F pLM sAq ry F c u � R k N eel N i q n City Council Staff Report July 30, 2008 CONSENT CALENDAR Subject: AWARD OF CONTRACT FOR THE TRAFFIC SIGNAL LOOP REPAIR PROJECT (CITY PROJECT 07-11), SUNRISE WAY AT ALEJO ROAD TRAFFIC SIGNAL MODIFICATION (CITY PROJECT 07-12), SUNRISE WAY AT MESQUITE AVENUE TRAFFIC SIGNAL MODIFICATION (CITY PROJECT 07-14), AND 2007/2008 PROTECTED-PERMISSIVE TRAFFIC SIGNAL CONVERSION PROJECT, (CITY PROJECT 07-19) From: David H. Ready, City Manager Initiated by: Public Works and Engineering Department SUMMARY The Public Works and Engineering Department has inventoried existing traffic signals that should be modified to remove protected signal phasing, and install protected/permissive signal phasing, to improve traffic flow. Award of this contract will allow staff to proceed with these traffic signal projects. RECOMMENDATION: 1) Approve Agreement No. in the amount of $621,199.00 with Steiny and Company, Inc., for Bid Schedules A through F, inclusive, for the Traffic Signal Loop Repair Project (City Project 07-11), Sunrise Way at Alejo Road Traffic Signal Modification (City Project 07-12), Sunrise Way at Mesquite Avenue Traffic Signal Modification (City Project 07-14), and 2007/2008 Protected-Permissive Traffic Signal Conversion Project, (City Project 07-19); and 2) Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: The Public Works and Engineering Department has inventoried existing traffic signals that should be modified to remove protected signal phasing, and to install protected/permissive signal phasing. In the past, it was common to install a full- functioning 8-phase traffic signal (allowing traffic movement in each direction of a four- way intersection, and for each left-turn phase). However, the industry has subsequently analyzed ways to improve the efficiency of traffic movement on arterial streets, and ITEM NO. !l "M City Council Staff Report July 30, 2008 - Page 2 Various Traffic Signal Projects determined that removal of protected phasing where not required drastically decreases delay of vehicles at signalized intersections. A protected/permissive signal is one that has a five-section vehicle head on the signal mast arm, shown at right below, and has a five-section vehicle head on the far pole, shown at left below: R Fi v Y I� G r ll� Y `Y L+ This type of signal phasing allows traffic to move through the intersection more efficiently, giving left-turning vehicles a "permissive" movement, allowing the turn when there are no opposing vehicles. In a true "protected" phase, a vehicle must wait for the green arrow to make the movement, whether or not there is opposing traffic. Previously, staff had identified and converted the following traffic signals to permissive, or protected/permissive signal phasing; or ensured the original design of new signals included protected/permissive signal phasing: • Indian Canyon Drive at San Rafael Road • Tahquitz Canyon Way at Palm Canyon Drive • Tahquitz Canyon Way at Indian Canyon Drive • Tahquitz Canyon Way at El Cielo Road • East Palm Canyon Drive at Cerritos Road/Smoketree Lane • East Palm Canyon Drive at Camino Real • South Palm Canyon Drive at Morongo Road • Farrell Drive at Via Escuela • Farrell Drive at Alejo Road • Farrell Drive at Baristo Road • Farrell Drive at Mesquite Avenue • Ramon Road at El Placer • Sunrise Way at Racquet Club Road • East Palm Canyon Drive at Smokee Tree Commons (Shopping Center) East Palm Canyon Drive at Farrell Drive • Ramon Road at San Luis Rey Drive • Ramon Road at Paseo Dorotea • Sunrise Way at Tachevah Drive J rr City Council Staff Report July 30, 2008- Page 3 Various Traffic Signal Projects • Sunrise Way at Amado Road • East Palm Canyon Drive at Cherokee Way • Ramon Road at Crossley Road • Tahquitz Canyon Way at Farrell Drive For the current City project, Staff has identified the following intersections that are eligible for conversion to protected/permissive signal phasing: • Sunrise Way at Alejo Road • Sunrise Way at Mesquite Avenue • Dinah Shore Drive at Crossley Road • Sunrise Way at Baristo Road • Indian Canyon Drive at Racquet Club Road At each intersection, existing protected phasing on one or both approaches will be converted to permissive phasing, or protected/permissive phasing; and in certain cases where protected phasing is warranted, protected/permissive phasing is added. Other modifications are proposed, including the addition of emergency vehicle preemption systems, and uninterrupted power supply systems (to keep the signals operational during power outages). The plans and specifications were prepared by Department staff, and on, June 18, 2008, the City Council approved the plans and specifications and authorized construction bidding. On June 21 and 28, 2008, the project was advertised for bids, and at 2:00 p.m. on July 22, 2008, the Procurement and Contracting Division received construction bids from the following contractors: 1. Steiny and Company, Inc.; Baldwin Park, CA; $621,199 2. DBX, Inc.; Temecula, CA; $625924 3. Christopher R. Morales, Inc.; San Dimas, CA; $682,720 4. PTM General Engineering Services, Inc.; Riverside, CA; $686,600 5. HMS Construction, Inc.; Vista, CA; $705,000 6. Sierra Pacific Electrical Contracting, Riverside, CA; $712,670 7. Brudvik, Inc.; Palm Springs, CA; $723,930 8. Moore Electrical Contracting, Inc.; Corona, CA; $726,750 9. Traffic Loops Crackfilling; Anaheim, CA; 735,700 The Engineer's estimate for this project was $600,000. The bid summary is on file with the Public Works and Engineering Department. The low bid was submitted by Steiny and Company, Inc., a California corporation. The corporate officers are: J. O. Steiny, Chairman; Susan