SUMMARY
David Hilliard of Palm Canyon 102, LP has requested a one-year time extension for
Tentative Tract Map 33575. The property is located at 850 and 990 South Palm Canyon
Drive (the southwest corner of South Palm Canyon and Mesquite). The previously
approved subdivision will expire on July 12, 2008.
RECOMMENDATION
Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A ONE-YEAR TIME

PRIOR ACTIONS:
On May 3, 2006, the City Council conducted a public hearing to review the application
for a Preliminary Planned Development district comprised of a mixed use development.
At that time, the Council directed the project to go back to the AAC and Planning

Commission for further review. The applicant revised the project and requested a
hearing with the City Council rather than the Planning Commission and AAC.
On July 12, 2006 the City Council voted unanimously to approve the preliminary
Planned Development District and Tentative Tract Map 33575 for the project.
On November 22, 2006 the Planning Commission voted 6-0-1 to approve the Final PDD
for the residential elements of the project with conditions,
On November 28, 2007 the Planning Commission voted 6-0-1 to approve the Final PDD
for the commercial/retail elements of the project.
On June 11, 2008, the Planning Commission approved a time extension on the final PD
to July 12, 2009 and recommended approval of a one-year time extension to July 12,
2009 of the Tentative Tract Map to the City Council by a vote of 7-0-0.
BACKGROUND AND SETTING
The applicant submitted the time extension request before the expiration date of the
tentative tract map. According to the applicant, "the time extension is necessary to
enable them to further evaluate the unit mix and retail components".
Section 94.03.00(H) of the Zoning Code states that extensions of time for a TTM may
be allowed by demonstration of good cause. According to Chapter 9.63,110 of the
Municipal Code, there are no specific findings or determinations that need to be made
to grant the time extension for the map. The Municipal Code does limit all time
extensions to one-year and that requirement is being carried forward in staff's
recommendation.
In reviewing the time extension request, staff considered if the following circumstances
have changed such that the project's approval might need reconsideration,
• The project's overall plan and lot configuration,
• The uses and development of the surrounding area, and
• The applicable policies of the General Plan, zoning ordinance and other
regulations.
Staff has reviewed the project, surrounding area and underlying zoning regulations and
determined that no significant changes have occurred that would suggest that the
project is no longer in keeping with the neighborhood or the City's development policies.
ENVIRONMENTAL ASSESSMENT
A time extension request is considered a "project" pursuant to the terms of the California
Environmental Quality Act (CEQA). A mitigated negative declaration and mitigation

monitoring program was previously approved by City Council on January 25, 2006. The
preparation of additional environmental documentation is not necessary because there
are no changed circumstances related to the project that will result in any new
significant environmental effects or a substantial increase in the severity of previously
identified significant effects. Therefore, the proposed time extension could not result in
any new environmental impacts beyond those already assessed in the previously
adopted mitigated negative declaration.
NOTIFICATION
Requests for time extensions do not require public notice.

WHEREAS, David Hilliard of Palm Canyon 102 LP ("Applicant") has filed an application
with the City pursuant to Chapter 9.63.110 of the Palm Springs Municipal Cade for a
one-year time extension for Case No. 6,1056 / TTM 33575 / PD 314, a previously
approved subdivision for a mixed use development; and
WHEREAS, on June 11, 2008, a public meeting on the application was held by the
Planning Commission in accordance with applicable law; and
WHEREAS, at said meeting, the Planning Commission held a public hearing and voted
7-0-0 to approve an extension on the final Planned Development No. 314, and to
recommend that the City Council approve a one-year time extension of Tentative Tract
Map 33575 from July 12, 2008 to July 12, 2009; and
WHEREAS, on July 16, 2008, the City Council held a public meeting in accordance with
applicable law to consider the applicant's request for a one-year time extension of the
Tentative Tract Map for case 5.1056 /TTM 33575 / PD 314; and
WHEREAS, the proposed project is considered a "project" pursuant to the terms of the
California Environmental Quality Act (CEQA); and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the
staff report and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
Section 1: A time extension request is considered a "project" pursuant to the terms of
the California Environmental Quality Act (CEQA). A mitigated negative
declaration and mitigation monitoring program was previously approved by
City Council on January 25, 2006. The preparation of additional

environmental documentation is not necessary because there are no
changed circumstances related to the project that will result in any new
significant environmental effects or a substantial increase in the severity of
previously identified significant effects. Therefore, the proposed time
extension could not result in any new environmental impacts beyond those

Section 2. To approve a one-year time extension from July 12, 2008 to July 12, 2009
for Case No. 5.1056 / TTM 33575 / PD 314 a previously approved
subdivision of 11.7 acres for a mixed use development of eighty (80) town-
homes, twenty (20) live-work units and 15,000 square feet of retail uses.

