2004 CITYWIDE ARHM OVERLAY
RECOMMENDATION:
It is recommended that the City Council award a construction contract in the amount of
$325,892.00 for Bid Schedules A through G inclusive to International Pavement
Solutions, Inc., for the 2004 Citywide ARHM Overlay Project, City Project 04-01.
SUMMARY:
Award of this contract will provide for an asphalt rubber hot mix (ARHM) overlay of
several streets throughout the City that require additional maintenance beyond the
typical slurry seal, and include: Araby Drive, Barona Road and Anza Trail, the Movie
Colony area (Via Altamira, Valmonte Norte, Avenida Palo Verde, Via Corta, Granvia
Valmonte, Valmonte Sur, Via Colusa, and Camino Real), and Alejo Road.
BACKGROUND:
The Public Works & Engineering Department oversees the maintenance of the City's
street system. The City uses a computer inventory system (a Pavement Management
System) that compiles a listing of the City's streets and maintains the overall condition of
each street. A list of streets in need of major repairs has been compiled. An overlay of
asphalt rubber hot mix (ARHM) material is proposed to seal larger cracks and overlay
the entire street to provide an extension of its life. The material uses rubber generated
from scrap tires. The State has approved a recycled rubber grant to the City in the
amount of $6,000. In addition, the 2003/2004 and 2004/2005 budgets have a total of
$371,000 for this project. The project was divided into seven bid schedules, to allow
Council to award street work depending on actual bid prices received. The schedule
breakdown is as follows:
Schedule A - Araby Drive
Schedule B - Barona Road and Anza Trail
Schedule C - Via Altamira, Valmonte Norte, Avenida Palo Verde and Via Corta from
Altamira to 40' north of Granvia Valmonte.
Schedule D - Granvia Valmonte west of Via Miraleste, Valmonte Sur, Via Colusa and
Via Corta from 40' north of Granvia Valmonte to Via Colusa
Schedule E - Granvia Valmonte east of Via Miraleste and Camino Real
Schedule F - Alejo Road adjacent to Frances Stevens Park
Schedule G - Sewer manhole raising on Gene Autry Trail (paid from sewer fund)
The plans and specifications (PS&E) were prepared by Engineering Division staff. On
September 15, 2004, the City Council approved the PS&E and authorized advertising for
construction bidding. The project was advertised for bids on September 28 and October
5, 2004, and at 2:00 P.M. on October 19, 2004, the Department of Procurement and
Contracting received bids from the following contractors:

The Engineer's Estimate after final design was $529,000. Despite currently high
gasoline and oil prices, the construction bids received were significantly lower than
previous unit prices received on our last ARHM overlay project. The low bid allows staff
to recommend award of all the bid schedules and to facilitate an ARHM overlay of all the
streets originally identified for this project.
Although staff coordinated with Desert Water Agency (DWA), as well as other utility
companies, during and after preparation of the PS&E for this project, staff learned during
bidding of this project that DWA has a future project that affects a portion of the streets
scheduled to receive an ARHM overlay with award of this project. DWA is currently
designing a reclaimed water line to serve the Agua Caliente Development Authority's
(ACDA) newly renovated golf course in the South Palm Canyon area (adjacent to Murray
Canyon Drive). The reclaimed water line will run from the current service point in the
Tahquitz Creek golf course, south on El Cielo Road to Escoba Drive, west on Escoba
Drive to Araby Drive, south on Araby Drive to Morongo Trail, west on Morongo Trail to
Barona Road, then south on Barona Road to the Palm Canyon Wash and the ACDA's
golf course.
The DWA reclaimed water line will require DWA to trench through the north half of the
segment of Araby Drive scheduled for an ARHM overlay (East Palm Canyon Drive to the
Palm Canyon Wash), as well as the south half of the segment of Barona Road
scheduled for an ARHM overlay (East Palm Canyon Drive to Murray Canyon Drive).
The Engineering Division has been in contact with DWA regarding scheduling and
coordination of the City and DWA's projects. DWA will not be ready to install the
reclaimed water line until April 2005 at the earliest, based on information recently
received. The Engineering Division expects that construction of the ARHM overlay may
begin by mid-January. Therefore, to avoid DWA's project from ruining a new ARHM
overlay, it may be necessary for staff to recommend at a later date a deletion of the
portions of Araby Drive and Barona Road from the project and postponing their overlay
for the next annual ARHM overlay project; or, to delay the construction contractor and
have these streets overlaid following DWA's project, which would require consideration
of a contract change order and an extra cost to the contract to remobilize the contractor
at that time. In any event, staff will take steps to avoid a newly overlaid street to be
excavated by DWA's project.

