PROPOSITION 40 THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE
NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002, PER-CAPITA
GRANT PROGRAM FUNDS
RECOMMENDATION:
That the City Council adopt a resolution that will allow the State of California,
Department of Parks and Recreation, Office of Grant Services to encumber Per-
Capita Grant Program funds as designated in State Proposition 40 on behalf of
the City of Palm Springs.
SUMMARY:
Staff asks that City Council adopt a resolution that allows the State of California,
Department of Parks and Recreation, Office of Grant Services to encumber Per-
Capita grant funds in the amount of$220,000 For a project to be named at a later
date.
BACKGROUND:
On March 5, 2002, California voters passed Proposition 40 by 56.8 percent, the
$2.6 billion "California Clean Water, Clean Air, Safe Neighborhood Parks, and
Coastal Protection Act of 2002."
The Parks Bond Act of 2002 provides $2.6 billion for a variety of parks and other
projects at the state and local levels, including $326,725,000 for local parks The
Park Bond Act requires that $196,035,000 of that be distributed on a per-capita
basis. The per-capita grant program is based upon population. The City of Palm
Springs' population (43,500) is based on January 1, 2002 figures provided by the
State Department of Finance. The per-capita rate for allocation is$4.40: however,
there is a minimum $220,000 allocation for populations below 50,025.
The per-capita grant does not require local matching funds and may be used for
a variety of purposes, focusing on acquisition, development, improvement,
restoration, and interpretation of local park and recreation lands.
The City will receive$220,000 from the Per-Capita grant, and staff and the Parks
and Recreation Commission will recommend a project to be named at a later date.

October 13 meeting. The commission's action will be reported to City Council at
this meeting.

RESOLUTION NO.
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, ALLOWING THE STATE OF CALIFORNIA,
DEPARTMENT OF PARKS AND RECREATION, OFFICE OF GRANT
SERVICES TO ENCUMBER PER-CAPITA GRANT PROGRAM FUNDS
AS DESIGNATED IN STATE PROPOSITION 40 ON BEHALF OF THE
CITY OF PALM SPRINGS.
WHEREAS, the people of the State of California have enacted the Proposition 40 Clean
Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002,
which provides funds to the State of California and its political subdivisions for acquisition,
development, improvement, restoration, and interpretation of local park and recreation
lands; and
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility for the administration of the program within the state, setting up necessary
procedures governing application by local agencies under the program, and
WHEREAS, said procedures established by the State Department of Parks and Recreation
require the City to certify by resolution the approval for it to encumber said funds on behalf
of the City of Palm Springs,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs:
Section 1. That the California State Department of Parks and Recreation is hereby
allowed to encumber per capita grant program funds as designated in state
Proposition 40 on behalf of the City of Palm Springs,
Section 2. That the City Manager is hereby appointed as agent of the City to conduct all
negotiations with the State Department of Parks and Recreation.