PROJECT DESCRIPTION:
A request by Dave Hilliard of Palm Canyon 102, LP for a one-year time extension on the
approval of Tentative Tract Map 33575 for "The Cameron", formerly known as
"Mesquite Village"; a Planned Development District (PDD) No. 314, and extension of the
final Planned Development District approval for a previously approved mixed use
development of eighty (80) residential town-home units, twenty (20) live-work units and
15,000 square feet of retail uses.

RECOMMENDATION:
That the Planning Commission:
• Recommend to the City Council approval of a one-year time extension of the
Tentative Tract Map for Case 5.1056 PD 314 / TTM 33575 from July 12, 2008 to
July 12, 2009 (twelve months) and,
• That the Planning Commission approve a time extension on their approval of the
final PDD for both the commercial and the residential components of the project
from November 28, 2008 to July 12, 2009 (approximately eight months) in order
to tie the expiration dates of these two approvals together.
BACKGROUND:
On May 3, 2006, the City Council conducted a public hearing to review the application
for a Preliminary Planned Development district comprised of a mixed use development.
At that time, the Council directed the project to go back to the AAC and Planning
Commission for further review. The applicant revised the project and requested a
hearing with the City Council rather than the Planning Commission and AAC.
On July 12, 2006 the City Council voted unanimously to approve the preliminary
Planned Development District and Tentative Tract Map 33575 for the project.
On November 22, 2006 the Planning Commission voted 6-0-1 to approve the Final PDD
for the residential elements of the project with conditions.
On November 28, 2007 the Planning Commission voted 6-0-1 to approve the Final PDD
for the commercial/retail elements of the project.
ANALYSIS:
The applicant submitted the time extension request on May 7, 2008, before the
expiration date of July 12, 2008 for the Tentative Tract Map and before the expiration of
the Final Planned Development District Approval of May 28, 2008. The applicant has
requested a time extension in order to further evaluate the unit mix and retail
components of the site to assure a successful development (see attached letter dated
May 22, 2008). Time extensions on Tentative Tract Maps may be recommended by the
Planning Commission for final determination by the City Council. Time extensions on
final Planned Development Districts are determined by the Planning Commission.
According to Chapter 9.63.110 of the Municipal Code, there are no specific findings or
determinations that need to be made to grant a time extension for a TTM. The Municipal

Code does limit all time extensions to a maximum of one-year and that requirement is
being carried forward in staffs recommendation.
Regarding the PDD, Sections 94.03.00(H & J) of the Zoning Code states that the
Planning Commission may grant extensions of time for a Planned Development District
(PDD) with demonstration of good cause. Final PDD's must be submitted for Planning
Commission approval within two years of the approval of the preliminary PDD,
otherwise the preliminary PDD approval expires. The applicant submitted the final PDD
on November 22, 2006 for the residential component and November 28, 2007 for the
commercial/retail component of the project, thereby satisfying the time requirement for
the preliminary PDD. Construction must commence on the project within six months
after the approval of the final PDD, or the entire PDD entitlement expires. For good
cause, the Planning Commission may extend the six month period required for
commencing construction. In this case, the final PDD for the retail component expires
six months after its November 28, 2007 approval, or May 28, 2008.
Staff is recommending coordinating the time extension of the Tentative Tract Map and
the Final PDD approvals so that one expiration date is established for these multiple
entitlements. The date of July 12, 2009, allows an extension of twelve months on the
TTM, and roughly eight months on the final PDD. In this way Staff believes the
confusion of multiple expiration dates is minimized. By approving this recommendation,
construction would need to commence by July 12, 2009.

Dear Mr. Lyon,
To clarify my letter dated May 7, 2008 to Edward Robertson,we have requested a
time extension of the above referenced Tentative Tract Map to accommodate the
changing market for new home development in Palm Springs. This TTM covers
the planned development of 80 townhomes, 22 live-work units and 15,000 square
feet of retail space located on the 11.7 acre site at the Northeast comer of Palm
Canyon Drive and Mesquite Road_ We are in need of the additional time in order
to further evaluate the unit mix and retail components of our site such that we can
effectively deliver an attractive and successful mixed use development.

