RECOMMENDATION:
That the City Council consider adopting a resolution suspending certain
regulatory ordinances to allow the 2004 American Heat, Palm Springs
Motorcycle&Hot Rod Weekend event to occur on and around adjoining streets
of the Prairie Schooner Parking Lot from October 8 through October 10.
SUMMARY:
Suspension of certain regulatory ordinances is required to facilitate and allow
special events to occur in the community. City Council enacted Ordinance
#1310 authorizing the temporary suspension of regulatory ordinances. Staff is
recommending that City Council exercise its authority and suspend the City's
Noise Ordinance, Noise Nuisance, Dance Permits,Zoning Ordinance and Sign
Ordinance as described in the attached Resolution to allow the 2004 American
Heat, Palm Springs Motorcycle & Hot Rod Weekend to occur from October 8
through October 10. All City costs associated with the event are being paid in
advance by the promoter based upon staff estimates gathered by the Special
Events Planning Team (SEPT).
BACKGROUND:
For three of the past four years, Road Shows, Inc. (RSI) has produced the
American Heat, Palm Springs Motorcycle & Hot Rod Weekend in the City of
Palm Springs. Events in 2000, 2001 and 2003 have all been produced and
staged along Palm Canyon Drive in the city's Central Business District.
Following the 2003 event, concerns were raised by many of the downtown
business owners about the event and what was widely described as a negative
impact upon the retail business community due to event activities and the multi-
day closure of streets. These issues led the promoter to seek an alternate
venue for the event in the hope of preserving the substantial economic impact
the event brings to the community while reducing the impact upon the retail
business owners along Palm Canyon Drive.
At the February 25 Study Session, RSI asked the City Council to consider
staging future American Heat events in one of three alternate locations near
the downtown. These locations had been discussed as alternate venues for
American Heat through meetings held in January and February with several
members of the Hotel and Hospitality Association. Proposed locations were(1)
a section of Indian Canyon Drive; (2) portions of Calle Encilia and Andreas
Road near the Spa Resort Casino, (3) and the Prairie Schooner Parking Lot
and part of Calle El Segundo east of the Hilton Hotel. City Council requested
that the promoter work with City staff and members of the hotel association to
develop a proposed event venue from one of the three suggested locations and
return to City Council for consideration of the event. After numerous meetings
and careful consideration of the options available,the promoter is proposing to 404

stage the event on primarily the Prairie Schooner Parking Lot and portions of
Andreas Road and Calle El Segundo.This location is recommended and endorsed
by both the Hilton Hotel (host hotel for the event), the Spa Resort Casino and the
Hotel and Hospitality Association.
RSI has been working with City staff and SEPT to evaluate the proposed venue
and develop an operational plan for the event. The final details of the operational
plan and logistical matters will be worked out with the SEPT team overthe coming
weeks prior to the event.
The promoter is paying all costs to produce the event based upon estimates
generated through the event evaluation process. Members of the SEPT team
participating in this evaluation include staff from the Police Department, Fire
Department, Parks and Recreation, Risk Management, and Public Works.
The promoter's responsibilities are being outlined in an agreement to be executed
by the City Manager on behalf of the City. The terms and conditions of this
agreement are being finalized by staff and will be presented to the City Manager
upon completion. The agreement will fully identify the responsibilities of both the
promoter and the City and any additional requirements needed to produce the
event as determined through the SEPT evaluation process.
RSI will be required to pay all costs of City services needed to support the event,
including Police Department, Fire Department and Public Works Division staff as
determined by the City and SEPT. RSI will be required to submit payment in
advance of the event for these services and the City's issuance of a special event
permit. In the event there are other incidental costs or other costs unknown prior
to the event and the promoter's initial payment, the promoter will be invoiced
immediately following the event and will be required to reimburse the City.
The promoter will be required to fully indemnify the City from any liability
associated with the event and comply with all of the terms and conditions set forth
in the agreement to safely produce the event as determined by SEPT and the City
Manager.

