Yp ALM SA4 ry v � w w CITY COUNCIL STAFF REPORT DATE: February 6, 2008 CONSENT CALENDAR SUBJECT: REINSTATING THREE-HOUR TIME LIMITS IN THE PLAZA MERCADO PARKING LOT_ FROM: David H_ Ready, City Manager BY: John Raymond, Director Community & Economic Development SUMMARY This action reinstates three-hour time limits in the Plaza Mercado parking lot, which is currently unrestricted. RECOMMENDATION: Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REINSTATING THREE-HOUR TIME LIMITS IN THE PLAZA MERCADO PARKING LOT. STAFF ANALYSIS: The suspension of the parking time limits in City-owned lots has been in place since June 2005. On June 27, 2007 the City Council adopted Resolution No. 21961 to continue the suspension of the enforcement of time limits on parking automobiles in City-owned parking lots, until June 30, 2008- At the request of certain business owners, Council also adopted Resolution No. 21826 reinstating two-hour time limits on Indian Canyon Drive between Saturmino Road and Andreas Road, which is also in effect until June 30, 2008. The June 27, 2007 Staff Report and Council"s discussion referred to the request of the Plaza Mercado business owners to reinstate time limits if there continued to be an adverse effect in that parking lot. The lot continues to fill up in the early morning and remains full throughout the day. Under the terms of the Plaza Mercado DDA, the property owner has a right to restrict half the spaces in the lot for private use, but has agreed not to do so pending a decision by the City to work through a parking study for the entire downtown. The consensus of Council at the June 27, 2006 meeting was to wait on conducting the comprehensive parking study in the downtown until the timing of ITEM NO.�— City Council Staff Report February 6, 2008 — Page 2 Parking the major redevelopment activities became more clear; continue the unrestricted parking time limits that are currently in place; and, bring back to Council recommendations to address specific problems, such as the Plaza Mercado lot. Main Street Palm Springs evaluated the request from the tenants and property owner of Plaza Mercado at their December 21, 2007 Executive Meeting. The Executive Board voted in favor to support reinstatement of the three-hour time limits of the Plaza Mercado parking lot. Attached are letters from the five major tenants and the property owner requesting that time limits and enforcement be reinstated in the Plaza Mercado parking lot. Staff recommends adopting the Resolution to reinstate three-hour time limits in the Plaza Mercado lot and to enforce the time limits according to the City's established hours of operation and enforcement policy. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REINSTATING THREE- HOUR TIME LIMITS IN THE PLAZA MERCADO PARKING LOT The City Council of the City of Palm Springs finds. A. On June 8, 2005 the City Council adopted Resolution 21286 suspending the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of June 9, 2005 and September 30, 2005_ B. On September 21, 2005 the City Council adopted Resolution No. 21414 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of October 1, 2005 and December 31, 2005. C. On December 14, 2005 the City Council adopted Resolution No. 21480 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned parking lots between the dates of January 1, 2006 and June 30, 2006. D. On September 20, 2006 the City Council adopted Resolution No. 21718 extending the suspension of the imposition and enforcement of time limits on parking of automobiles on City owned lots and on Indian Canyon Drive and Belardo Road from Ramon Road north to Alejo Road until June 30, 2007. E. On February 7, 2007 the City Council adopted Resolution No. 21826 reinstating two-hour time limits on Indian Canyon Drive between Saturmino Road and Andreas Road. F. On June 27, 2007 the City Council adopted Resolution No.21961 extending the suspension of two-hour time limits on portions of Indian Canyon Drive and Belardo Road from Alejo Road to Ramon Road; and downtown city-owned parking lots and parking structure until June, 30, 2008 G. The City Manager, pursuant to Section 12.32.050 of the Palm Springs Municipal Code, has examined the request by the business owners and determined that reinstating the two-hour time limits in the Plaza Mercado parking lot would not adversely affect the businesses and customers who predominately use the lot, and therefore concludes that the reinstatement of the two-hour time limits and enforcement of time limits is warranted. The City Council of the City of Palm Springs therefore resolves: oaa013 Resolution No. Page 2 Section 1. The City Council reinstates the imposition and enforcement of three-hour time limits on the parking of automobiles in the Plaza Mercado parking lot, effective the date signs are re-installed. Section 2. Except as expressly provided in this resolution, all regulations governing the driving, stopping, parking, or leaving standing of vehicles on City owned parking lots and public streets shall remain in full force and effect.