Chair Marantz noted her abstention and would not be participating in the discussion and

Chair Hochanadel suggested removal of the construction fencing.
Mr_ Hilliard, applicant, stated their willingness to remove the construction fencing as
long as it is not required for dust control.
Commissioner Conrad noted her preference for removal of the construction fencing and
jspoke in favor of the time extension for this site.

4. Case 5.1201 CUP - An application by Family of Love Church for the
operation of a church facility to include religious assemblies, ceremonies

David A. Newell, Associate Planner, provided background information as outlined in the
staff report dated June 11, 2008,
Chair Marantz opened the Public Hearing:
-13obbi Fletcher, board member and advisory board chair, stated that the use is not
intrusive to industrial activity and noted several definitions for "compatible". Ms.
Fletcher stated that there are over 13 churches operating in the same zone and noted
the stringent regulations of toxic materials by government agencies such as OSHA.
-Brooks Young, pastor, stated the Planning Department was contacted prior to signing
the lease and was informed that the church was allowed; and have paid the required
fees.
-Gabriel Lujan, project designer, expressed concern with the existing churches in the M-
1-P zone and addressed the parking concerns. Mr_ Lujan clarified their intent is not to
open an adult business such as a nightclub or strip club_
-Ofelia Seals, Riverside, spoke in support of the church; noting that the church not only
educates and teaches its members but also provides support for families and homeless
people.
-Efrain Young, church deacon, spoke of the church's opportunity for the youth to grow
and have a safe place to go to. Mr. Young requested approval of the conditional use
permit.

PUBLIC HEARING fcont'd►:
-Jeffrey Robertson, church deacon in training, spoke in support of the church; and
strongly encouraged the Commission to approve the conditional use permit.
-Anita Young, church member, stated the church was founded in April 2007 and
provided details on the services the church provides to meet the needs of the
community.
-Kristen Crawford, Cathedral City, read a letter into the record from her
mother Joanne Campezi, pertaining to church's growth; spoke highly of the pastor
and requested approval of the project.
-Javier Lopez, Palm Springs, church member, spoke of ways the church has helped him
grow and become a better person; requested approval of the conditional use permit.
-Brian Strahl, represents the property owner, stated the building is a nine tenant building
and clarified that the Terminix building is not directly adjacent to the church's tenant
space.
-Charlotte Rougel, expressed gratitude for the church's help in providing assistance to
her when she had a fire in her home.
-Mandy Alquist, Palm Springs, church & board member, stated the importance for the
church members to have a place to call their home and requested approval.
-Bobbi Fletcher and Brooks Young, applicants, requested a period of five years for the
conditional use permit and allowance of addifional service times.
-Scott Ventura, Fire Division Chief, provided details on the determination of occupancy
and an annual review by the Fire Department.
There being no further appearances, the Public Hearing was closed.
Further discussion occurred on the tenant vacancies for the building, hours of operation
for future assemblies and the adjacent industrial uses.
MIS/C (Caffery/Cohen, 7-0) To approve, and direct staff to bring back a resolution of
approval; and staff to work with the applicant on a schedule consisting of,
-A Five year term for the Conditional Use Permit based on the lease.
-Hours of operation based on allowing administrative activities during the day and
assembly activities on nights and weekends.
Adequate parking based on the zoning standards for the complex and an annual
review to be conducted by the Fire Department,

Commissioner Conrad noted her abstention since she was not involved in the original
approval of the project.
Edward Robertson, Principal Planner, provided background information as outlined in
the staff report dated June 11, 2008.
Chair Marantz opened the Public Hearing; there being no appearances the Public
Hearing was closed.
WS/C (Caffery/Scott, 6-0, 1 abstained/ Conrad) To approve, subject to Conditions of
Approval.
6. COMMISSION WORK PROGRAM: Work Program Priorities and
Subcommittee Assignments
Mr. Ewing provided an update on the Utility Undergrounding Subcommittee and
the Architectural Advisory Subcommittee meetings that were held recently.
Mr. Ewing reported that the City Council would be conducting interviews on July 25'h
for the Boards and Commission vacancies.
7. COMMISSION/STAFF REPORTS AND REQUESTS:
Commissioner Conrad requested a meeting take place with the Airport subcommittee,
including Mr. Don Wexler, to study the landscape plans that were distributed today_
Commissioner Ringlein requested an update on the perimeter landscaping located at
The Springs and Sossa's Market on Gene Autry and Vista Chino Road.
Vice Chair Hochanadel requested an update on dialogue between hotel builders and
cell tower companies. Staff responded this request would be forwarded to Economic
Development department_
