HomeMy WebLinkAbout7/28/2004 - STAFF REPORTS (7) DATE: July 28, 2004 TO: CITY COUNCIL FROM: CHIEF OF POLICE APPROVING AN AGREEMENT WITH THE PALM SPRINGS UNIFIED SCHOOL DISTRICT TO PROVIDE A FULL TIME POLICE OFFICER, CALLED THE FAMILY INTERVENTION OFFICER (FIO), TO ADMINISTER THE SCHOOL COMMUNITY POLICING PARTNERSHIP GRANT FOR AT-RISK STUDENTS AND FAMILIES IN THE CITY OF PALM SPRINGS. RECOMMENDATION: It is recommended that the City Council enter into an agreement with the Palm Springs Unified School District to provide a full time police officer, called the Family Intervention Officer (FIO), to administer the School Community Policing Partnership Grant in the City of Palm Springs. SUMMARY: The Family Intervention Officer position was created by Council approval on September 3, 2003. At the time of Council approval, no contract was prepared to formalize the agreement between the City and the Palm Springs Unified School District. This report and attached minute order will formalize that agreement. The term of this agreement is from October 15, 2003 to June 30, 2004. BACKGROUND: The agreement for the Family Intervention Officer is similar to the agreement that the School District and City have entered into for the past 25 years for the School Resource Officer, whereby the School District pays a portion of the salary for a full-time police officer on the High School campus. The Palm Springs Police Department has long held that proactive intervention programs focusing on the children and youth of our community are crucial to crime prevention. The Department's Drug Prevention and PAL programs are examples of successful attempts to offer education and alternative activities to at-risk children. The Family Intervention Officer, through the School Community Policing Partnership Grant, insures that this positive association between our community's youth and the Police Department continues and grows stronger. The City will bill the Palm Springs Unified School District for the Family Intervention Officer position under account number 3016-40000. The Palm Springs Unified School District will pay to the City for all services rendered under the Agreement, the sum of$52,400 for FY 2003-04, to be made upon billing by the City. FISCAL IMPACT The cost to the City of Palm Springs for FY 2003-2004 will be in-kind in the amount of $35,250. This cost includes the officer's police car, vehicle maintenance, laptop computer, cell phone, and pager, for a total in-kind cost of$35,250. r` 9 Chief of,�o�ace/ Approved: City Manager Attachment: 1. Minute Order y� PALM SPRINGS UNIFIED SCHOOL DISTRICT SCHOOL COMMUNITY POLICE PARTNERSHIP GRANT FAMILY INTERVENTION OFFICER WHEREAS, the Palm Springs Unified School District, hereinafter referred to as the District pursuant to the provisions of the California Education Code, Section 12400, desires to continue to cooperate with the City of Palm Springs, hereinafter called the City, and to continue its agreement with the City in order to insure the greater safety of students and to improve and strengthen law enforcement on or about the campuses of the schools of Palm Springs: NOW, THEREFORE, it is agreed by and between the parties as follows: 1. The City shall provide to the District during the 2003-2004 school year, a trained police officer on a full-time basis with the equipment normally provided for his use by the Police Department of the City for assignment to the District for the purpose of strengthening law enforcement, particularly at the schools within the city limits of Palm Springs and instilling in the young an affection, respect and understanding of the role of law enforcement in society. 2. The uniformed police officer shall work under the direction of the District's School Community Policing Partnership Operations Committee. Some assignments may require the officer to wear civilian business attire. The officer shall serve the District forty (40) hours per week. In the event the officer shall find it necessary to work overtime his police supervisor shall be notified in advance for approval. His hours and site assignments shall be designed by joint agreement between the School District and the Police Department. In instances where crimes occur, the police officer shall not be prohibited from taking appropriate legal measures to respond. 3. The police officer shall be expected to maintain radio contact with his direct supervisors at all times. In the event the officer shall find it necessary to leave the city limits of Palm Springs while on duty his police supervisor shall be notified, where feasible, in advance of the expected absence, and the Police Watch Commander shall be notified. 4. The District will pay to the City for all services rendered under this Agreement, the sum of$52,400, with payment to be made upon billing by the City. In addition, the District will pay the City for expenses related to training and conferences incurred under the provisions of the School Community Policing Partnership grant, to be made upon billing by the City. 5. Pursuant to Government Code § 895.4, each party hereby assumes the liability imposed on it, its officers and employees for injury caused by a negligent or wrongful act or omission occurring in the performance of that V/93 party's obligations under this agreement to the same extent that such liability would be imposed in the absence of Government Code § 895.2. Accordingly, each party shall defend, indemnify and hold harmless the other party for any claim, demand, cause of action, loss, liability, damage, cost or expense that may be imposed on such party solely by virtue of said Section 895.2. The term of this agreement will be from October 15, 2003 to June 30, 2004, however the agreement may be amended at any time by the mutual consent of the parties hereto and may be terminated by either party upon 30 days written notice to the other of its intention to do so. In the event this agreement is terminated, the cost shall be prorated on the basis of one-tenth per month of the actual services performed hereunder.
