Ready, City Manager BY: City Clerk's Office SUMMARY The City Council will consider a Resolution requiring City Staff to review the Conflict of Interest Code and submit a 2008 Biennial Notice to the City Council prior to October 1, 2008. RECOMMENDATION: Adopt Resolution No_ , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REQUIRING CITY STAFF TO REVIEW THE CONFLICT OF INTEREST CODE AND SUBMIT A BIENNIAL NOTICE AS REQUIRED UNDER THE POLITICAL REFORM ACT." STAFF ANALYSIS: The Political Reform Act requires every local government agency to review its Conflict of Interest code biennially. No later than July 1 of each even-numbered year, code reviewing bodies must notify each agency within their jurisdiction to review its conflict- of-interest code. The City Council is the code reviewing body for the City. Therefore, not later than July 1, 2008, the City Council must notify staff to review its code and submit a biennial notice to the City Council. No later than October 1 of each even-numbered year, staff must submit to the code reviewing body, a notice indicating whether or not an amendment is necessary. ITEM NO. •`5' City Council Staff Report June 18, 2008—Page 2 Conflict of Interest Code Pursuant to the Political Reform act, the Conflict of Interest Code must be reviewed every two-years and amended when circumstances change. Adopting the proposed resolution is the first step in the review process, which requires staff to submit the requisite notice to the City Council by the last meeting in September. WHEREAS, the Political Reform Act requires cities to adopt a Conflict of Interest Code; and WHEREAS, the Conflict of Interest Code must be reviewed every two-years and amended when circumstances change; WHEREAS, no later than July 1 of each even-numbered year, code reviewing bodies must notify each agency within their jurisdiction to review its conflict-of-interest code; WHEREAS, the City Council is the code reviewing body for the City of Palm Springs; WHEREAS, no later than October 1't of each even-numbered year City staff shall submit to the code reviewing body, a notice indicating whether or not an amendment is necessary. NOW THEREFORE THE CITY COUNCIL RESOLVES AS FOLLOWS: Section 1. The City Council directs City staff to review the Conflict of Interest code, and if a change is necessitated by changed circumstances to submit a 2008 Local Agency Biennial Notice, or to submit a report stating that no amendment is necessary. Section 2. The City Clerk shall transmit the Biennial Notice and recommendations to the City Council at the Regular City Council meeting of September 17, 2008. Adopted this 18t' day of June, 2008.
