O�pALM Spy � y u v, c9.1L CITY COUNCIL STAFF REPORT DATE: May 7, 2008 SUBJECT: APPROVAL OF A RESOLUTION AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD (CIWMB) FOR ANY OR ALL AVAILABLE CIWMB TIRE-RELATED GRANTS FOR A PERIOD OF FIVE YEARS FROM THE DATE OF ADOPTION." Ready, City Manager BY: Public Works and Engineering Department SUMMARY Every year, the Public Works and Engineering Department strives to program an Asphalt Rubber Hot Mix (ARHM) Overlay project for selected City streets that require additional maintenance improvements that a typical slurry seal will not adequately address. The State, through the 'Rubberized Asphalt Concrete (RAC) Use Grant Program", offers funding assistance to cities that schedule ARHM overlay projects that utilize rubberized asphalt concrete. RECOMMENDATION: 1. Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR ANY OR ALL AVAILABLE CIWMB TIRE- RELATED GRANTS FOR A PERIOD OF FIVE YEARS FROM THE DATE OF ADOPTION." 2. AUTHORIZE AND ENPOWER THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE IN THE NAME OF THE CITY OF PALM SPRINGS ALL NECESSARY GRANT RELATED DOCUMENTS, FOR THE PURPOSES OF SECURING GRANT FUNDS AND TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN THE GRANT APPLICATIONS. City Council Staff Report May 7, 2008 --Page 2 RAC Use Grant Program STAFF ANALYSIS: The California Integrated Waste Management Board (CIWMB) receives an annual appropriation from the California Tire Recycling Management Fund (Tire Fund) to administer the Tire Recycling Act (Act) (Senate Bill 937 Chapter 35) and related legislation. Public Resources Code (PRC) Section 42872.5 allows for the awarding of grants to public entities for funding of public works projects that use rubberized asphalt concrete (RAC). The RAC Use Grant Program anticipates that $3,020,583 will be available for fiscal year 2007/2008. These funds are available on a competitive basis to all cities, counties, special districts, and other local government agencies that fund public works projects using rubberized asphalt concrete. The Program reimburses applicants at rate of $5.00 per ton of rubberized asphalt concrete used in their project. This year, the Public Works and Engineering Department has proposed an ARHM overlay of the following roads: 1 - Tachevah Drive from Palm Canyon Drive to Indian Canyon Drive 2 - El Alameda Drive from Palm Canyon Drive to Indian Canyon Drive 3 - Tamarisk Drive from Palm Canyon Drive to Indian Canyon Drive 4 -Amado Road from Palm Canyon Drive to Indian Canyon Drive 5 - Belardo Road from Arenas Road to Ramon Road 6 - San Lorenzo Road from Random Road to Sunrise Way 7 - Camino Real from S. Riverside Drive to Mesquite Avenue 8 - Indian Canyon Drive from San Rafael Dr. to Tramview Rd. (south bound) 9 - Baristo Road from Sunrise Way to Farrell Drive 10 - Farrell Drive from Tahquitz Canyon Way to Ramon Road. This Overlay Project will cover approximately 646,000 square feet of paving using approximately 5,652 tons of rubberized asphalt concrete, and a minimum of 57 tons of crumb rubber made from California waste tires recycled and saved from being wasted in California landfills. Although the SB 937 program is highly competitive, we are hopeful that our application will be received and approved. If funded, our ARHM overlay project will be eligible for reimbursement of up to $28,258 from the CIWMB. Although the total reimbursement available to the City only represents approximately 2.5% of the total cost, it is an opportunity to participate in the SB 937 program and continue our City-wide recycling efforts. The SB 937 program requires that agencies applying for grant funds submit an authorizing resolution by the agency's legislative body. A RESOLUTION OF THE CITY OF PALM SPRINGS, CALLIFORNIA, AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD (CIWMB) FOR ANY OR ALL AVAILABLE CIWMB TIRE-RELATED GRANTS FOR THE PERIOD OF FIVE YEARS FROM DATE OF ADOPTION, AND AUTHORIZING AND EMPOWERING THE CITY MANAGER OF THE CITY OF PALM SPRINGS OR HIS DESIGNEE TO EXECUTE IN THE NAME OF THE CITY OF PALM SPRINGS ALL NECESSARY GRANT RELATED DOCUMENTS FOR THE PURPOSES OF SECURING GRANT FUNDS TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN THE GRANT APPLICATION(S). WHEREAS, Public Resources Code Sections 42800 et seq. established the waste tire program for the State of California and assigns responsibility for its implementation to the California Integrated Waste Management Board (CIWMB); and WHEREAS, CIWMB is authorized to award grants under the waste tire program as identified in its Five-Year Plan for the Waste Tire Recycling Management Program; and WHEREAS, procedures established by the State of California and the CIWMB require each jurisdiction/applicant to certify by resolution the approval of the jurisdiction/ applicant's governing body for submittal of a grant application before submission of said application to the CIWMB; and WHEREAS, if awarded a grant, the City of Palm Springs will enter into a Grant Agreement with the CIWMB for implementation of a tire-related grant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs as follows: 1. That submittal of an application to the CIWMB for any or all available CIWMB tire- related grants for the period of five years from date of adoption is hereby authorized; and 2. That the City Manager of the City of Palm Springs or his designee is hereby authorized and empowered to execute in the name of the City of Palm Springs all necessary grant related documents, for the purposes of securing grant funds to implement and carry out the purposes specified in the grant application(s).
