Re: Villagefest Board
Dear David:
The Council in July before the August recess discussed the possibility of revising the
membership of the Villagefest Board. We were instructed to prepare such an amendment.
Attached please find a draft ordinance revising the membership of the Villagefest Board
to expand the Board from the current membership of five members with three members in the
retail industry, one jeweler and one conmiunity-wide tourism member to seven members. The
draft ordinance provides for four members as retail merchants, one jeweler, one member of the
community-wide tourism industry and one representing the community at large.
One of the instructions given by the Council was to talk to the current Villagefest Board
and see what their attitude was towards revising the membership of the Villagefest Board. I
believe that Jerry Ogbu n had several meetings with the Villagefest Board early in August and
his summary to me was that the Villagefest Board did not wish to change the membership at this
time. Presuming that the Villagefest Board would be willing to make the change we had already
drafted the attached ordinance.
I do not know whether there have been some further conversations with the Villagefest
Board and whether they have revised their position from the one which Jerry Ogburn shared with
me. If their position remains the same, then I am not quite sure where we stand with this.
However, I thought I should go ahead and pass on to you the work we have already done on this
subject.

Obviously, the ordinance can readily be adapted to make whatever changes are desirable
in the membership of the Villagefest Board.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, REVISING A PORTION OF CHAPTER 2.22
OF THE PALM SPRINGS MUNICIPAL CODE REGARDING THE
VILLAGEFEST BOARD
WHEREAS, the City Council of the City of Palm Springs ("City Council')
recognizes the importance of citizen participation in local govenunent; and
WHEREAS, the City Council now desires to expand the number of members on
the Villagefest Board.
NOW THEREFORE, it is found, determined and resolved by the City Council of the City
of Palm Springs as follows:
Section 1. All of the facts set forth in the above recitals are true and correct and are
incorporated herein by this reference.
Section 2. Section 2.22.010 of the Palm Springs Municipal Code is amended, in its
entirety, to read as follows:
"Section 2.22.010 Created.
There is created a Villagefest board which shall exist as an advisory body of the city. It
shall consist of seven (7) members, serving without compensation, appointed in the
mamier prescribed in Section 2.22.020 of this code. All appointments to the board shall
be for teens also as prescribed in Section 2.22.020 of this code."
Section 3. Section 2.22.020 of the Palm Springs Municipal Code is amended, in its
entirety, to read as follows:
"Section 2.22.020 Tenn-Vacancies-Vote.
"(a) Members of the board shall be appointed or removed in accordance with and shall be
subject to all the provisions of Chapter 2.06 of the Palm Springs Municipal Code, as the
chapter now reads, or as it may be amended from time to time. Members shall serve for
three-year terns and until their successors are appointed and qualified, unless they are
earlier incapacitated, resign, or are removed.
(b) Members of the board shall have the following qualifications:
(1) [Four] members shall be either current retail merchants or have significant
retail experience;
(2) [One] member shall be a retail merchant having significant experience in
jewelry, crafts or similar areas;
(3) [One] member shall represent the community at large; and

(4) [One] member shall represent the comrnimity-wide tourism industry."
Section 4. Pursuant to this ordinance two new positions are added to the board. These
two new positions shall also be for three-year terms but the initial terns shall be co-
terminus with the terns of the current board ending on to
continue the staggering of offices.
Section 5. Legal Construction. The provisions of this Chapter shall be construed as
necessary to effectively carry out its purposes, which are hereby found and declared to be
in furtherance of the public health, safety and convenience.
Section 6. Publication. The City Cleric of the City of Palm Springs shall certify to the
passage and adoption of this Chapter, and shall cause the same to be posted and published
in the mamier and the time required by law.
