Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY Approval of this item will authorize Veolia Water North America-West, LLC ("Veolia") to proceed with final design of the Household Hazardous Waste Facility to be located at the wastewater treatment plant. RECOMMENDATION: 1) Approve Notice to Proceed to Veolia Water North America-West, LLC, for final design of the Household Hazardous Waste Facility, not to exceed $45,000. STAFF ANALYSIS: Riverside County currently operates a household hazardous waste program at a facility located on City property on Alejo Road. The current program is limited to "ABOP" (antifreeze, batteries, oil and paint), and it has been the City's and County's desire to enlarge the facility and upgrade the ABOP program to a permanent household hazardous waste program that can collect the full array of hazardous wastes, including electronic wastes. The City and County jointly applied for a regional household hazardous waste grant from the California Integrated Waste Management Board (CIWMB) to fund a portion of the construction and equipment costs of the expanded facility, which is to be located at the wastewater treatment plant. The City and County were successful in obtaining a $149,915 CIWMB grant for this purpose. Randy Purnell Landscape Architects was previously hired by Veolia to prepare a preliminary design for the new facility, which was originally located at the southeast corner of Mesquite Avenue and Vella Road, and included a community garden. ' ° City Council Staff Report July 16, 2008 Notice to Proceed for HHW Facility Design preliminary plan was reviewed and recommended for approval by the Architectural Advisory Committee on October 8, 2007, and was approved by the Planning Commission on November 14, 2007. Subsequently, the City Council selected the same site as the location for the new animal shelter. In consultation with the City's Animal Shelter Project Manager, AI Smoot, staff repositioned the household hazardous waste facility further south, to be located directly adjacent to and south of the Animal Shelter. However, due to space restrictions and the need to preserve land for wastewater treatment facility purposes, the community garden component of this project has been eliminated. Randy Purnell Landscape Architects, in conjunction with MDS Consulting and MRC Engineering, Inc., has submitted proposals to Veolia to provide final engineering design for the household hazardous waste facility, which will include construction of a new cul- de-sac at the south end of Vella Road. The negotiated fees are: Randy Purnel Landscape Architects (lead): $18,600 MDS Consulting (civil engineering): $17,480 MRC Engineering Inc. (electrical engineering): $3,000 Total final design cost: $39,080 Staff has reviewed the proposals, and recommends the City Council approve a Notice to Proceed to Veolia for the final engineering design of the household hazardous waste facility, with a not to exceed budget of $45,000 to provide a contingency for additional services that may be necessary during the final engineering design phase. In accordance with the terms of the CIWMB grant, the household hazardous waste facility must be constructed by March 31, 2009. Therefore, it is critical to complete the final engineering design before the end of the year, to allow for bidding and construction by the grant deadline. FISCAL IMPACT: The price for this work was negotiated pursuant to Section 5.3 of the Agreement with Veolia and will not exceed $45,000. The preliminary construction estimate for the community garden and household hazardous waste facility prepared by Randy Purnei in June 2007 is $356,035, by eliminating the community garden component, the approximate cost estimate for the household hazardous waste facility is $180,000. In addition to the $149,915 CIWMB grant, the City has budgeted $60,000 from the Recycling Fund for this project, and has also obtained a $100,000 contribution towards the permanent household hazardous waste facility from Palm Springs Disposal Services, pursuant to Amendment No. 2 to the Solid Waste Management Services Agreement, approved by City Council on November 14, 2007. Secondly, an analysis of the Hazirlat components with new site and the County of Riverside's requirements, assuring all functional elements are in order. Lastly, design of electrical components, grading and drainage, finalizing with details and specifications of buildings, shade structures, fences, gates, landscape, irrigation, etc. Allached is our proposal detail, as well as the civil and electrical engineers proposals. Description of Services: a)Construction Documents: Randy Purnel Landscape Architects will manage the project as the lead consultant as well as develop detailed drawings depicting all elements of design for the use of accurate and competitive bidding and construction including- at) Sitting, detailing, and specific finishes of office and storage structures. a2) Development, detailing, engineering, and specifications of finishes for shade structures. a3) Hardscape; fence, gates, paving, walls, etc; details and specifications indicating material sizes, finishes, and manufactures. a4) Collaborahon with electrical and civil engineers as needed to design and develop electrical and civil engineering requirements. a5) Landscape planting plan indicating all plant types in botanical and common names, sizes, quantities, locations, and special comments. a6) Landscape irrigation plan indicating the use of water conservation efforts; drip irrigation, base controllers, recycled/treated water system. a7) Attend up to 15 hours of meeting time with client, and/or consultants; to design, review, and coordinate project. Construction documents shall be submitted to the client, the City of Palm Springs, and the County of Riverside. III. Exclusions: a) All specialized engineering and engineering plans including but not limited to grading, drainage, geotechnical, hydraulic, electrical and structural. b) City, DWA, County and State fees and permits. c) Signage design and development. d) Bid processing, analysis. e) Restroom facilities f) Construction Management and/or supervision g) Revisions post document approval, such as: minor adjustments, coordination with consultants/ contractors, RFI, revised/additional material selections, and requests for additional printing/distribution. h) Landscape construction bidding process. IV. Fees: Landscape Architectural fees for the Hazmat Facility shall be: a) Construction Documents $ 12,600,00 VI) Reimbursable Expenses Allowance (Not to exceed and billed accordingly) $ 1,000.00 a2) Shade Structural Engineering Allowance $ 5,000.00 (Not to exceed and billed accordingly) TOTAL $ 18,600.00 V, Additional Fees: Services in addition to those described above are to be compensated on a time and materials basis