Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY Approval of this item will authorize Veolia Water North America-West, LLC ("Veolia") to proceed with the cleaning of Digester No. 1 at the wastewater treatment plant. RECOMMENDATION- 1) Approve the Digester No. 1 Notice to Proceed to Veolia Water North America- West, LLC, in the amount of$81,596.25 STAFF ANALYSIS: Previously, the City and Veolia coordinated the overhaul of the wastewater treatment plant Digester No. 2 system, which is now operating as the City's primary digester. Currently, the previously used primary digester (Digester No. 1) is not in operation. Ultimately, the City and Veolia will coordinate on a subsequent Capital Project to overhaul Digester No. 1 similar to the recently completed Digester No. 2 project, such that both of the Digester systems are operational and on-line. Prior to performing any work on the currently off-line Digester No. 1 system, it is necessary to clean out any remaining wastewater sludge from within Digester No. 1. In accordance with Section 5.3(f) of the Amended and Restated Wastewater Services Agreement between the City and Veolia, Veolia is entitled to make a first proposal to do any Capital Project related to the wastewater treatment plant. The scope of work for this project simply involves the removal of all existing wastewater sludge and materials from within the Digester No. 1 tank, entirely cleaning the tank, and disposing of the sludge for drying in at the wastewater treatment plant sludge drying beds. Item No. 2 • 0 • City Council Staff Report July 9, 2008 Notice to Proceed for Digester No. 1 Cleaning Staff has reviewed Veolia's original proposal, and recommended a revised not to exceed contract fee of $81,59625, on a time and materials basis (see Attachment 1). Veolia has agreed to the City's recommended fee. FISCAL IMPACT: The price for this work was negotiated pursuant to Section 5.3 of the Agreement and will not exceed $81,596.25. Sufficient funds are available in the Wastewater Treatment Fund Account No. 420-6800-50000 (Unscheduled Capital Projects). David J. Barakian Thomas J. Actual costs paid shall be based on invoices and receipts from NADCS Digester Cleaning included in Veolia's invoice to the City. Allowable time for completion: 15 working days Total Sub Contractor/Materials Costs Not to Exceed $57,950 Veolia Administration Cost Veolia Administration $540 Veolia Construction Manager $11,560 (136 hours @ $85 per hour) Veolia Travel and Living $2,400 Time and Materials (NOT TO EXCEED) This fee is to be paid on a time and material basis, not to exceed $2,400, Actual costs paid shall be based on invoices and receipts from Veolia included in Veolia's invoice to the City. Total Veolia Administration Costs Not to Exceed $14,500 Total of All Costs Not to Exceed $72,450 Veolia Mark-Up (12.5%) Not to Exceed $9,056,26 Veolia's mark-up shall be paid at 12.5% of the total final time and materials fees paid, computed on the final Vealia invoice submitted to the City. The mark-up "fee" of $9,056.25 is not guaranteed, but represents a not to exceed amount established for the purposes of this contract.
