RESOLUTION RATIFYING CONTRACT SERVICES AGREEMENTS WITH TERRA NOVA
PLANNING AND RESEARCH, INC. FOR ENVIRONMENTAL REVIEW SERVICES NOTTO
EXCEED $18,340 (#A483C)AND WITH MACKENZIE, WAGNER & ASSOCIATES, INC.
FOR APPRAISAL SERVICES NOT TO EXCEED $5,500 (#A484C)
RECOMMENDATION:
It is recommended that the Community Redevelopment Agency of the City of Palm
Springs, California("Agency')ratify Contract Services Agreements with Terra Nova
Planning and Research, Inc. for environmental review services not to exceed
$18,340 (#A483C) and with MacKenzie, Wagner & Associates, Inc. for appraisal
services not to exceed $5,500 (#A484C).
SUMMARY:
Staff recommends the Agency ratify Contract Services Agreements executed on an
emergency basis by the Agency's Executive Director during August 2004. The
contracts cover environmental review services for the Agency-owned Prairie
Schooner parcel by Terra Nova Planning and Research, Inc. in an amount not to
exceed $18,340 and appraisal services for the same property by MacKenzie,
Wagner& Associates, Inc. in an amount not to exceed $5,500.
BACKGROUND:
The Agency elected to not hold business meetings during August 2004. During that
time it was necessary to proceed with Contract Services Agreements for
environmental review and appraisal services related to Agency-owned property
commonly known as the Prairie Schooner parcel. The contracts cover
environmental review services by Terra Nova Planning and Research, Inc. in an
amount not to exceed $18,340 and property appraisal services by MacKenzie,
Wagner & Associates, Inc. in an amount not to exceed $5,500.The Agency's
Executive Director executed the Agreements on an emergency basis, each for
amounts below$25,000, to allow negotiations to proceed in a timely fashion for an
Amendment to the DDA between the Agency and the Agua Caliente Band of
Cahuilla Indians,which would include the use of the Prairie Schooner parcel. While
the City of Palm Springs' Procurement Ordinance allows the City Manager to
approve contracts under$25,00�, the Agency has not yet adopted the Ordinance in
its By-Laws therefore necessitatung ratification of these Agreements by the Agency.

WHEREAS,the Community Redevelopment Agency of the City of Palm Springs, California
(the "Agency') is the owner of the real property commonly known as the Prairie Schooner
Parcel located in the City of Palm Springs; and
WHEREAS, the Agency is negotiating an Amendment to the Disposition and Development
Agreement(the"DDA")between the Agency and the Agua Caliente Band of Cahuilla Indians
(the "Tribe")which would include the use of the Prairie Schooner Parcel; and
WHEREAS, environmental review and appraisal services were needed to allow the DDA
negotiations to proceed in a timely fashion; and
WHEREAS, staff negotiated contracts with Terra Nova Planning and Research, Inc. for
required environmental review services and with MacKenzie,Wagner&Associates, Inc.for
required appraisal services; and
WHEREAS, the Agency elected not to hold business meetings during the month of August
2004 and the Executive Director of the Agency executed on an emergency basis the two
negotiated contracts, each for amounts below $25,000; and
WHEREAS, the City of Palms Springs' Procurement Ordinance allows the City Manager to
approve all contracts under$25,000, but the Agency has not yet adopted the Ordinance in
its By-Laws, which requires Agency Board action.
NOW,THEREFORE, BE IT RESOLVED that the Community Redevelopment Agency of the
City of Palm Springs, California hereby ratifies the following Contract Services Agreements:
