSOCIATION (PSPOA)
REPRESENTING THE POLICE SAFETY UNIT
1. The City of Pahn Springs (hereinafter the "City") and the Palm Springs Police
Officers' Association (hereinafter "PSPOA") previously entered into an
agreement entitled Memorandum of Understanding (MOU) Between The
Municipal Employee Relations Representative (MERR) And The Palm Springs
Police Officers' Association (PSPOA) Representing The Police Safety Unit dated
July 19, 2000. Article 33 of that MOU defined the term of the MOU to be July 1,
2000 through June 30, 2004.
2. In anticipation of the expiration of the current MOU, the parties have been
negotiating in good faith pursuant to the provisions of the Meyers-Milias-Brown
Act to reach agreement on a new MOU to take effect upon the expiration of the
current MOU. These negotiations, however, will not be completed prior to the
expiration date of the current MOU. Yet, the parties desire to maintain the current
MOU for at least three additional months to allow additional negotiation time.
Accordingly, the current MOU term must be extended to accomplish this desire.
3, Therefore, the parties have met and conferred in good faith and have jointly
prepared this Side Letter of Agreement extending the teen of the current MOU by
three months. Furthermore, ARTICLE 33 — TERM OF AGREEMENT of the
MOU is hereby amended such that the text thereof is deleted in its entirety and
replaced with the following:
"The tern of this Agreement shall be E-om July 1, 2000 through
September 30, 2004."
4. In light of the extension of the current MOU, the City's representatives and the
PSPOA's representatives have also reached an understanding that any negotiated
wage increases for the 2004-2005 fiscal year contained in any ensuing MOU shall
be retroactive to July 1, 2004.

5. The City's representatives and the PSPOA's representatives have reached the
understanding reflected by this Side Letter and agreed to recommend same to
their respective representative bodies. The parties jointly urge City Council to
adopt this Side Letter by resolution, which will provide for the MOU changes
contained herein. The parties hereto acknowledge that this Side Letter shall not
be in full force and effect until adoption by the City Council.
Subject to the foregoing, this Side Letter is hereby executed by the authorized
representatives of the City and the PSPOA and entered into this 30th day of June, 2004.

I HEREBY CERTIFY that this Minute Order, approving a side letter of Agreement
extending term of the July 1, 2000 — June 30, 2004 Memorandum of
Understanding (MOU) between the Municipal Employee Relations
Representative (MERR) and the Palm Springs Police Officers Association
(PSPOA) representing the Police Safety Unit was adopted by the City Council of
the City of Palm Springs, California this 30th day of June, 2004.
