Re: Rainmaker Fountain
The Rainmaker fountain, located in Frances Stevens Park, was commissioned
through a national design competition for sculpture. Comprised of two fountain
structures, the fountain is intended to have kinetic water elements [hat move and
pour water from colored pipes at various intervals. The large basin overlooks an
amphitheater space, and a symbolic "arroyo" carries water to the lower pool
structure.
The fountain has suffered from a number of mechanical and maintenance
problems over the years. Last August, the City brought in Waterline Studios, a
highly qualified firm that specializes in water fountain design, to prepare a
comprehensive assessment of the fountain, including the mechanical, electrical
and structural components. A copy of this assessment was provided to the City
Council under separate cover in November 2007. The assessment identifies a
number of items that can be repaired or replaced to bring the fountain back into
working order and other items that will improve the long-term viability and reduce
long-term maintenance costs.
This item was brought to the Public Ar[s Commission for informal discussion on
September 13, 2007- At that time, the commissioners requested costs for
demolition of the fountain. The City Engineer has estimated the cost of demolition
to be between $60,000 and $75,000. On October 11th, the item was taken back
to the Public Arts Commission for formal action. There was significant discussion
regarding the ongoing maintenance and high costs to keep the fountain
functional. The Public Arts Commission voted unanimously to recommend that
the Rainmaker fountain be decommissioned.
On November 7, 2007 City Council reviewed [his matter and directed staff to
receive bids for the repair. In January 2008, the City issued a formal request for
bids. This bid was publicly advertised and sent to over 63 contractors throughout
Southern California. A mandatory site visit was conducted on January 23`a

Although five contractors participated in the site visit, no bids were received by
the deadline to submit bids. Since no bids were received by the deadline and the
estimated cost of the project was under $100,000, the City's Procurement
Ordinance allows staff to negotiate a price to complete the project. Staff has
negotiated a price with one of the contractors that participated in the site visit and
expressed an interest in the project. Enclosed is a cost proposal from
International Waterscapes to complete the repairs. The total cost, including
installation of an 8" sewer line and replacement of the electrical panel is
$141,750. The cost proposal has been reviewed by the City's capital project
consultant, Allen Smoot. Mr. Smoot has determined that the cost proposal is
consistent with the City's original bid specification, a copy of which is attached,
and appears to be in line with the City Engineer's estimate of costs.
The estimated cost to repair the fountain is $141,750. Because the 8" sewer line
can be installed by City forces, the contractor's cost proposal can be reduced by
$48,750 for a revised cost of $93,000. The City Engineer's estimate for
demolition is between $60,000 and $75,000.