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, TEMPORARILY SUSPENDING CERTAIN
REGULATORY ORDINANCES TO FACILITATE THE 2004
AMERICAN HEAT, PALM SPRINGS MOTORCYCLE&HOT ROD
WEEKEND.
WHEREAS the City of Palm Springs designated the American Heat, Palm Springs
Motorcycle & Hot Rod Weekend as a City-sponsored event; and
WHEREAS the City Council desires to facilitate the staging of the City-sponsored event to
maximize revenue production; and
WHEREAS the City Council finds that certain regulatory ordinances, which are generally
deemed desirable and necessary,may, nonetheless, impede the conduct of special events;
and
WHEREAS the City Council finds that in holding special events, the public interest and the
benefits derived therefrom outweigh the temporary public inconvenience; and
WHEREAS the City Council has enacted Ordinance #1310 authorizing temporary
suspension of regulatory ordinances,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California, as follows:
Section 1. A. That the American Heat, Palm Springs Motorcycle & Hot Rod Weekend is
a special event beneficial to the community and its visitor-oriented economy.
B. That the dates of the 2004 American Heat, Palm Springs Motorcycle & Hot
Rod Weekend are from October 8 through October 10.
C. That Road Shows, Inc. is the event promoter, along with its construction and
concession personnel and staff.
D. That the venue of the American Heat, Palm Springs Motorcycle & Hot Rod
Weekend is the Prairie Schooner Parking Lot and portions of Andreas Road
and Calle El Segundo.
Section2. That the following ordinances are hereby temporarily suspended for the special
event designated in Section 1 above: Noise Ordinance, Noise Nuisance, Dance
Permits, Zoning Ordinance, and Sign Ordinance.
Section 3. That the regulatory ordinances designated in Section 2 above shall remain in
full force and effect except as to the event dates and persons or organizations
as designated in Section 1 above.

OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, CALLING AND GIVING NOTICE OF HOLDING OF
A MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 2004
UTILITY USERS TAX BALLOT QUESTION
WHEREAS, under the provisions of Article VIII of the Charter of the City of Palm Springs, and
the laws relating to the conduct of municipal elections, the City Council may call a special
election consolidated with the regular statewide election to be held on Tuesday, November 2,
2004, for the purpose of permitting the voters of Palm Springs to decide whether certain
amendments to the City's municipal code should be adopted; and
WHEREAS, the City Council wishes to place a matter on the ballot for consideration by the
City's voters, to increase the City's existing utility users tax, the revenue of which shall be used
to support general operating costs for the City.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as
follows:
Section 1. There shall be a measure put to a vote of the people of Palm Springs,
consolidated with the regular statewide general election to be held November 2, 2004, which
would increase general fund revenue by increasing by three percent (3%) the existing utility
users tax within the City of Palm Springs. The text of the proposed measure is set forth in
Attachment "A" of this Resolution. The ballot question shall be:
"Shall the ordinance to permit the Council to increase the existing utility
users tax by up to three percent for a period of no more than three years,
be adopted?"
Section 2. The City Council has been, facing a $4.2 million budget deficit for the coming
fiscal year caused by a number of factors, including the loss of $800,000 in vehicle license fees
and the diversion of $900,000 by the State of California in each of fiscal years 2004-2005 and
2005-2006 to fund a $15 billion borrowing of monies approved by the voters of California.
Furthermore, the State legislature is considering a reallocation of $1.8 million in City sales tax
revenue for fiscal year 2004-2005 and beyond with the promise that such funds would be
replaced with a similar amount of property tax revenue, however, such replacement is far from
certain. This is in addition to the annual diversion of$3.2 million in City property taxes and other
revenue which the State has been taking since 1992. This $4.1 ongoing loss of revenue, along
with other causes, have created an emergency within the meaning of Article XIII C § 2(b) of the
California Constitution (Proposition 218). Given the State's precarious budget situation, there is
a high possibility for additional diversions of City revenue to the State in the future.
Approximately 55% of the City's general fund budget is spent on public safety services (police
and fire), and the loss of the foregoing funds will seriously threaten public safety services, as
well as other necessary general operations which are essential to the health, safety and welfare
of the people of Palm Springs.

Section 3. The City Clerk of said City is hereby authorized, instructed and directed to
procured and furnish, through the Registrar of Voters for the County of Riverside or other
resource as necessary, any and all official ballots, notices, printer material and all supplies,
equipment and paraphernalia that may be necessary in order to property and lawfully conduct
said election.
Section 4. The ballots to be used at said election shall be, both as to form and matter
contained therein, such as may be required by law to be used thereat.
Section 5. The polls for said election shall be open at seven o'clock a.m. on the day of said
election and shall remain open continuously from said time until eight o'clock p.m. of the same
day when said polls shall be closed, except as provided in Section 14401 of the Elections Code
of the State of California.
Section 6. In all particulars not recited in this Resolution, said election shall be held and
conducted as provided by law for holding municipal elections in said City.
Section 7. Notice of time and place of holding said election is hereby given and the City
Clerk is hereby authorized, instructed and directed to give such further or additional notice of
said election, in time, form and manner as required by law.
Section 8. The City Clerk is authorized to reimburse said County, or other resource, for
services performed when the work is completed and upon presentation to the City of a properly
approved bill.
Section 9. Pursuant to Chapter 6, Division 15, of the Elections Code of the State of
California, the canvas of the General Municipal Election to be held in said City is hereby ordered
to be made and caused by the City Clerk.
Section 10. The City Clerk of said City shall cause to be complete the canvas of said election
and shall certify the results to the City Council in accordance with State and local law.
ADOPTED this 21 st day of July, 2004.