per Randy Purnel Landscape Architects current hourly fees. Additional services will include but are not limited to: a) Revisions and or changes to the plans that are not part of Section li. Description of Services. b) Revisions as a result of the error of other consultants. c) Changes in the City policies during the term of this agreement. d) Changes in the original description of design work. e) Modifications to the drawings after the approval by Owners. f) Bid coordination and site visit services. Our hourly fees will be as follows: Principal Landscape Architect: $180/hr Landscape Architect: $125/hr Landscape Designer $ 90/hr Draftsmen time: $ 60/hr Secretarial time: $ 70/hr Woes VI. Reimbursable Expenses Allowance: The following are in addition to the fees described above and will be billed at cost plus 15%for bookkeeping and handling. RPLA will estimate a not to exceed amount in the total price and if the reimbursables will go beyond the stated estimate, RPLA will notify the client and receive written approval prior to any other accumulated expenses. Reimbursable expenses include but are not limited to • Reproduction of drawings and specifications for any purpose, including blue lines, black lines, and reproducibles and preparation of CAD files for submission to the owner, contractor or government agency. • Postage costs for distribution of drawings and specifications: (Express Mail, UPS, Federal Express, etc.) • Government plan review fees (if applicable) • City and water district plan check fees. VII. Pay,ment_ ALL FEES ARE DUE UPON RECEIPT OF INVOICE a) RPLA will invoice on a progressive/ percentage of project completion basis. Percentage of the project invoiced for, will be based upon project size and amount of phases. RPLA will include the percentage amounts in the cover letter of the initial proposal to the client(if applicable and at RPLA's discretion). These percentages will include one or more of the following 25%, 50%, 75%, and/or 100%. b) If we have not received payment within 15 days from the date on the invoice for progressive billing RPLA has the option to stop all work on the project, until payment is received. c) Invoices that remain unpaid after 45 days of job/phase completion, will be considered delinquent and will be turned over for collections, unless prior arrangements have been made. d) It is understood that the client agrees to pay the fee as stipulated, and is not solely relying upon obtainment of financing to make payment. If the Landscape Architect is to be paid when the client receives funding from a third party, the fee may be adjusted to compensate for excessive delays. Arbitration:Any controversy or claim arising out of or relating to this contract or the breach thereof shall be settled by arbitration administration by the American Arbitration Association in accordance with its applicable rules, and judgment upon the award rendered by the arbitrator(s) may be entered in the court having jurisdiction thereof. 2. Attorney's Fees and Limitation of Liability: In the event either party is required to bring an action to enforce or interpret any provision herein, the prevailing party shall be entitled to reasonable attorneys fees, as determined by an arbitrator or, if applicable, a court of appropriate jurisdiction, as well as costs, expenses and damages to which said party may be entitled. In no case shall landscape Architect be liable for more than the total amount of his fees. The Owner agrees to indemnify the Landscape Architect from any and all legal actions relating to the services provided in this agreement brought by persons of entities not a party to this agreement. 3. Incorporation of Plans and Specifications: The terms and conditions of the specifications set forth in the specification manual and/or plans are hereby incorporated by reference in this Agreement. Owner and Landscape Architect agree to be bound by said terms and conditions. Wherever there is a conflict between this Agreement and the plans and specifications, the terms and specifications on the plans shall prevail. 4. Owner's responsibilities: shall include, but are not to be limited to: Owner shall be responsible for delivery of an accurate site plan, on electronic media, to the landscape architect; Owner is responsible for accuracy of property lines; and Owner is responsible for proper maintenance of the project after completion Of construction. 5. Termination of Agreement: This agreement will automatically be terminated upon receipt by the Landscape Architect of the final payment from the Owner. Either party may terminate this agreement upon seven (7) days written notice. If the Owner should elect to terminate this agreement, then all fees and expenses accrued but unbilled to that date, plus all outstanding invoices, are immediately due and payable. 6. NOTICE TO PROPERTY OWNER: IF BILLS ARE NOT PAID IN FULL FOR THE LABOR, SERVICES, EQUIPMENT, OF MATERIALS FURNISHED,A MECHANIC'S LIEN LEADING TO THE LOSS,THROUGH COURT FORECLOSURE PROCEEDINGS, OF ALL OR PART OF YOUR PROPERTY BEING SO IMPROVED MAY BE PLACED AGAINST THE PROPERTY EVEN THOUGH YOU HAVE PAID YOUR CONTRACTOR IN FULL.. This item includes obtaining maps and plans from the City of Palm Springs, Desert Water Agency and other applicable utility purveyors. Prepare ❑ geometrically-correct Base Map including boundary delineation, plottoble easements and encumbrances, existing utilities (both wet and dry), and other physical constraints and opportunilies that would affect land planning and construction cost items. CONTROL SURVEY and AERIAL TOPOGRAPHIC MAPPING Perform a complete Horizontal and Vertical Control Survey and prepare an Aerial Topographic Survey at a suitable scale covering the project Site. The aerial mpogrophic survey will include existing ground contour lines, spot elevations and all identifiable features. Note: Our fee for this task has been reduced due to our work on the adjacent Palm Springs Animal Shelter project. PRELIMINARY PRECISE GRADING PLAN Working in conjunction. with Randy Purnel Landscape Architects, prepare a Preliminary Precise Grading concept plan. Submit the concept plan to the project team and revise as requested We anticipate a couple of meetings and revisions to this plan. FINAL PRECISE GRADING PLAN Upon obraining project team acceptance of the Preliminary Precise Grading Plan, prepare one set of the Final Precise Grading Plan in accordance with the requiremen7s of the City of Palm Springs. This Precise Grading Plan will include the construction of a standard offset cul-de-sac at the southerly end of Vella Road. All necessary signing and striping will be included on this plan. PRIVATE WET UTILITY IMPROVEMENT PLANS It is possible that this project may require additional and/or relocated Domestic Water, Sanitary Sewer and Fire Protection improvements.
