RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, URGING LEGISLATION THAT WOULD RESTORE FUNDING TO LOCAL GOVERNMENTS IN THE INDIAN GAMING SPECIAL DISTRIBUTION FUND AB1389 (TORRICO). WHEREAS, the Agua Caliente Band of Cahuilla Indians operates the Spa Resort Casino, Class III gaming, on sovereign tribal land, entirely within the boundaries of the City of Palm Springs; and WHEREAS, existing law creates, until January 1, 2009, a County Tribal Casino Account, and provides for a certain portion of funds to be used for grants to local agencies impacted by gaming that are paying into the Indian Gaming Special Distribution Fund; and WHEREAS, the Agua Caliente Band of Cahuilla Indians, as required by Tribal- State Gaming Compact, and in good faith, deposited money into the Indian Gaming Special Distribution Fund, to mitigate potential impacts by tribal gaming; and WHEREAS, the Tribal Council and the City Council work in a corporative effort to address all items of mutual concern, including the mitigation of any potential impacts directly resulting from gaming; and WHEREAS, in fiscal year 2005-06 the Governor decreased the amount of funding available for mitigation grants by $20 million because some counties were not providing the required annual reports on the use of distribution fund spending; and the Legislature passed SB 288, which immediately reinstated the funding; and WHEREAS, in 2007 the California State Auditor presented a report and made recommendations to ensure that local governments receive maximum benefit from the Special Distribution Fund and comply with applicable provisions of state law; and WHEREAS, the City of Palm Springs, funds critical law enforcement, fire and EMS services with its special distribution fund grants, that have a reasonable relationship to offsetting the impacts of gaming in the Downtown area and nearby residents, and supports reasonable legislation to that end. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS. SECTION 1. Requests an Amendment to AB1389 (TORRICO) to provide an appropriation and immediate funding for local governments from the Indian Gaming Special Distribution Fund. 0413©/Zoos =4=1&4 z,F. Supports AB1389 (TORRICO), [if amended], and urges immediate legislation that would restore funding for local governments from the Indian Gaming Special Distribution Fund. SECTION 3. Authorizes and directs the Mayor and City Manager, the Fire Chief and Police Chief to send letters to Assembly Member Torrico, Chairman, Assembly Governmental Organization Committee, urging the restoration of funding local governments from the Indian Gaming Special Distribution Fund, and the immediate appropriation and funding of mitigation grants to local agencies, prior to the January 1, 2009, expiration date.