The low bidder is International Pavement Solutions, Inc., from San Bernardino, CA. The
company is a Nevada corporation whose officers are: Brent C. Rieger, President; Dennis
C. Rieger, Treasurer/CEO; Nancy Escobedo, Secretary. Sufficient funds are available in
the local Measure A fund, account number 134-4498-50225 (ARHM Overlay) and the
Wastewater Treatment Plant fund, account number 420-6800-50000 (unscheduled
capital projects).

N-1 NOTICE IS HEREBY GIVEN that sealed bids for the 2004 CITYWIDE
ARHM OVERLAY PROJECT will be received at the office of the Director
of Procurement and Contracting of the City of Palm Springs,
California, until 2 P.M. on October 19, 2004, at which time they will
be opened and read aloud.
N-2 DESCRIPTION OF THE WORK: The work comprises the cold planing and
grinding of existing asphalt concrete pavement; construction of
I asphalt rubber hot mix (ARHM) overlay; traffic striping and
markings; sewer manhole adjustments to grade; and all appurtenant
work on the following locations:
1 . Araby Drive from STA. 3+96 . 77 to STA. 20-I-44 . 50;
2 . Barona Road from 600' south of East Palm Canyon Drive to
Jacaranda Road;
3 . Anza Trail from Barona Road to Sta. 1+70;
4 . Via Altamira from Via Chica to Via Miraleste;
5 . Valmonte Norte from Via Chica to Via Corta;
6. Avenida Palo Verde from Tamarisk Road to Via Altamira;
7 . Via Corta from Via Colusa to Via Altamira;
8 . Granvia Valmonte from Via Corta to Avenida Caballeros;
9 . Valmonte Sur from Via Chica to Via Corta;

N-3 AWARD OF CONTRACT:
(a) The City reserves the right after opening bids to reject any
or all bids, to waive any informality (non-responsiveness) in a bid,
or to make award to the lowest responsive, responsible bidder on the
basis of the total sum of Bid Schedules A, B, C, D, E, F and G, and
reject all other bids, as it may best serve the interest of the City.
Bidder shall bid on all bid schedules .
(b) As a condition of award, the successful bidder will be
required to submit payment and performance bonds and insurance .
N-4 BID SECURITY: Each bid shall be accompanied by a certified or
cashier ' s check or Bid Bond in the amount of 10 percent of the total '
bid price, sum of Bid Schedules A through G inclusive, payable to the
City of Palm Springs . "

N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid
Price for a period of 60 calendar days from the date of bid opening.
N-6 CONTRACTOR' S LICENSE CLASSIFICATION: The Contractor shall
possess a valid Class A or C12 Contractor license at the time of
submitting bids .
N-7 CALIFORNIA WAGE RATE REQUIREMENTS : The Contractor shall pay the
general prevailing rate of per diem wages as determined by the
Director of the Department of Industrial Relations of the State of
California for the locality where the work is to be performed. A copy
of said wage rates is on file at the office of the City Engineer.
The Contractor and any subcontractors shall pay not less than said
specified rates and shall post a copy of said wage rates at the
project site .
N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100
percent of payments due under the Contract Documents from time to
time, without retention of any portion of the payment by the City, by
depositing securities of equivalent value with the City in accordance
with the provisions of Section 22300 of the Public Contract Code.
N-9 OBTAINING OR INSPECTING CONTRACT DOCUMENTS :
(a) Contract Documents may be inspected without charge at the
office of the City Engineer, 3200 East Tahquitz Canyon Way, Palm
Springs, CA 92262 .
(b) Complete sets of said Contract Documents may be purchased at
$35 . 00 per set and are obtainable from the office of the City
Engineer, 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262 . No
refund will be made of any charges for sets of Contract Documents .
(c) An additional fee of $20 . 00 will be charged for sets of
documents sent by mail.
N-11 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid
shall be sealed and addressed to the City of Palm Springs, and shall
be delivered or mailed to the Director of Procurement and Contracting
at 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262 . The
envelope shall be plainly marked in the upper left hand corner with
the name and address of the Bidder and shall bear the words "Bid
For. . " followed by the title of the Project and the date and hour of
opening Bids . The certified or cashier' s check or Bid Bond shall be
enclosed in the same envelope with the Bid.
