Ready, City Manager BY: Department of Aviation SUMMARY Gensler Architectural Design Amendment No. 15 provides additional scope to the Airport's Improve/Modify/Rehab Terminal Complex Project by adding a maintenance yard (not included in the original proposal), increasing the size of the New Concourse concessions, and providing for a redesign of the terminal re-entry area, landscape palate and a revised water feature. The landscape palate and the water feature will go before Architectural advisory on May 12, 2008 for final review. If for any reason they are turned down there will not be a further request for design dollars; revisions will be made until approval is received. The reason for a request of increased landscape design fees is that the current contract required the landscape architect to only update the previously approved plans for the courtyard and he has not had to carry out a redesign. RECOMMENDATION: 1. Approve Amendment No. 15 to Agreement No. 4382 with Gensler for an additional amount of$ 224,790. 2. Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS This Amendment would increase the design scope by adding a maintenance yard, increasing the size of the concessions in the New Concourse and to compensate for required design changes related to the terminal re-entry area, landscape palate and water feature. As the project design evolved additional scope was added, and the landscape and water feature plans, that under this contract were to be only updated from the plan previously approved when the hold-room project was undertaken, were required to be re-worked. For a project that involves remodeling and new construction in a public facility that must remain open during construction, industry standard for architects fees are between 11% to 12% of construction cost plus reimbursables at 10% of the design fee. The Federal Aviation Administration prohibits the use of percentage fee based contracts on projects that receive federal grants, as this project will; they require fixed fee contracts. However, the percentage fee calculations are an excellent benchmark by which to determine an appropriate fixed fee. The low bid on the project was received on April 24, 2008 at $6,448,000. Utilizing the industry percentages as a benchmark would result in total design fees between $709,280 and $773,760, and total reimbursables between $70,928 and $77,376. Amendment 15 outlines specific adjustments for the various sub-tasks of this project for an overall increase in design fees of $209,790 and an increase in reimbursables of $15,000. Total architectural services for the Expand/Modify/Rehab Terminal Complex project including Amendment 15 would now total $703,400 or 10.9% of construction cost, plus reimbursables of $52,800 or 7.5% of design fee. Both of the fee items are below industry percentages. Ready, City N a Attachment.- Gensler A4382 -Amendment No. 15 OUM AMENDMENT NO. 15 AGREEMENT NO 4382 —ARCHITECTURAL SERVICES THIS FIFTEENTH AMENDMENT to Agreement No. 4382 for contract services, (herein "Amendment") made and entered into on the day of , 2008, by and between the CITY OF PALM SPRINGS (herein "City") and GENSLER (herein "Architect") is hereby amended effective as follows: RECITALS The City and Architect entered into that certain Contract Services Agreement No. 4382 for Architectural Design Services ("Agreement'), as duly amended from time to time. The parties wish to amend the Agreement pursuant to the terms of this Amendment to increase scope and compensation. NOW, THEREFORE, the parties hereto agree as follows: Section 1. Exhibit "A" Scope of Services is hereby amended by adding a new "Task 16f Maintenance Yard Enclosure". Section 2. Section 3. Full Force and Effect: Except as previously modified herein, all other provisions of the Agreement shall remain unmodified and in full force and effect. Section 4. Corporate Authority: The persons executing this Amendment on behalf of the parties hereto warrant that (i) such party is duly organized and existing, (ii) they are duly authorized to execute and deliver this Amendment on behalf of said party, (iii) by so executing this Amendment, such party is formally bound to the provisions of this Amendment, and (iv) the entering into this Amendment does not violate any provision of any other agreement to which said party is bound.
