Home My WebLink About12/15/2004 - STAFF REPORTS (5) RESOLUTION NO. 21157 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 2nd OF NOVEMBER, 2004, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS, a special municipal election was held and conducted in the City of Palm Springs, California, on November 2, 2004, as required by law; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS on June 9, 2004, and July 21, 2004, the City Council called a Special Municipal Election to be consolidated with the November 2, 2004, presidential election, for the purpose of placing Citizen Petition Referendum and Council Initiated Measures concerning Resolution 20866 and Utility User Tax, respectively; and WHEREAS pursuant to Resolutions 20975 and 21063 adopted June 9, 2004, and July 21, 2004, respectively, the City Clerk of said City has caused the canvass of the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as Exhibit A, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That there were 19 voting precincts established for the purpose of holding said election consisting of consolidations of the regular elections precincts in said City as established for the holding of state and county elections. Section 2. That said special municipal election was held for the purpose of submitting the following measures to the electors of said City; to-wit: MEASURE [ U ] Shall Resolution 20866 approving amendments to the General Plan Use and Circulation Plan for Section 14 be adopted? MEASURE [ V ] Shall the ordinance to permit the Council to increase the existing utility users tax by up to three percent for a period of no more than three years be adopted? Section 3. That the number of votes given at each precinct and the number of votes given in the City to each of the Measures, are as listed in Exhibit A attached. Resolution No. 21157 Page 2 Section 4. That as a result of said election, a majority of the qualified voters voting on Measure U, "Shall Resolution 20866 approving amendments to the General Plan Use and Circulation Plan for Section 14 be adopted?", did vote in favor thereof, and that same measure was approved. Section 5. That as a result of said election, a majority of the qualified voters voting on Measure V, "Shall the ordinance to permit the Council to increase the existing utility users tax by up to three percent for a period of no more than three years be adopted?", did vote against thereof, and that same measure was rejected. Section 6. The City Clerk shall enter on the records of the City Council of said City, a statement of the results of said election, showing: (1) The measures voted upon; (2) The number of votes given at each precinct for and against each measure; (3) The total number of votes given in the City for and against each measure; and (4) The whole number of votes cast in the City.