Steiny, President; Richard Tesoriero, Vice President; and Gayle C. Kappelman, Secretary. Agreement This account was originally established for construction of a new traffic signal at Indian Canyon Drive and Tamarisk Road; however, subsequently the City was successful in receiving a federal grant for the installation of this traffic signal. Therefore, these funds are now being allocated for the Sunrise Way and Alejo Road traffic signal modification. Riverside County Transportation Commission approval of an amendment to the City's Measure A Plan to reallocate the funding for this signal is on file with the City Engineer. AGREEMENT THIS AGREEMENT made this day of 200_, by and between the City of Palm Springs, a charter city, organized and existing in the County of Riverside, under and by virtue of the laws of the State of California, hereinafter designated as the City, and Steinv and Company_ Inc. hereinafter designated as the Contractor. The City and the Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1 --THE WORK The Contractor shall complete the Work as specified or indicated under the Bid Schedule(s) of the City's Contract Documents entitled: VARIOUS TRAFFIC SIGNAL PROJECTS CITY PROJECT NO. 07-11, 07-12, 07-14, AND 07-19 The Work is generally described as follows: modification of existing traffic signals, including relocation of existing vehicle heads, traffic signal rewiring, installation of traffic signs, relocation of traffic signal controllers, emergency pre-emption systems, uninterrupted power supply systems, relocation of equipment, and other associated work at the following locations: • Sunrise Way at Alejo Road • Sunrise Way at Mesquite Avenue • Dinah Shore Drive at Crossley Road • Sunrise Way at Baristo Road • Indian Canyon Drive at Racquet Club Road The work also comprises the replacement of traffic signal loop detectors at various locations with new installation of Type E loop detectors, and associated work. ARTICLE 2 -- COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall commence on the date specified in the Notice to Proceed by the City, and the Work shall be fully completed within the time specified in the Notice to Proceed. The City nnd the Contractor recognize that time is of the essence of this Agreement, and that the City will suffer financial loss if the Work is not completed within the time specified in Article 2, herein, plus any extensions thereof allowed in accordance with applicable provisions of the Standard Specifications, as modified herein. They also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the City if the Work is not completed on time. Accordingly, instead of VARIOUS TRAFFIC SIGNAL PROJECTS AGREEMENT FORM CITY PROJECT NO.07-11,07.12,07.14, 07-19 6113/08 AGREEMENT AND BONDS-PAGE 1 requiring any such proof, the City and the Contractor agree that as liquidated damages or delay (but not as a penalty), the Contractor shall pay the City the sum of $1,500 for each calendar day that expires after the time specified in Article 2, herein. In executing the Agreement, the Contractor acknowledges it has reviewed the provisions of the Standard Specifications, as modified herein, related to liquidated damages, and has made itself aware of the actual loss incurred by the City due to the inability to complete the Work within the time specified in the Notice to Proceed. ARTICLE 3 CONTRACT PRICE $621,199.00 (Bid Schedules A— F inclusive) The City shall pay the Contractor for the completion of the Work, in accordance with the Contract Documents, in current funds the Contract Price(s) named in the Contractor's Bid and Bid Schedule(s). ARTICLE 4 -- THE CONTRACT DOCUMENTS The Contract Documents consist of the Notice Inviting Bids, Instructions to Bidders, the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations, the accepted Bid and Bid Schedule(s), List of Subcontractors, Non-collusion Affidavit, Bidder's General Information, Bid Security or Bid Bond, this Agreement, Worker's Compensation Certificate, Performance Bond, Payment Bond, Standard Specifications, Special Provisions, the Drawings, Addenda numbers 0 to 0 , inclusive, and all Change Orders and Work Change Directives which may be delivered or issued after the Effective Date of the Agreement and are not attached hereto. ARTICLE 5 -- PAYMENT PROCEDURES The Contractor shall submit Applications for Payment in accordance with the Standard Specifications as amended by the Special Provisions. Applications for Payment will be processed by the Engineer or the City as provided in the Contract Documents. ARTICLE 6 -- NOTICES Whenever any provision of the Contract Documents requires the giving of a written Notice, it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address known to the giver of the Notice. ARTICLE 7 -- MISCELLANEOUS Terms used in this Agreement which are defined in the Standard Specifications and the Special Provisions will have the meanings indicated in said Standard Specifications and the Special Provisions. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound, and specifically, but without limitation, monies that may become due and monies that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no VARIOUS TRAFFIC SIGNAL PROJECTS AGREEMENT FORM CITY PROJECT NO.07-11,07-12,07-14,07-19 ,'� �' AGREEMENTAND BONDS-PAGE 2 6113108 assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. The City and the Contractor each binds itself, its partners, successors, assigns, and legal representatives, to the other party hereto, its partners, successors, assigns, and legal representatives, in respect of all covenants, agreements, and obligations contained in the Contract Documents.
